INTERIOR STREETS. The Riverfront Site includes interior public streets, some of which are not improved (i.e., “paper streets”), some of which are identified on City maps as “closed”, and some of which are currently open to the public but not consistently maintained by the City. These interior streets provide important intra-campus circulation for the ProMedica Headquarters Project and thus are a vital component for the development and operation of the ProMedica Headquarters Project. The City will agree to provide the following support relating the interior streets:

INTERIOR STREETS. All interior streets shall be constructed by Owner as depicted on the Preliminary Engineering Plans.
INTERIOR STREETS. The Owner shall dedicate at its sole expense or cause to be dedicated by each Developer of a phase within the Territory, to the Village, concurrent with recording of the final plat of subdivision for any phase adjacent to each roadway being dedicated within the Lennar Development, all necessary rights-of-way as provided for herein as depicted on the Final Plats of Subdivision. The roadways within the LMC Development will be privately owned roadways maintained by LMC.
INTERIOR STREETS. All interior streets shall be constructed by Developer as depicted on the Final Engineering Plans. In the areas depicted on the Final Engineering Plan where a center median is to be constructed, the center median shall be a minimum of eight feet (8') wide from back of curb to back of curb with pavement sections on either side measuring at least fourteen feet (14').
INTERIOR STREETS. The City acknowledges the Developer’s desire, evidenced in the Preliminary Plat, to construct private streets within the interior of the Project. All such private streets within the Project shall be constructed to engineering and technical design standards that are substantially similar to those that were applied to Unit 1 of the Original Development. Such streets shall be privately owned and maintained by the Project’s homeowners’ association, and shall be open to the public without restriction or condition. Gates, guardhouses, or other devices or structures that impede public access may not be used on any private or public street within the Project.
INTERIOR STREETS. The Village and the Owner acknowledge and agree that all interior streets within the Territory shall be privately owned, operated, maintained, repaired, and replaced by the Owner in perpetuity. The Village hereby approves the specifications for the interior streets as specifically set forth on the Final Engineering Plans, acknowledging that the interior street standards may not be consistent with the Village’s standards for public streets. If and when required by the Village, the Owner and the Village shall enter into an agreement to allow for the Village’s Police Department to enforce traffic and parking regulations within the private street network.

At no time shall Tenant permit Tenant’s employees to loiter in Common Areas or elsewhere about the Building or Property.
