LAYOFF AND RECALL FROM LAYOFF. 13.01 In the event of a work shortage, for the purposes of layoffs and for the purposes of recalling those to work who have been laid off, seniority will be applied on a bargaining unit wide basis and the following factors shall be considered, seniority, qualifications, skill and ability to perform the normal required work. It is agreed that where qualifications, skill and ability to perform the normal required work are relatively equal, seniority as herein defined will govern. It is understood that some employees may require some orientation to perform the work in question. 13.02 Whenever possible, when it becomes necessary to effect a layoff, the Employer will provide five (5) clear days notice to the affected employees. The Unit Chairperson will also be advised of the layoff and provided with the names of employees designated for layoff prior to the layoff commencing. 13.03 For purposes of this Article, a layoff means a layoff of more than one (1) working day. A layoff will be exercised using this following process: 1) Employees who are reduced from their classification because of a reduction in the workforce for more than one (1) day or the cancellation of a job may exercise their plant-wide seniority by replacing the junior most employee within their classification on their shift, or they may elect to exercise their plant wide seniority by replacing the junior most employee within their classification on another shift. 2) If there is no such employee with less seniority in their classification, they may exercise their plant-wide seniority by replacing the junior most employee within their department on their shift provided they are qualified to perform the normal work required of that employee, at the rate of the job. 3) If there is no such employee with less seniority within their department, they may exercise their plant wide seniority by replacing the junior most employee within the plant on their shift provided they are qualified to perform the normal work required of that employee, at the rate of the job. 4) If there is no such employee with less seniority on their shift in the plant, they may exercise their plant-wide seniority by replacing the junior most employee on another shift in the plant, within their department, and finally within the bargaining unit provided they are qualified to perform the normal work required of that employee, at the rate of the job. 5) It is agreed and understood that employees may require some minor orientation to the workplace and or situation as described in items 1-4 above. 13.04 When recalling an employee after lay-off, recall will be in reverse order of seniority in accordance with the criteria set out in Article 13.01 and the Employer shall notify the employee by direct telephone contact, registered mail or courier and allow five (5) calendar days for the employee to report for work and in the meantime if an employee is recalled and is not immediately available for work, other employees in seniority standing shall be recalled but shall be temporarily employed until the senior employee reports within the five (5) day period as outlined. An employee to whom a registered letter or courier is sent in accordance with this article must contact the Human Resources Manager within three (3) working days of the notice of return to work if he wishes the Employer to hold the job open for him for the full five (5) day period. Special consideration will be given to employees who leave the local area during an extended lay-off, provided that the employee has notified the Employer in advance of his intended absence, as well for employees who are unable to return to work due to illness. The Unit Chairperson shall be advised in writing of employees upon their recall to work. 13.05 It shall be the employee’s responsibility to keep the Employer notified in writing as to any change of his address or telephone number so that they will be up to date at all times. 13.06 In the event of a lay off the Union Committee shall be retained without regard to seniority by the Employer so long as work is available, which they are qualified to perform.

(b) Employees who are reduced from their classification because of a reduction in the workforce for more than one (1) day or the cancellation of a job may exercise their plant-plant wide seniority by replacing the junior most employee within their classification on their own shift, (c) If there is no such employee with less seniority on their own shift within their classification, or they the employee may elect to exercise their plant wide seniority by replacing the junior most employee within their classification on another shift. 2) If there is no such a shift of their choosing or the affected employee with less seniority in their classification, they may exercise their plant-wide seniority by replacing can elect to replace the junior most employee within in the line operator classification on his/her shift, seniority permitting. Employees electing to move to the line operator classification will maintain their department on recall rights to their shift provided they are qualified to perform the normal work required of that employee, at the rate of the jobformer position. 3(d) If there is no such employee with less seniority within their departmentclassification plant wide, they the employee may exercise their plant wide seniority by replacing the junior most employee within on his/her shift as per Flowchart grouping "A"or"B", provided the plant on their shift provided they are qualified employee has the demonstrated skills and ability to perform the normal work required of within that employee, at the rate of the jobclassification. 4(e) If there is no such employee with less seniority within the employees job classification/Flowchart grouping on their shift in his/her shift, the plant, they employee may exercise their plant-plant wide seniority by replacing the junior most employee on another a shift in of their choosing as per Flowchart "A"or"B”, provided the plant, within their department, employee has the demonstrated skills and finally within the bargaining unit provided they are qualified ability to perform the normal work required of within that employee, at the rate of the jobclassification. (f) If there is no such employee with less seniority within the employees job classification/Flowchart grouping plant wide, the employee may exercise their plant wide seniority by replacing the junior most employee in the next downward job classification/Flowchart grouping on his/her shift, provided the employee has the demonstrated skills and ability to perform the work within that classification. (g) If there is no such employee with less seniority within the next downward job classification/Flowchart grouping on his/her shift, the employee may exercise their plant wide seniority by replacing the junior most employee in the next downward job classification/Flowchart grouping on a shift of their choosing, provided the employee has the demonstrated skills and ability to perform the work within that classification (h) An employee will be given a five (5) day familiarization period in the event of a reduction in workforce only in lower rated classifications.
