Common use of Instant Dismissal Clause in Contracts

Instant Dismissal. a) An employee may be dismissed without notice (instant dismissal) for serious misconduct or neglect of duty, in which case wages will be paid up to the time of dismissal only. b) Serious misconduct includes but is not limited to the following: • Theft of company or clients’ property, fraud, dishonesty • Unauthorised use of company or a clients equipment or property • Engaging in any verbal or physical abuse (with customers, colleagues, contractors, (client representatives) or any other person. • Consumption of, or reporting for work under the influence of, alcohol or a prohibited substance. • Harassment or discrimination • Any serious breach of the company’s policies. c) Neglect of duty means negligence or refusal to obey a lawful and reasonable instruction of the employer. d) The company may suspend an employee with or without pay whilst a matter of serious misconduct or neglect of duty is investigated.
