Lease Negotiations. Owner shall refer all inquiries concerning the rental of space in the Project to Manager. All negotiations with prospective tenants shall be conducted by Manager or under its direction. All leases shall be prepared by Manager in the name of Owner and shall be in accordance with such leasing guidelines as Owner and Manager shall agree upon from time to time. Manager shall secure Owner's prior written approval before entering into any lease that is not in compliance with the leasing plan set forth in the Annual Plan. All leases shall be presented to and executed by Owner. Manager shall duly and punctually comply with all the obligations of Owner under all leases with tenants of space in the Project, but solely on behalf of Owner and at Owner's expense.

Lease Negotiations. Manager will set rents that in the opinion of the manager at the time of the rent negotiations with the Tenant reflect the market conditions of that time and approximate rents of comparable rental properties. However, Manager will not set the rents if expressly instructed in writing by Owner to Manager to the contrary, with Owner confirming the amount of the initial rent and any subsequent increases which are deemed acceptable to Owner. Owner designates manager as its agent to negotiate and sign any and all lease agreements or related addenda on its behalf, unless expressly instructed otherwise in a written statement from Owner to Manager. Barring such instruction, Manager will employ best efforts to pursue lease terms and agreements consistent with the broad terms Owner and Manager have discussed for the property. Manger is not, nor shall it be expected to be legal counsel or a legal advisor to Owner. Owner is advised to seek its own legal counsel for legal issues or legal questions related to the Property.
Lease Negotiations. The Agent shall handle all negotiations with tenants with respect to the initial leases, determining lease renewal increases and length of lease. Owner shall pay the Agent 50.00 % of the first full month’s rent as a leasing fee to negotiate and place tenants. Tenants are sent lease renewal notices approximately 80-days prior to their lease expiration. Agent will be compensated a $50 flat fee for a one-year lease renewal (or a $25 flat fee for a six-month least renewal). Should an owner decide to list their property for sale, Agent must be notified at least 90-days prior to listing the property for sale, and advised if lease is to be renewed, canceled, or converted to month- to-month.

Lease Negotiations. From the date hereof, He-Ro hereby agrees to use its best efforts, and to cause its officers and employees to use their best efforts, to enter into agreements on or before the Closing with the landlords for those He-Ro leases listed on Schedule 4.1(j) to reduce the rental obligations by the percentage set forth on said Schedule or to terminate such leases, as indicated on said Schedule, without penalties that are reasonably unacceptable to Nah-Nah and He-Ro. Any changes which, in Seller’s reasonable business judgment, would affect the financial or other business terms of the Lease or increase Mercury’s costs or liabilities thereunder shall be subject to Seller’s approval which may be granted or withheld in Seller’s sole discretion.

Lease Negotiations. The Broker shall handle all negotiations with tenants with respect to leases. All such agreements are subject to the approval of the Owner. However, the Owner may provide the Broker with authorization to lease under certain specified terms and conditions.
Lease Negotiations. Broker shall handle all negotiations with tenants and prospective tenants. Upon execution of a lease, Xxxxxx shall collect from the tenant all prorated rents plus a refundable Security Deposit. Depending on market conditions or special circumstances, Broker may collect additional rents and/or deposits in advance. The tenant's Security Deposit shall be maintained in Broker's trust account and shall not be used to pay Owner's obligations. Owner waives any right to interest which may accrue on tenant’s Security Deposit.
Lease Negotiations. Manager shall have complete discretion and authority and the exclusive right to negotiate and enter into leases with existing and prospective tenants. If Owner prefers, Manager will review the qualifications of new tenants with the Owner prior to execution of lease.
