INCIDENTS REQUIRING REPORTING. 1. If the Provider is CQC registered it shall comply with the requirements and arrangements for notification of deaths and other incidents to CQC in accordance with CQC Regulations and if the Provider is not CQC registered it shall notify Serious Incidents to any Regulatory Body as applicable, in accordance with the Law.
2. If the Provider gives a notification to the CQC or any other Regulatory Body under clause B11.1 which directly or indirectly concerns any Service User, the Provider must send a copy of it to the Authority within 5 Business Days or within the timescale set out in Appendix G (Incidents Requiring Reporting Procedure).
INCIDENTS REQUIRING REPORTING. 1. If the Service Provider is CQC registered it shall comply with the requirements and arrangements for notification of deaths and other incidents to CQC in accordance with CQC Regulations and if the Service Provider is not CQC registered it shall notify Serious Incidents to any Regulatory Body as applicable, in accordance with the Law.

If the Provider gives a notification to the CQC or any other Regulatory Body under clause B13.1. which directly or indirectly concerns any Service User, the Provider must send a copy of it to the Commissioned Service within 5 Business Days or within the timescale set out in APPENDIX C: (Incidents Requiring Reporting Procedure). The Parties must comply with the arrangements for reporting, investigating, implementing and sharing the Lessons Learned from Serious Incidents, Patient Safety Incidents and non-Service User safety incidents that are agreed between the Provider and the Commissioned Service and set out in APPENDIX C: (Incidents Requiring Reporting Procedure). Subject to the Law, the Commissioned Service shall have complete discretion to use the information provided by the Provider under this clause B13.1. and APPENDIX C: (Incidents Requiring Reporting Procedure).
INCIDENTS REQUIRING REPORTING. 16.1 The Contractor shall notify Serious Incidents to any regulatory body as applicable, in accordance with the Law.
16.2 The Contractor will in connection with the performance of the Services notify the School of any Serious Incident which directly or indirectly concerns any pupil, employee or member of the School, visitor or any member of the public affected or any other incident or change in circumstances that may affect the safety or well-being of such a person or persons as soon as practically possible and in any event within 5 Working Days.
16.3 The Parties must comply with the arrangements for reporting, investigating, implementing and sharing the lessons learned from serious incidents and non-Service User(s) safety incidents that are agreed between the Contractor and the School.
16.4 Subject to the Law, the School shall have complete discretion to use the Information provided by the Contractor under this clause 16.
INCIDENTS REQUIRING REPORTING. 26.1 If the Provider is CQC registered it shall comply with the requirements and arrangements for notification of deaths and other incidents to CQC in accordance with CQC Regulations and if the Provider is not CQC registered it shall notify Serious Incidents to any Regulatory Body as applicable, in accordance with the Law.
26.2 If the Provider gives a notification to the CQC or any other Regulatory Body which directly or indirectly concerns any Service User, the Provider must simultaneously send a copy of it to the Council.
26.3 Subject to the Law, the Council shall have complete discretion to use the information provided by the Provider in relation to this clause 25.
INCIDENTS REQUIRING REPORTING. If a notification the Provider gives to any Regulatory Body directly or indirectly concerns any Service User, the Provider must send a copy of it to the Authority. The Authority will have complete discretion (subject only to the provisions of the Data Protection Act 1998) to use the information provided by the Provider under this Section in any report which they make to any Regulatory Body, and NHS Body, any office or agency of the Crown, or to any other appropriate regulatory or official body in connection with Serious Incidents, or in relation to the prevention of Serious Incidents, provided that in each case they notify the Provider of the information disclosure and the body to which they have disclosed it. As per Clause GC18 of the General Conditions (Incidents Requiring Reporting), the Provider must consider and respond to the recommendations arising from any audit, Serious Incident or Patient Safety Incident Report.

2. If the Provider gives notification to the CQC or any other Regulatory Body under clause A19.1 which directly or indirectly concerns any Service User, the Provider must send a copy of it to the Trust within 1 Business Day.
3. The Provider must comply with the arrangements for reporting, investigating, implementing and sharing the Lessons Learned from Serious Incidents, Patient Safety Incidents and non-Service User safety incidents that have been agreed between the Trust and the Authority as contained in the Authority Contract; an extract of this can be found at Appendix B (Incidents Requiring Reporting Procedure).
A19.4. Subject to the Law, the Trust shall have complete discretion to use the information provided by the Provider under this clause A19 and Appendix B (Incidents Requiring Reporting Procedure).
INCIDENTS REQUIRING REPORTING. The Provider must comply with the arrangements for notification of deaths and other incidents to CQC, in accordance with CQC Regulations and Guidance (where applicable), and to any other relevant Regulatory or Supervisory Body, any NHS Body, any office or agency of the Crown, or to any other appropriate regulatory or official body in connection with Serious Incidents, or in relation to the prevention of Serious Incidents (as appropriate), in accordance with Good Practice and the Law If the Provider gives a notification to the CQC or any other Regulatory Body under clause which directly or indirectly concerns any Service User, the Provider must send a copy of it to the Authority within 5 Business Days or within the timescale set out in APPENDIX C: (Incidents Requiring Reporting Procedure). The Parties must comply with the arrangements for reporting, investigating, implementing and sharing the Lessons Learned from Serious Incidents, Patient Safety Incidents and non-Service User safety incidents that are agreed between the Provider and the Authority and set out in APPENDIX C: (Incidents Requiring Reporting Procedure). Subject to the Law, the Authority shall have complete discretion to use the information provided by the Provider under this clause and APPENDIX C: (Incidents Requiring Reporting Procedure).
INCIDENTS REQUIRING REPORTING. If the Provider is CQC registered it shall comply with the requirements and arrangements for notification of deaths and other incidents to CQC in accordance with CQC Regulations and if the Provider is not CQC registered it shall notify serious incidents to any regulatory body as applicable, in accordance with the Law. If the Provider gives a notification to the CQC or any other regulatory body regarding serious untoward incidents and patient safety incidents which directly or indirectly concerns any service user, the Provider shall send the Council a copy of any notification within one month of the original submission of the notification. The Parties must comply with the arrangements for reporting, investigating, implementing and sharing the Lessons Learned from serious incidents, patient safety incidents and non-service user safety. Subject to the Law, the Council shall have complete discretion to use the information provided by the Provider under this Clause B.5.
