Installation & Use. The Provider or its agent will supply and install the Provider Equipment and a connection to the Service, or the Provider may at its option permit Subscriber to self install the Provider provided Equipment. Subscriber shall follow all self installation instructions and assumes sole responsibility with respect to self installation. WITHOUT LIMITING THE FOREGOING, IN NO EVENT SHALL the Provider OR ANY UNDERLYING PROVIDERS BE LIABLE FOR ANY LOSS OR DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY (INCLUDING DEATH) OR DAMAGE TO PROPERTY, ARISING DIRECTLY OR INDIRECTLY OUT OF THE INSTALLATION OR CONNECTION OF SUCH EQUIPMENT BY SUBSCRIBER. The Provider may charge Subscriber a fee for any missed installation/upgrade appointments without notice 24 hours in advance. If Provider is hired to install Providers equipment at Subscriber's property, Subscriber gives permission and accepts responsibility for the property upon which the Providers Equipment is attached.

Installation & Use. Your installation and use of any software; cloud services or developer tools provided as Subscription Benefits is subject to separate license terms provided with the software, services or tools, such as click-through license terms, except for any changes to those terms that are provided in this Agreement. You may only use these Subscription Benefits in a virtual environment if allowed by the specific product end user license. Of course, you may not use the software, cloud services of developer tools to develop any form of malicious software or spamware.

Installation & Use. Desktop Fonts can be installed and used on the number of computing devices and workstations specified and indicated on a receipt from the time of purchase of the Licenses (includes screens displaying information that the Licensee entered on the website where the Licensor sells Desktop Fonts). The Licensee is responsible to keep track that the license limitations are kept within the tier and used internally.

  • Installation Where installation is required, Contractor shall be responsible for placing and installing the product in the required locations at no additional charge, unless otherwise designated on the Contract or purchase order. Contractor’s authorized product and price list shall clearly and separately identify any additional installation charges. All materials used in the installation shall be of good quality and shall be free of defects that would diminish the appearance of the product or render it structurally or operationally unsound. Installation includes the furnishing of any equipment, rigging, and materials required to install or replace the product in the proper location. Contractor shall protect the site from damage and shall repair damages or injury caused during installation by Contractor or its employees or agents. If any alteration, dismantling, excavation, etc., is required to achieve installation, the Contractor shall promptly restore the structure or site to its original condition. Contractor shall perform installation work so as to cause the least inconvenience and interference with Customers and with proper consideration of others on site. Upon completion of the installation, the location and surrounding area of work shall be left clean and in a neat and unobstructed condition, with everything in satisfactory repair and order.

  • Installations 2.1. This test shall be conducted with either the complete REESS or with a related REESS subsystem(s) including the cells and their electrical connections. If the manufacturer chooses to test with related subsystem(s), the manufacturer shall demonstrate that the test result can reasonably represent the performance of the complete REESS with respect to its safety performance under the same conditions. If the electronic management unit for the REESS is not integrated in the casing enclosing the cells, then the electronic management unit may be omitted from installation on the Tested-Device if so requested by the manufacturer.

  • Installation and Use You may install and use the Software only for the number of licenses acquired by you. In order to exercise your rights to the Software under this Agreement, you must activate your copy of the Software in the manner described during the launch sequence.

  • Installation, Maintenance, Testing and Repair Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party.
