Common use of Jury or Court Witness Duty Leave Clause in Contracts

Jury or Court Witness Duty Leave. The Employer shall grant leave of absence without loss of seniority or benefits under the terms of this Agreement to an Employee who serves as juror or witness in any court or who is required by subpoena to attend a court of law or coroner’s inquest. The Employee must turn over any witness or jury fees to the Department of Finance, excluding payment for traveling, meals or other expenses. The Employee will present proof of service and the amount received. Time spent by an Employee required to appear before any government body, or who is subpoenaed to attend a coroner’s inquest or is required to serve as a court witness in any manner arising out of their employment shall be considered as time worked at the appropriate rate of pay.
