Common use of Labour Flexibility Clause in Contracts

Labour Flexibility. (a) The supervisor may direct an employee to carry out such duties as are within the limits of the employee's skill, competence and training that are consistent with the employee's classification and grading, provided that such duties are not designed to promote deskilling. Such work will be performed without reduction in salary. (b) The supervisor may direct an employee to carry out duties and use such equipment as may be required, provided that the employee has been properly trained or has otherwise acquired the necessary skills in the use of such equipment. Any such direction issued by the employer shall be consistent with the employer's responsibility to provide a safe and healthy working environment for employees, and the employer's duty of care. (c) Provided further that where an employee is directed to carry out work of a higher classification, the provisions of clause 38 – HIGHER DUTIES will apply.
