Common use of Job Restoration Clause in Contracts

Job Restoration. Upon return from an FMLA leave, the employee will be restored to her/his original job or to an "equivalent” job, which shall mean identical to the original job in terms of pay, benefits, and other employment terms and conditions. An employee’s use of FMLA leave will not result in the loss of any employment benefit that the employee earned or was entitled to before using unpaid FMLA leave.
