Common use of JOB BIDS Clause in Contracts

JOB BIDS. (a) Whenever job vacancies of a permanent nature (i.e. expected to be of more than thirty (30) days duration) occur in the bargaining unit, other than in the Labourer classification, the Corporation shall post notice thereof for a period of five (5) consecutive working days on the bulletin boards. Qualified employees shall make written application for promotion into such vacancies by signing a job notice within the aforementioned posting. All notices of vacancies shall designate the job and rate of pay for such job. The Corporation shall post the name of the successful applicant within ten (10) days after the period of five (5) days has expired. (b) Unless his employment is terminated, an employee’s job shall not be considered vacant by reason of his absence from work because of sickness, injury or other authorized leave of absence. (c) The Corporation will determine the successful applicant for a job posting by considering the skill, qualifications and present ability of the individuals applying to perform the required work, and where any of the applicants have those qualities to perform the required work and to perform it well, the employee with the greatest seniority will receive the promotion. (d) Any employee who has successfully bid under this article shall not be entitled to bid on a posted job for a period equal to the probationary period of this Agreement from the date of his successful bid, except with the mutual consent of the Corporation and the Union. (e) Should the successful applicant for the vacancy turn out to be unsatisfactory in the opinion of management after a period not to exceed thirty (30) days worked, he shall be returned to his former position. Management shall not form its opinion in a manner that is arbitrary, discriminatory or in bad faith. (f) Where no employee meets the qualifications for the posting, the Corporation shall be free to fill the job vacancy from outside sources. (g) Only the original job vacancy and the first succeeding vacancy must be posted.

JOB BIDS. The Employer agrees to maintain a job bidding procedure as specified in this section. The efficient operation of the plant requires that minimum skill, ability, and qualifications as determined by the Employer be required (a) Whenever the “job vacancies requirements”). Bids shall be awarded to the most senior bidding employee who has the necessary job requirements. Jobs other than those specified below will be posted for bid if the Employer determines there is an operational need. The Employer may, in the instance of certain skilled jobs, choose to select, and train employees in the jobs as listed below without requirement to bid those positions. In the event a permanent nature (i.e. expected to be of more than selected employee has not been placed in the job within thirty (30) calendar days duration) occur in of the bargaining unit, other than in the Labourer classificationselection, the Corporation Complex Manager or his/her designate will be notified the selected employee was not moved. The Employer shall post notice thereof that such opening(s) exist. Consideration will be given to existing employees who meet the skill, ability, and qualification requirements for the job. All job postings shall state the job title, job requirements, line and shift, a brief description of the principal duties, the wage rate for the job and the maximum working hours for the employee to quality (“qualifying period”). Job postings shall be from Monday at noon (12:00 p.m.) until Friday at noon (12:00 p.m.), however, all jobs shall be posted for a period minimum of five (5) consecutive working days on the bulletin boards. Qualified employees shall make written application for promotion into such vacancies by signing a job notice within the aforementioned postingdays. All notices of vacancies shall designate the job and rate of pay for such jobbids must be received during that period in order to be considered. The Corporation job shall post the name of the successful applicant be awarded within ten seven (107) days after the period of five (5) days has expired. (b) Unless his employment is terminated, an employee’s job shall not be considered vacant by reason of his absence from work because of sickness, injury or other authorized leave of absence. (c) The Corporation will determine the successful applicant for a job posting by considering the skill, qualifications and present ability end of the individuals applying posting on Friday noon (12:00 p.m.). No employee may bid during their probationary period. JOB BIDS. (g) 14.07 Only the original job vacancy and the first succeeding vacancy must be posted. 14.08 The name of the successful applicant shall be posted on the bulletin board. 14.09 Until the selection process is complete, the Company may fill the position with whoever it chooses. 14.10 Upon request to the Human Resources Department, applicants who do not receive the position applied for will be given verbally, on a without prejudice basis, the reasons why their application was refused. Unsuccessful applicants may, within five (5) working days of the receipt of this response, lodge a grievance commencing at Step 2 of the Grievance Procedure
