Immediate family or household. The employee is only entitled to carer’s or compassionate leave if the person for whom the leave is being taken is: a) a member of the employee’s immediate family; or b) a member of the employees’ household. The term immediate family includes; a) spouse (including a former spouse, a de facto spouse and a former de facto spouse) of the employee. A de facto spouse means a person who lives with the employee as his or her partner on a bona fide domestic basis including a same sex partner; and b) child or an adult child (including an adopted child, step child or an ex-nuptial child), parent, grandparent, grandchild, or sibling of the employee or spouse of the employee.
