Land Survey. All lots require fire setbacks in order to meet fire codes. In the event that this Agreement is transferred, sold or otherwise assigned, the Lessee agrees that as a condition of the Lessor’s consent to such transfer, sale or assignment, Lessee shall at its own cost obtain a survey of the leasehold including necessary fire setbacks and the Leased Premises as defined herein shall be amended in accordance with this survey to include such necessary fire setbacks if any.
Land Survey. At any time during the term of this Option, Purchaser may have prepared, at Purchaser's cost, a survey of the Premises by a registered land surveyor (the "Survey"). The Survey shall be used to compute the legal description of the real property to be purchased pursuant to this Option. In the event such Survey discloses any defects in Owner's title, Purchaser shall so notify Owner and Owner shall endeavor to cure the same within 30 days after such notice, or such other period agreed to by Purchaser and prior to closing. If such defects are not cured by the Closing Date, Purchaser shall have the same remedies as are allowed in Section 7 above for title defects disclosed in the Title Commitment.

The Purchase Price represents approximately $71.74 per square foot of land for 348,480 square feet of land to be contained within the Option Parcel, as shown on that certain survey prepared by Cxxxxxx, Xxxxxx and Gxxxxx (CBG) and dated July 15, 2010 (the “Land Survey”), a copy of which has been provided to Developer. However, if the number of square feet to be contained within the Option Parcel is modified at the request of Developer, and such modification is approved in writing by Owner in its sole and absolute discretion as part of the Approved Conceptual Plan described in Section 7.2, then the Purchase Price shall be increased or decreased in accordance with the corresponding increase or decrease in square footage of the Option Parcel, using the price per square foot stated above.
