Company Drivers. The Company will offer dispatches to Company Drivers until they have accumulated 52 hours in the current week prior to the commencement of the dispatch. The Company will not cause a Company Driver to be laid off, have their regularly scheduled hours of work reduced, demoted, terminated or transferred by bringing in Brokers or Driver Services to perform the available work. If it becomes necessary to use Brokers or Driver Services as provided for above, the Company agrees to give a written notification of the reasons for such contracting out to a designated representative of the Union, prior to the work being performed. The Company will normally provide 5 days’ notice for contracts involving more than 3 Brokers or Driver Services. If time does not permit, the Company shall notify a Union official and follow with a written notice. In the notification, the Company will give the name of the contractor, the approximate number of personnel involved, the approximate duration and the work to be performed. The Company and the Union acknowledged that, although the use of third party carriers to haul raw material or finished product at the request of the customer or supplier does not constitute contracting out, in such cases the Company shall meet with representatives of the Union prior to the commencement of such work to review any alternatives suggested by the Union which might assist in convincing the customer to utilize bargaining unit members to perform such work.

(v) Singlets, tracksuit pants, football shorts, or any other variations of the company uniform are not to be worn whilst engaging in deliveries and pick-ups. (vi) Non company issued accessories, such as gloves, hats and scarfs, should be unbranded (no logos) and neutral in colour, but preferably in Riteway corporate colours (black, grey, red or white). Accessories deemed inappropriate by the company will be asked to be removed. Leave Policy Planned annual leave and RDO’s will not be permitted from 1 November to 26 December each year. Only under special circumstances and at the approval of the General Manager will this be allowed (ie weddings, honeymoons). Contract drivers and employees should not accrue annual leave in order to plan holidays longer than four weeks in duration. Only in special circumstances and with the approval of the General Manager will a contract driver or employee be able to take more than four weeks consecutive annual leave. Contract drivers are able to take single annual leave days off for pre planned engagements ie visit to an accountant or specialist appointment, using annual leave provided that: 1. It is at a time suitable to the company and, 2. a minimum of seven days prior notice is given. Sick days will not be paid as annual leave. Only under special circumstances, and at the approval of the General Manager, will these conditions be varied i. e. a driver who misses more than eight consecutive work days through illness.   • Bus Drivers The provisions of this Article apply to school term bus drivers except as hereinafter modified. Bus Drivers are guaranteed a base of one thousand and ninety (1090) hours per school year. Guarantee consists of 1090 hours divided by possible working days in a school year times actual number of days worked. This excludes Saturday and Sunday and General Holiday trips. (a) Regular shift is defined as the conveyance of passengers to school in the morning and home in the afternoon. (b) Extra shift is defined as the conveyance of passengers for extra-curricular activities. (c) Shifts shall be paid at a minimum of two (2) hours and drivers' time will be uninterrupted if less than one-half (½) hour remains between shifts. (i) Drivers are entitled to one 15 minute rest period after two (2) hours of work and a second rest period after six (6) hours of work. Paid waiting times of 15 minutes or more will be construed as a paid rest period regardless of the length of time spent waiting. (d) All work after nineteen hundred (1900) hours on those days on which the regular shift has been worked shall be deemed to be overtime. After twelve (12) hours from the start of the regular shift, work will be deemed as overtime. (e) Hours of work consisting of regular and extra shifts and overtime are shared as equally as possible amongst drivers. Each driver has the opportunity to choose a percentage of the work available beyond one’s guaranteed hours, although the decision of the Employer will prevail. If no drivers are available, other transportation department staff may share the work. (f) Where School District transportation is used for extra-curricular trips on Saturdays and Sundays, the following applies instead of the overtime rates in Article 10.2: (i) Time and one-half (1 ½) regular rate for driving to and from destination. (ii) Upon arrival at destination, waiting time shall be paid at the regular rate of pay. (iii) No shift will be paid less than four (4) hours. (iv) Trips that are cancelled where the driver positions into departure point/school shall be paid at two (2) hours at one and one half (1 ½) times the regular rate. (v) All work carried out in this sub paragraph 9.5(f) shall be on a volunteer basis and shared as equally as possible. All Transportation employees may participate and shall be paid at the Bus Driver rate of pay. (vi) An exception to 9.5 (f) (i) to (iv) above will apply to bus driving on ski trips. Bus drivers who drive on ski trips shall share those hours only with other registered ski trip drivers. (g) Work carried out on General Holidays shall be paid in accordance with the current contract rates. (h) At the end of each school year a review of school bus drivers’ hours of work will be made to ensure minimum guarantee is met. Any shortages will be paid out.

  • Company Car Throughout the term of this Agreement, Employee shall be entitled to the exclusive use of a company car of at least the same type and quality as that furnished to Employee as of the date of this Agreement. Employer shall replace such company car from time to time with new vehicles, such that the company car provided to Employee shall at no time be older than two (2) years. All expenses of maintenance, operation and insurance shall be paid by Employer or reimbursed by Employer to Employee.

  • Volunteer Firefighting Leave Leave without pay will be granted when an employee who is a volunteer firefighter is called to duty to respond to a fire, natural disaster or medical emergency.

  • Moonlighting Employee will focus his/her professional time, ability, and attention on City business during the term of this Agreement. To the extent consistent with applicable law, Employee shall not engage in any other business duties or pursuits whatsoever or, directly or indirectly, render any services of a business, commercial, or professional nature to any other person or organization, whether for compensation or otherwise, without the prior consent of the City Manager, except that: (1) The expenditure of reasonable amounts of time not in conflict with the City's needs and interests, for educational, charitable, community, and professional activities, shall not be deemed a breach of this Agreement and shall not require prior consent. (2) This Agreement shall not be interpreted to prohibit Employee from making passive personal investments or conducting private business affairs if those activities do not materially interfere with the services required under this Agreement or create conflicts of interest.
