INGRESS, EGRESS, AND LOCATION. Operator hereby assigns to Contractor all necessary rights of ingress and egress with respect to the tract on which the well is to be located for the performance by Contractor of all work contemplated by this Contract, Should Contractor be denied free access to the location for any reason not reasonably within Contractor’s control, any time lost by Contractor as a result of such denial shall be paid for at the standby time rate. Operator agrees at all times to maintain the road and location in such a condition that will allow free access and movement to and from the drilling site in an ordinarily equipped highway type vehicle. If Contractor is required to use bulldozers, tractors, four-wheel drive vehicles, or any other specialized transportation equipment for the movement of necessary personnel, machinery, or equipment over access roads or on the drilling location, Operator shall furnish the same at its expense and without cost to Contractor. The actual cost of repairs to any transportation equipment furnished by Contractor or its personnel damaged as a result of improperly maintained access roads or location will be charged to Operator, Operator shall reimburse Contractor for all amounts reasonably expended by Contractor for repairs and/or reinforcement of roads, bridges and related or similar facilities (public and private) required as a direct result of a rig move pursuant to performance hereunder. Operator shall be responsible for any costs associated with leveling the rig because of location settling.

Producer shall reimburse Contractor for all amounts reasonably expended by Contractor for repairs and/or reinforcement of roads, bridges and related or similar facilities (public and private) resulting from Producer’s failure to comply with its obligations hereunder. Notwithstanding anything contained in this Contract to the contrary, Contractor shall be responsible for all Claims arising out of damage to public roadways, bridges, and appurtenances to the extent required by law and caused by the negligence and willful misconduct of Contractor Group.

Zion agrees at all times to maintain the road and Location in such a condition that will allow free access and movement to and from the site in an ordinarily equipped highway type vehicle. If Contractor is required to use bulldozers, tractors, four-wheel drive vehicles, or any other specialized transportation equipment for the movement of necessary personnel, machinery, or equipment over access roads or on the Location, Zion shall furnish the same at its expense and without cost to Contractor. The actual cost of repairs to any transportation equipment furnished by Contractor or its personnel damaged as a result of improperly maintained access roads or Location will be charged to Zion.
INGRESS, EGRESS, AND LOCATION. 30.1. Subject to Contractor’s continued adherence with all obligations required of Contractor Personnel as set forth in this Contract, Operator shall be responsible for providing all necessary rights of ingress and egress to each drilling location, as well as for selecting, marking, and clearing each drilling location, for providing proper and sufficient certificates, including all consents, licenses, approvals, permits or permission necessary pursuant to applicable Laws to enter upon and operate on each drilling location, and for notifying Contractor of any obstructions, impediments, or hazards to operations in the area of each drilling location, including but not limited to wellheads, pipelines, cables, military ordinance, mines, caverns and sink holes. Should Contractor be denied free access to a location for any reason not reasonably within Contractor’s control, any time lost by Contractor as a result of such denial shall be paid at the Standby Rate. 30.2. Operator agrees at all times to maintain the road and drilling location in such a condition that will allow free access and movement to and from and between each location in a loaded conventional four-wheel drive oilfield truck and fuel truck. The actual cost of repairs to any transportation equipment furnished by Contractor or Contractor’s Personnel damaged as a result of the condition of access roads or the location being other than as required by this Article 30 will be charged to and paid by Operator. Contractor shall be responsible for all amounts expended by Contractor for repairs and reinforcement of roads, bridges and related or similar facilities (public and private) required as a result of a Drilling Rig move pursuant to performance hereunder. Operator shall be responsible for any costs associated with leveling the Drilling Rig because of location settling.

Related to INGRESS, EGRESS, AND LOCATION

  • UNDERGROUND LOCATIONS Prior to the Company commencing any work the Customer must advise the Company of the precise location of all underground services on the site and clearly xxxx the location. The underground mains and services the Customer must identify include, but are not limited to, telephone cables, fibre optic cables, electrical services, gas services, sewer services, pumping services, sewer connections, sewer sludge mains, water mains, irrigations pipes, oil pumping mains and any other services that may be on site. Whilst the Company will take all care to avoid damage to any underground services the Customer agrees to indemnify the Company in respect of all any liability claims, loss, damage, cost and fines as a result of damage to services not precisely located and notified pursuant to this clause.

  • Ownership and Location of Metering Equipment The Metering Equipment to be constructed, the capability of the Metering Equipment to be constructed, and the ownership thereof, are identified on the attached Schedule C to this ISA.
