In-Licensed Materials and Open Source. The Nextmidi Software may contain or may operate with software, services or other technology which may be necessary for the full operation of the Nextmidi Software and that is not owned by Nextmidi but has been licensed to Nextmidi by a third party (“In-Licensed Materials”) or that is available under open source or free software li- censes. The In-Licensed Materials may be subject to additional terms and conditions as made available to Customer in a README.txt file or the like. To the extent Nextmidi uses open source software in the Nextmidi Software, the terms and restrictions in this Nextmidi XXXX shall not prevent or restrict Customer from exercising additional or different rights to such open source software in accord- ance with the applicable open source licenses. The open source software may be subject to additional terms and conditions as made available to Customer in a README.txt file or the like.

Any fees charged by DI in connection with the Deep Instinct Software do not apply to any In-Licensed Materials for which fees may not be charged under the applicable In-Licensed Materials licenses. All In-Licensed Materials are provided "AS IS" without warranty of any kind, and subject to the applicable license terms attached to such In-Licensed Materials or if no such terms are attached, then under the terms of this Agreement and accordingly, the restrictions contained in this Agreement shall apply to such In-Licensed Materials.

Company does not assume and will not have any liability or responsibility to you or any other person or entity for any Third-Party Materials.   • Licensed Software Computer program(s) provided by Contractor in connection with the Deliverables, subject to Section 14 of this Contract.
