Leave of Absence Without Pay. (a) Full or part-time leave of absence without pay may be granted at the discretion of the Employer. Faculty members may apply for job-sharing under the provision for part-time leave of absence. Applications shall be made in writing to the administrator responsible. All applications will be dealt with promptly and will not be unreasonably denied, nor dealt with in a discriminatory manner. The reply to an application for leave will be in writing. Leave of Absence Without Pay. (a) Full Section 1. The Board or part-time its designee may grant secretaries who have met certain criteria and procedures, as outlined in this Article, a leave of absence without pay up to a maximum of one (1) year. An extension of a leave of absence may be granted at upon the discretion recommendation of the EmployerSuperintendent. Faculty members may apply Examples of such leaves are health, maternity, child care, study, research, professional association assignment and approved travel. Each request for job-sharing under an unpaid leave of absence will be considered on its individual merits. The applications shall be submitted in accordance with the provision provisions of the Article. Section 2. To be eligible for part-time a leave of absence, except military leave, as provided by law, the secretary must have completed the probationary period.
Section 3. Applications For one year, reinstatement shall be made in writing granted to any available position which is substantially equivalent to the administrator responsibleposition held before the leave commenced or to any available position of a lower classification for which the secretary is qualified and interested. All applications will If no position is available at the time the leave terminates, the secretary may request an extension of the leave of absence or be dealt placed on layoff status with promptly all rights pursuant to the provisions outlined in Article X.
Section 4. Section 7. An eligible secretary desiring a leave of absence shall submit such request to the Board of Education through the Human Resources’ Office. Such request shall be submitted by the Superintendent to the Board with his/her recommendation for action.
Section 8. For faculty members on part- time all secretaries whose leave without payshall terminate at the end of a school year, benefit premiums shall be payable by a letter of availability must reach the Employer on a pro rata basis. Failure to comply with this provision shall be interpreted as a resignation of employment.
Section 9. Accrued seniority shall be maintained during periods of unpaid leave of absence.

Leave of Absence Without Pay. (a) Full 29.8.1 A member may apply for and the University may grant leave of absence without pay. Leaves may be approved for reasons of study, research, visiting appointments, or partbona fide personal or professional reasons. Leaves shall not be granted for the purpose of accepting a tenure-time stream or permanent appointment with another employer.

Where a prior payment member elects to defer such a decision, she shall provide the Employer Vice-President (Academic) with written notice of both her intention to do so within thirty (30) working days of receiving notice from the faculty member's share Vice-President (Academic) that she is eligible for such consideration as stated in Article 20.38.2 and the Employer's share (pro- rated, if applicable) of any 20.41.2 or all of the following benefitsArticle 21.38.2 and 21.41.2.
29.8.11 As soon as such information is available, the Employer shall remit these payments to ensure continuous coverage: Life Insurance, Medical Services Plan provide the President of BC, Extended Health, Dental, Short the Association with the names of members on leave of absence without pay and Long Term Disability and AD&D.

Leave of Absence Without Pay. (a) Full or part-time 14.14.1 Leave of absence without pay not to exceed one year may be granted to a permanent employee upon the written request of the employee to the Board and the Approval of the Board. The leave is subject to the following restrictions:
14.14.2 The granting of a leave of absence without pay not to exceed three months gives to the employee the right to return to his/her position at the expiration of his/her leave of absence provided he/she is physically and legally capable of performing the duties. The position may be granted at filled only for the discretion duration of the Employerleave, and the employee so assigned must be reassigned upon completion of the leave. The granting of a Leave of Absence without pay in excess of three months gives to the employee the right to return to a position in his/her former classification without a change in status.
14.14.5 If an employee cannot be placed in a vacant position in his/her class upon return from leave of absence. Applications shall be made in writing to the administrator responsible. If a faculty member proceeding on leave without pay makes a prior payment request form and provide it to the Employer of both Supervisor. Unexcused absences without prior approval from their Supervisor and Superintendent shall only be used when employee is ill or injured. Employees must provide medical documentation for all unpaid absences due to illness or injury. Leave of Absence Without Pay. Section 1. An appointing authority may grant an employee a leave of absence without pay for a specified time subject to the following provisions:
a. If at all possible, the employee shall request such leave in writing to the Department Head at least five (a5) Full working days prior to the requested starting date of such leave. The request shall specify the reason for the leave and the date of leaving and the date of return to the job.
b. All requests for leave of absence without pay in excess of thirty (30) calendar days shall be approved by the Human Resources Director prior to the granting of the leave.
c. Leave of absence without pay shall be granted only when it is in the interest of the City to do so. The interest of the employee shall be considered when he has shown by his records to be of more than average value to the City and when it is desirable to retain the employee even at some sacrifice.
d. At the expiration of a leave of absence without pay, the employee shall be reinstated in the position he vacated or partin any other vacant position in the same class.
e. Vacation and sick leave benefits shall not accrue during a leave of absence without pay of more than thirty (30) calendar days.
f. A leave of absence without pay for more than thirty (30) calendar days shall not constitute a break in service; however, time spent on leave of absence without pay shall not be used in computing time-time in-grade for satisfactory performance increases. Neither shall a leave of absence without pay for more than thirty (30) calendar days count toward service for accruing vacation, sick leave, or seniority.
g. Any employee who shall receive payment for work performed for any employer other than the City of Xxxxxx while on approved leave without pay, shall be subject to immediate dismissal, except when such leave has been specifically approved by the employee's Department Head for the purpose of such employment.
h. Failure on the part of an employee to report promptly at the expiration of a leave of absence without pay may be cause for dismissal.
Section 2. Pregnant employees may be granted a leave of absence for maternity. Such leave shall be subject to the following provisions:
a. When a pregnancy is confirmed, the employee shall notify her immediately supervisor.
b. The employee shall be allowed to continue her normal work duties, provided that she is able to perform her normal duties without endangering her health, the health of her unborn child, or the lives or health of her fellow workers.
c. The Department Head may at any time, request a physician's statement regarding the advisability of continued employment during the pregnancy of the employee.
d. Beginning at the sixth (6th) month of pregnancy, the employee shall be required to present a physician's statement to her immediate supervisor regarding her ability to continue her normal work. Such statements shall be submitted monthly thereafter, and filed in the employee's department file. At any time that medical evidence indicates that continued employment may be harmful to the employee or the unborn child, the employee shall be placed on maternity leave or allowed to resign at the discretion of the Employer. Leave of Absence Without Pay. 18.01 In accordance with the provisions of Ohio Revised Code, Section 3319.13, the Board shall grant a leave of absence for a period not exceeding two (a2) Full consecutive school years where illness or part-time other disability is the reason for the request.
18.02 If the basis for the leave of absence is the result of a Worker’s Compensation claim in which the Board was the Employer and that Employee is receiving temporary partial or temporary total Worker’s Compensation payment, the Board shall continue, for the period until the Employee returns to the payroll on either sick leave or regular work, to pay the same portion of the hospitalization insurance premium as provided in existing Board Policy, provided, however, that such period does not exceed one (1) year.
18.03 The Board shall continue to carry, on payroll records, all Employees whose sick leave accumulation has expired, or who are on disability leave of absence or an approved leave of absence. If the absence is due to illness and all of the Employee’s sick leave accumulation has expired, his or her sick leave will be treated as unpaid days. Board paid hospitalization and major medical insurance provisions will continue for a maximum period of sixty (60) days following the expiration of all accumulated sick leave, unless the Employee is on FMLA Leave in which case such coverage will continue until the Employee’s FMLA Leave is exhausted.
18.04 While on leave of absence without pay for reasons other than illness or disability or FMLA Leave and after insurance benefit extension provided for in 18.03, the Employee may participate in group insurance programs offered to regular Employees by paying the total cost of the premium to the Board, if the Employee participated in the group insurance program prior to his/her absence. Such payment and other terms of insurance coverage shall be governed by the provisions of the Federal Consolidated Omnibus Budget Reconciliation Act (COBRA).
18.05 The welfare of classified staff members may require an extended absence from duty for other than illness or disability. The Board may grant a request for such leave for one (1) year. Such leave may be granted extended an additional year upon written request and approval by the Board.
18.06 Seniority status of the Employee who has voluntarily requested a leave of absence shall not be interrupted by such leave, but the period of leave shall not count toward accumulated seniority.
18.07 Employees who are on an approved leave of absence and planning to return to their duties at the discretion expiration of that leave shall notify the Employer. Faculty members may apply for job-sharing under the provision for part-time leave Superintendent of absence. Applications shall be made in writing their intent to the administrator responsible. Except in the case of leaves for short-term emergencies of duty thirty (30) days or less, prior to the Employer may, time that person wishes to return to duty.
18.08 Employees returning from leave shall resume their duties at its discretion, require that the length of a leave coincide with the beginning or end of a semester or term of instructionthe school year unless otherwise approved by the Board.
(b) Where 18.09 An Employee taking a leave is granted, the faculty member's performance evaluation shall be extended accordingly.

Leave of Absence Without Pay. 12.1 An employee, upon written request, shall be granted a leave of absence by the Manager of Employee and Labor Relations for legitimate personal reasons. Whenever practical, such requests should be submitted at least three months in advance. Such leave of absence shall be without pay and shall not normally be granted for a period of more than one (a1) Full year. Requests for an extension of a leave of absence shall be filed with the Manager of Employee and Labor Relations in writing no later than thirty (30) days prior to the end of the original leave, unless otherwise agreed by the Manager of Employee and Labor Relations. Requests for leaves of absence or part-time extensions thereof shall be submitted through the employee’s department head who shall forward same to the Manager of Employee and Labor Relations.
12.2 An employee on a leave of absence without pay may be granted may, upon request, continue participating in the employee benefit programs described in Article XIII, provided that the period of absence does not exceed two (2) years and also that the above provision meets with the requirements of ERISA. The employee shall pay the full cost of such benefits. All payments are due in advance or by the first of each month at the discretion prevailing group rate.
12.3 Employees with one (1) or more years of seniority shall be entitled to leaves of absence of up to one (1) year. Employees with less than one (1) year of seniority shall be entitled to leaves of absence of up to six (6) months. An employee on an approved leave of absence shall be entitled to resume their former position at the end of the leave. Reasonable notification will be required from the employee requesting such leave along with a specific date for return from such leave. At the option of the Employer. Faculty members , an employee may apply for job-sharing under return from such leave prior to the provision for part-time specifically expressed date.

Leave of Absence Without Pay. Section 25.1 “Authorized Personal Leave” (aAPL) applies after exhausting all other applicable leave and shall be scheduled at least twenty-four (24) hours in advance and approved by the employee’s supervisor. APL shall not be considered negatively or held against the employee as concerns evaluations, promotional consideration, or any other employment factors. The parties understand APL shall be considered authorized leave without pay and shall be coded “APL” on timesheets, leave reports and for all payroll purposes. APL shall be closely monitored and shall normally be used only for non-illness related absences.
A. The employee shall request approval of APL in writing to the appropriate supervisor. The request shall specify the dates and the reason for APL.
B. All requests for APL in excess of thirty (30) calendar days shall be approved by the Human Resources Director prior to the granting of the leave. Any APL in excess of six (6) months must be approved by the Mayor or designee.
C. At the expiration of an APL absence, the employee shall be reinstated in the position he vacated or in any other vacant position in the same class.
D. “Leave Without Pay” (LWOP) shall be considered as unauthorized absence from duty and shall be administered without pay. Leave Without Pay shall be coded as “LWOP” on timesheets, leave reports, and for all payroll purposes. Further, upon returning from an unauthorized leave of absence or based on an employee’s failure to contact his/her department during such a leave of absence without pay, the employee shall be subject to possible disciplinary action which may include dismissal.
E. A leave of absence without pay for more than one hundred sixty (160) continuous work hours shall not constitute a break in service. Vacation and sick leave benefits shall not accrue during a leave of absence without pay in excess of one hundred sixty (160) continuous work hours including extended leave periods with breaks of twenty (20) hours or less of actual work, whether it is paid or unpaid. Full time employees must complete in excess of twenty (20) hours of actual work within a workweek to be eligible for accruals to recommence after an extended absence.
F. Any employee who shall receive payment for work performed for any employer other than the City of Tulsa while on either APL or part-time LWOP shall be subject to immediate dismissal, except when an employee has received specific written approval from the department head or designee for use of such leave for the purpose of outside employment (also see 25.1B).
G. Failure on the part of an employee to report promptly at the expiration of a leave of absence without pay may be granted at the discretion of the Employer. Such requests shall not be unreasonably denied.
23.13 The Employee shall continue to receive full benefits, to move through the salary grid as if he/she will advise the faculty member as was not on leave and to earn seniority credit.
23.14 One (1) month prior to the reasons for his/her decision commencement of such leave the Employer shall inform the Employee in writing before of all agreed terms and conditions upon which the granting of leave commencesis based, including a reference to the specific section(s) of the Collective Agreement which governs the type of leave granted and specifying a deadline (minimum of one (1) week) for acceptance or rejection of the said terms and conditions.

Leave of Absence Without Pay. 19.01 Subject to operational requirements, the CLC will grant leave of absence as follows:
19.02 Leave of absence, with continuing seniority, without pay for a specified period not exceeding one year, shall be granted in the event of the employee requesting this leave to work for the International Union, the Local Union or any other Affiliated Union, or a political organization supported and/or endorsed by the Canadian Labour Congress, for Union education purposes, or outside the bargaining unit for the CLC, provided the Employer has received one month’s written notice. On application by such employee, the Employer agrees to reinstate the employee in their former classification and, as much as possible, in their former position in terms no less favourable than those enjoyed previous to such leave.
19.03 The Employer agrees in consultation with the Union and when necessary, subject to the needs of the Employer, to grant, in writing, leave of absence for a specified period up to one year to an employee, provided adequate reason can be shown. By mutual agreement such leave may be extended. One month prior to the termination of such specified leave of absence, the employee must notify the Employer of their intention to return, and shall be returned to their former classification and as much as possible in their former position on terms no less favourable than those enjoyed previous to such leave, with previous seniority maintained, and at the prevailing rate of pay. Only if such leave of absence is of thirty (a30) Full calendar days duration, or partless, shall the said employee continue to accumulate seniority.
19.04 For purposes of this Article, it is understood that employees shall only be permitted to return to work prior to the specified termination date of their leave of absence provided that there is a position available and with the understanding that the salary and conditions of such position apply until the expiration of the original term of leave of absence.
19.05 When an eligible employee is collecting benefits under the long-time term disability plan, the employee shall be deemed to be on leave of absence without pay for the duration of their disability, continuing seniority maintained up to two (2) years. If subsequently the physicians of the insuring company certify the employee to be able to return to work and the employee ceases to receive disability benefits under the plan, the employee may be granted give the Employer one month’s notice that the employee? is able and willing to return to work, and the Employer will then reinstate the employee on terms no less favourable than those enjoyed previous to their leave, with applicable seniority maintained and at the discretion prevailing rate of pay.

Leave of Absence Without Pay. 24.1 Full-Time Clerical and Paraprofessionals-Leave of Absence for twenty (a20) Full days or partless:
A. Request for leave of absence without pay shall be made in writing to the Director of Employee Services and routed through the building principal.
B. The Director of Employee Services may grant up to five (5) days leave of absence without pay, and the Superintendent or his/her designee may grant up to twenty (20) days after taking into consideration the following factors:
1. The nature of the request.
2. The recommendation of the building principal.
3. The availability of a qualified substitute.
24.2 Full-time Time Clerical and Paraprofessional-Leave of absence for more than twenty (20) days: Employees may be granted a leave of absence for twenty (20) days or more only by action of the BOARD based on the following conditions:
A. Requests for leave shall be in writing and directed to the Director of Employee Services.
B. Eligibility shall be based on a minimum of two (2) years of continuous employment in the DISTRICT.
C. All leaves of absence without pay shall be limited to one (1) work year. Further extension shall be limited to one (1) normal work year. Further extension shall be at the discretion of the BOARD. No leave shall be extended beyond two (2) years.
D. Except for Parental Leave, all leaves without pay should commence at the beginning of a work year and reinstatement during the work year shall be at the discretion of the BOARD.
E. Salary increments shall not accrue.
F. Sick leave days shall not accrue, but unused sick leave held at the start of the leave shall be available upon reinstatement.
G. Written notice of intention to either return or resign shall be given by the Employee to the Director of Employee Services sixty (60) days prior to the beginning of the work year. Failure to furnish such written notice shall constitute a notice of resignation.
H. Employees returning to the DISTRICT from a leave of absence without pay will be reassigned to the position they left, if available, or to any available position for which they are qualified.
I. Leaves of absence without pay may be granted at for a serious health condition after the discretion Employee has exhausted FMLA Leave, study, travel to work in an educational program sponsored by an official governmental agency (Peace Corps, Job Corps, etc.), to serve in public office, or for other good and sufficient reason.

Leave of Absence Without Pay. (11.1 Leave of Absence for twenty days or less:
A. Request for leave of absence without pay shall be made in writing to the Director of Human Resources and routed through the building principal.
B. The Director of Human Resources may grant up to five days leave of absence without pay, and the Superintendent or designee may grant up to twenty days after taking into consideration the following factors:
a) Full The nature of the request.
b) The recommendation of the building principal.
c) The availability of a qualified substitute.
11.2 Leave of absence for more than twenty days: employees may be granted a leave of absence for twenty (20) days or part-time more only by action of the Board based on the following conditions:
A. Requests for leave shall be in writing and directed to the Director of Human Resources.
B. Eligibility shall be based on a minimum of two (2) years of continuous employment in the Peoria Public Schools.
C. All leaves of absence without pay shall be limited to one work year. Further extension shall be limited to one normal work year. Further extension shall be at the discretion of the Board. No leave shall be extended beyond two (2) years.
D. Except for parental leave, all leaves without pay should commence at the beginning of a work year and reinstatement during the work year shall be at the discretion of the Board.
E. Salary increments or steps on the salary schedule shall not accrue.
X. Xxxx leave days shall not accrue, but unused sick leave held at the start of the leave shall be available upon reinstatement.
X. Written notice of intention to either return or resign shall be given by the employee to the Director of Human Resources sixty (60) days prior to the beginning of the work year. Failure to furnish such written notice shall constitute a notice of resignation.
H. Employees returning to the District from a leave of absence without pay will be reassigned to the position they left, if available, or assigned to any available position for which they are qualified.
I. Leaves of absence without pay may be granted at the discretion of the Employer. Faculty members may apply for job-sharing under the provision study, travel to work in an educational program sponsored by an official governmental agency (Peace Corps, Job Corps, etc.), to serve in public office, or for part-time leave of absence. Applications shall be made in writing to the administrator responsible. Leave of Absence Without Pay. 14.01 The Board may grant a reasonable leave of absence for personal reasons to an employee providing such does not unduly hamper the “Board” in its operations. Before an employee can take such a leave the employee must obtain a written approval of same from the “Board”. Such leave shall be without pay. Except in extreme circumstances the “Board” will not consider a leave of absence in excess of six (a6) Full days without a notice of at least one (1) month.
14.02 Seniority employees who are properly designated representatives of the “Union” and members of the bargaining unit shall upon request of the “Board” be granted a leave of absence to attend to Union business without pay and without loss of seniority provided such does not unduly hamper the “Board” in its operations and the number of leaves granted does not exceed one (1) employee at any time and does not exceed a total of twenty (20) days in a calendar year. The “Union” will notify the “Board” in writing at least fifteen (15) working days in advance of requirement for leaves of one (1) week or partless. 14.03 Any seniority employee elected or selected for a full-time position with the Union shall be granted a leave of absence without pay may be granted at or participation in benefits for a period of one (1) year. Leave of Absence Without Pay. (a) Full A. Leaves of absence without pay are for the purpose of professional development or part-time the completion of a terminal degree. Such leaves may be for a period up to two consecutive years.
B. 19.3 A teacher eligible to apply for a leave is of absence without pay shall have at least two years of contract elementary teaching experience with the Board.
19.4 An unpaid leave of absence may be granted under the following conditions:
i) Salary increments will not be allowed for the time spent on leave except for a teacher on loan to D.N.D. or C.U.S.O. to serve with the Canadian Armed Forces or an administrative assignment who will be eligible, on his or her return, for any salary revision to which he or she would have been entitled had he or she not been on leave.
ii) Salary will not be paid during this leave of absence, except for a teacher on loan to D.N.D. or C.U.S.O.
iii) Provided the teacher undertakes to reimburse the Board for the total premiums, the Board will pay 100% of the required contributions to maintain benefits. This provision will not apply to teachers on administrative leave, or on loan to C.U.S.O or D.N.D who are provided benefits under the appropriate leave or loan provisions or are maintained in the activities relevant to Board’s benefit plans for which they are normally eligible.
iv) The teacher shall retain a position with the University curriculum. Board although the position may not be the position the teacher held before commencement of the leave, except in the case of short term special assignments.

Leave of Absence Without Pay. 19.01 Employees shall be granted leave of absence without pay, with continuing seniority, for a specified period, when delegated to perform necessary Union activities, including negotiation of contracts and settlement of grievances on behalf of other bargaining units.
19.02 Leave of absence, with continuing seniority, without pay for a specified period not exceeding one year, shall be granted in the event of the Employee requesting this leave to work for the International Union, the Local Union or any other affiliated union, or a political organization supported and/or endorsed by the Canadian Labour Congress, for Union Education purposes, or outside the bargaining unit for the CLC, provided the Employer has received one month's written notice. On application by such Employee, the Employer agrees to reinstate her/him in her/his former classification and as much as possible in her/his former position in terms no less favourable than those enjoyed previous to such leave.
19.03 The Employer agrees in consultation with the Union and when necessary, subject to the needs of the employer, to grant, in writing, leave of absence for a specified period up to one year to an Employee, provided adequate reason can be shown. By mutual agreement such leave may be extended. One month prior to the termination of such specified leave of absence, the Employee must notify the Employer of her/his intention to return, and shall be returned to her/his former classification and as much as possible in her/his former position on terms no less favourable than those enjoyed previous to such leave, with previous seniority maintained, and at the prevailing rate of pay. Only if such leave of absence is of thirty (a30) Full calendar days duration, or partless, shall the said Employee continue to accumulate seniority.
19.04 For purposes of this Article, it is understood that Employees shall only be permitted to return to work prior to the specified termination date of their leave of absence provided that there is a position available and with the understanding that the salary and conditions of such position apply until the expiration of the original term of leave of absence.
19.05 When an eligible Employee is collecting benefits under the long-time term disability plan, she/he shall be deemed to be on leave of absence without pay for the duration of her/his disability, continuing seniority maintained up to two (2) years. If subsequently the physicians of the insuring company certify her/him to be able to return to work and she/he ceases to receive disability benefits under the plan, she/he may be granted give the Employer one month's notice that she/he is able and willing to return to work, and the Employer will then reinstate her/him on terms no less favourable than those enjoyed previous to her/his leave, with applicable seniority maintained and at the discretion prevailing rate of pay.

Leave of Absence Without Pay. 5-10.01 The school board shall grant a regular employee a leave of absence without pay for reasons which it deems valid for a maximum duration of twelve (a12) Full consecutive months; this leave of absence may be renewed. The leave referred to in the preceding paragraph may be on a full-time basis or part-time basis. In the case of a part-time leave of absence without pay, the employee concerned shall only be entitled to the benefits which are applicable to him proportionately to his workdays in relation to the regular workweek provided for in article 8-2.00.*
5-10.02 The school board must grant a regular employee a full-time leave of absence without pay for at least one (1) month, but not exceeding twelve (12) consecutive months, if the school board can use an employee in surplus in the position of the employee on the leave of absence without pay, insofar as the employee in surplus meets the qualifications required by the classification plan and the specific requirements of the position. 5-10.03 The board shall grant a leave without pay to a regular employee to accompany his spouse who is transferred temporarily for a period not exceeding twelve (12) months; this leave may be renewed. * This paragraph shall not cause an employee who obtains such a leave to lose the status of full-time employee.
5-10.04 The board shall grant a regular employee a full-time or part-time leave of absence without pay for study purposes which may be granted renewed. This leave of absence is subject to the provisions of clause 5-10.09 and of clause 5-10.10 with the exception of the first paragraph.
5-10.05 The request for a leave of absence without pay or for a renewal of a leave of absence without pay must be made in writing and must state the reasons thereof.
5-10.06 During his absence, the employee may participate in the group insurance plans and the complementary pension plans, provided that he pay the entire amount of the premiums and contributions required if the regulations of the said plans allow.
5-10.07 Upon his return, he shall be reinstated in his position unless it was abolished during his absence or the employee concerned was displaced as a result of the application of the provisions of article 7-3.00.
5-10.08 In the case of a resignation, during or at the discretion end of this leave of absence, the employee shall reimburse the school board for any amount paid for and in the name of the Employeremployee.
5-10.09 The employee, who uses his leave of absence for purposes other than those for which he obtained it, shall be considered as having resigned as of the beginning of his absence.
5-10.10 After seven (7) years of active service with the board and following any period of seven (7) years of active service thereafter, a regular employee shall obtain a full-time or part-time leave without pay for a minimum duration of one (1) month, without exceeding twelve (12) consecutive months. Faculty members In order to obtain this leave, the employee must make a request to the board in writing at least sixty (60) days prior to the date of the beginning of the leave and specify the duration thereof. The provisions of clauses 5-10.06, 5-10.07, 5-10.08, 5-10.11 and 5-10.12 shall apply to such a leave. Notwithstanding the foregoing, if the board deems it necessary to replace the employee who requests a leave and is unable to find a replacement, it may apply for jobdefer the leave to another date to be agreed upon with the employee. If more than one employee at a time in the same office, department, school or adult education centre also wishes to take such a leave, the board may defer the leave to another date; it shall then proceed according to seniority.

Leave of Absence Without Pay. An employee may apply for a leave of absence as set out in Article 14. A leave of absence shall be granted for death or serious illness in the immediate family, union activities, vacation, bereavement, compassionate reasons, pregnancy, paternity and adoption. Where such indefinite leave is granted the employee will give a two week notice in writing of his/her intention to return to work. Leave of absence provisions as outlined in the Collective Agreement and in legislation, specifically the Employment Standards Act will be co-ordinated.
(a) Full Any employee desiring a leave of absence shall make application to his/her supervisor. Upon application in writing by such employee to the Company within thirty (30) days prior to the expiry of any such leave of absence, he/she shall be re-employed without loss of seniority.

(c) No salary increment is payable for a period of leave of absence without pay unless the University President, upon written request from the faculty member concerned, decides the leave is spent in the activities relevant to the University curriculum. In this case, the faculty member will receive any salary adjustments for which he/she would normally be eligible. In the event that the University President judges that the activities are not relevant to the University curriculum, he/she will advise the faculty member as to the reasons for his/her decision in writing before the leave commences.
(d) No benefits shall be payable by the Employer for faculty members on leave without pay, except as provided in this Agreement. Leave of Absence Without Pay. 19.01 Subject to operational requirements, the CLC will grant leave of absence as follows:
19.02 Leave of absence, with continuing seniority, without pay for a specified period not exceeding one year, shall be granted in the event of the employee requesting this leave to work for the International Union, the Local Union or any other Affiliated Union, or a political organization supported and/or endorsed by the Canadian Labour Congress, for Union education purposes, or outside the bargaining unit for the CLC, provided the Employer has received one month’s written notice. On application by such employee, the Employer agrees to reinstate the employee in their former classification and, as much as possible, in their former position in terms no less favourable than those enjoyed previous to such leave.
19.03 The Employer agrees in consultation with the Union and when necessary, subject to the needs of the Employer, to grant, in writing, leave of absence for a specified period up to one year to an employee, provided adequate reason can be shown. By mutual agreement such leave may be extended. One month prior to the termination of such specified leave of absence, the employee must notify the Employer of their intention to return, and shall be returned to their former classification and as much as possible in their former position on terms no less favourable than those enjoyed previous to such leave, with previous seniority maintained, and at the prevailing rate of pay. Only if such leave of absence is of thirty (a30) Full calendar days duration, or partless, shall the said employee continue to accumulate seniority.
19.04 For purposes of this Article, it is understood that employees shall only be permitted to return to work prior to the specified termination date of their leave of absence provided that there is a position available and with the understanding that the salary and conditions of such position apply until the expiration of the original term of leave of absence.
19.05 When an eligible employee is collecting benefits under the long-time term disability plan, the employee shall be deemed to be on leave of absence without pay for the duration of their disability, continuing seniority maintained up to two (2) years. If subsequently the physicians of the insuring company certify the employee to be able to return to work and the employee ceases to receive disability benefits under the plan, the employee may be granted give the Employer one month’s notice that the employee is able and willing to return to work, and the Employer will then reinstate the employee on terms no less favourable than those enjoyed previous to their leave, with applicable seniority maintained and at the discretion prevailing rate of pay.
19.06 The Employer agrees, in consultation with the Union, and subject to the operational needs of the Employer. Faculty members may apply for job-sharing under the provision for part-time leave of absence. Applications shall be made in writing , to the administrator responsible. All applications will be dealt with promptly and will not be unreasonably denied, nor dealt with in a discriminatory manner. The reply to grant an application for leave will be in writing. Except in the case of leaves for short-term emergencies of thirty (30) days or less, the Employer may, at its discretion, require that the length of a leave coincide with the beginning or end of a semester or term of instruction.

Leave of Absence Without Pay. (a) Full or part-time 1. Applications for leave of absence without pay and for extension of leave of absence without pay may be granted made by an employee for any reason considered acceptable by the Director of Welfare or his designee and may be approved or disapproved at the discretion of the EmployerDirector of Welfare or his designee.
2. Faculty members All leaves of absence are subject to the provisions of applicable Federal and State laws, rules, regulations, including New Jersey Department of Personnel rules and regulations and Board policy.
3. Employees must use all sick days that have accrued prior to commencing a leave of absence without pay, due to the employee's non-work related illness or injury which has been approved by the Director of Welfare or his designee.
a. Permanent employees may apply for job-sharing under the provision for part-time leave of absenceabsence for a period not to exceed six (6) months duration at any one time, subject to approval of the employee's Department Head and the Director of Welfare. Applications Application for extension of said leave of absence may be approved for an additional period not to exceed six (6) months duration, subject to approval of the employee's Department Head and the Director of Welfare. 5. The following constitutes the sole and exclusive method for making application for leaves of absence and for extensions of leaves of absence without pay:
a. For leaves of absence without pay of three (3) days duration or less, the employee will notify his/her immediate supervisor of the request and reason for the request, and said request shall be made subject to prior approval of the immediate supervisor.
b. In all cases of a leave of absence without pay in writing excess of three (3) days, the employee shall apply for a leave of absence in writing, signed and delivered to his/her immediate supervisor. The employee shall file application for leave with his/her immediate supervisor as soon as he/she becomes aware of the administrator responsibleneed for the leave. Application for leave shall include the explicit reason or reasons why leave is necessary and the date for the commencing and terminating of leave. All applications for leave must be accompanied by written documentation of the need for leave as may be appropriate (i.e. medical, educational, military, etc.). Said documentation shall include the explicit reason or reasons for the leave and the period of time the employee will be dealt with promptly unable to work because of the need for the leave. The Board reserves the right to have an employee examined by a qualified physician of its choice and will at the Board's expense before acting upon the employee's request for an extension of leave of absence for medical reasons.
c. No leave of absence shall become effective without prior approval of the employee's Department Head and of the Director of Welfare.
d. Management reserves the right to deny applications for leaves of absence which are not be unreasonably denied, nor dealt with filed in a discriminatory manner. The reply timely manner and/or which in any way does not satisfactorily document the basis for the leave and its duration.

(d) No benefits shall be payable by the Employer 9. Anniversary dates for faculty members employees on leave without pay, except excluding military leave, leave due to a work-related illness or injury and leave subject to the federal Family and Medical Leave Act and/or the New Jersey Family Leave Act, change as provided follows:
a. There will be no change in this Agreement. For faculty members on part- time leave without pay, benefit premiums shall be payable by the Employer anniversary date for employees who are out of work on a pro rata basisleave of absence without pay for less than thirty (30) calendar days.
b. If the leave of absence without pay exceeds thirty (30) calendar days, anniversary dates will change as follows:
1. If a faculty member proceeding on the leave without pay makes a prior payment exceeds 30 calendar days but is less than or equal to 120 calendar days, change the Employer of both anniversary date one (1) quarter later.
2. If the faculty member's share and leave exceeds 120 calendar days but is less than or equal to 210 calendar days, change the Employer's share anniversary date two (pro- rated2) quarters later.
3. If the leave exceeds 210 calendar days but is less than or equal to 300 calendar days, if applicablechange the anniversary date three (3) of any quarters later.
4. If the leave exceeds 300 calendar days but is less than or all of equal to 390 calendar days, change the following benefits, the Employer shall remit these payments to ensure continuous coverage: Life Insurance, Medical Services Plan of BC, Extended Health, Dental, Short and Long Term Disability and AD&D.
(e) For leaves of longer than anniversary date four (4) months, quarters later.
5. Any consecutive period of leave without pay beyond 390 calendar days will result in a change in anniversary date. Leave of Absence Without Pay. 24.1 Full-Time Clerical and Paraprofessionals-Leave of Absence for twenty (a20) Full days or partless:
A. Request for leave of absence without pay shall be made in writing to the Director of Employee Services and routed through the building principal.
B. The Director of Employee Services may grant up to five (5) days leave of absence without pay, and the Superintendent or his/her designee may grant up to twenty (20) days after taking into consideration the following factors:
1. The nature of the request.

24.2 Full-time Time Clerical and Paraprofessional-Leave of absence for more than twenty (20) days: Employees may be granted a leave of absence for twenty (20) days or more only by action of the BOARD based on the following conditions:
A. Requests for leave shall be in writing and directed to the Director of Employee Services.
B. Eligibility shall be based on a minimum of two (2) years of continuous employment in the Peoria Public Schools.
C. All leaves of absence without pay shall be limited to one (1) work year. Further extension shall be limited to one (1) normal work year. Further extension shall be at the discretion of the BOARD. No leave shall be extended beyond two (2) years.
D. Except for Parental Leave, all leaves without pay should commence at the beginning of a work year and reinstatement during the work year shall be at the discretion of the BOARD.

F. Sick leave days shall not accrue, but unused sick leave held at the start of the leave shall be available upon reinstatement.
G. Written notice of intention to either return or resign shall be given by the Employee to the Director of Employee Services sixty (60) days prior to the beginning of the work year. Failure to furnish such written notice shall constitute a notice of resignation.
H. Employees returning to the District from a leave of absence without pay will be reassigned to the position they left, if available, or to any available position for which they are qualified.
I. Leaves of absence without pay may be granted at for a serious health condition after the discretion Employee has exhausted FMLA Leave, study, travel to work in an educational program sponsored by an official governmental agency (Peace Corps, Job Corps, etc.), to serve in public office, or for other good and sufficient reason.
J. Any Employee who takes a leave in order to fulfill his/her student teaching requirements shall be returned to his/her previous position with the District.

Leave of Absence Without Pay. An employee may apply for a leave of absence as set out in Article 14. A leave of absence shall be granted for death or serious illness in the immediate family, union activities, vacation, bereavement, compassionate reasons, pregnancy, paternity and adoption. Where such indefinite leave is granted the employee will give a two week notice in writing of his/her intention to return to work. Leave of absence provisions as outlined in the Collective Agreement and in legislation, specifically the Employment Standards Act will be co-ordinated.
(a) Full Any employee desiring a leave of absence shall make application to his/her supervisor. All requests for leave of absence shall be made on forms provided by the Company and shall be dealt with by the Human Resource Manager. The decision of the Human Resource Manager with regard to any such request shall be rendered within seven (7) working days. Only those employees who have completed their probationary period will be qualified for a leave of absence unless he/she is entitled to such leave under the Employment Standards Act.
(b) The record of the disposition of any such applications shall be available for inspection by the Chairperson of the office committee.
(i) An employee with seniority elected to or partappointed to an elective office of the Union, the nature of the duties of which office would require him/her to absent himself/herself from his/her employment with the Company, shall, upon his/her request in writing, be entitled to a leave of absence. Upon application in writing by such employee to the Company within thirty (30) days prior to the expiry of any such leave of absence, he/she shall be re-employed without loss of seniority.
(ii) An employee with seniority elected or appointed to part time office within the Local Union the nature of the duties of which would require him/her to absent himself/herself from his/her employment with the Company will, upon his/her request in writing, be entitled to a leave of absence. Union requests for such leave shall be made a minimum of ten (10) days before the requested leave begins.
(d) The Company will grant to two (2) employees 2 leaves of absence for Union activities for a period not to exceed fourteen (14) calendar days each, provided, however, that it shall be a condition precedent to the Company's granted leave of absence that the Union notifies the Company at least ten (10) days before such requested leave begins. The Company can give consideration to the need to meet departmental staffing requirements.
(e) The Company will grant to any employee, without loss of seniority, a leave of absence for a period not to exceed one hundred and eighty (180) days for death or serious illness in the immediate family.
(f) The Company will grant to any seniority employee, a leave of absence, without pay, for compassionate purposes, as long as such leave has been justified to the Manager, Human Resources. This leave must be for a minimum of three (3) weeks and a maximum of eight (8) weeks in duration. However, the Manager of Human Resources will consider leaves for a lesser period of time. All requests for compassionate leave must be made in writing and directed to the Manager of Human Resources.
(g) The Company may consider a leave of absence without pay may for personal and/or family related events that are unusual and extraordinary, and are not otherwise covered under the Collective Agreement or under the Employment Standards Act. Leave of Absence Without Pay. A. Any Bargaining Unit Employee holding a regular position may request a leave of absence without pay for any of the following reasons, and approval or denial of such requests will be based on Court operational needs and/or law:

2. To take a course of study which will increase the employee's usefulness on return to his/her position.

If a faculty member proceeding on leave without pay makes a prior payment to the Employer of both the faculty member's share and the Employer's share (pro- rated, if applicable) of any or all of the following benefits, the Employer shall remit these payments to ensure continuous coverage: Life Insurance, Medical Services Plan of BC, Extended Health, Dental, Short and Long Term Disability and AD&D.soon as is possible.

Leave of Absence Without Pay. Section 25.1 “Authorized Personal Leave” (aAPL) Full applies after exhausting all other applicable leave and shall be scheduled at least 24 hours in advance and approved by the employee’s supervisor except when utilized per the provisions of Section 34.9. APL shall not be considered negatively or partheld against the employee as concerns evaluations, promotional consideration, or any other employment factors. The parties understand APL shall be considered authorized leave without pay and shall be coded “APL” on timesheets, leave reports and for all payroll purposes. APL shall be closely monitored and shall normally be used only for non-illness related absences.
A. The employee shall request approval of APL in writing to the appropriate supervisor. The request shall specify the dates and the reason for APL.
B. All requests for APL in excess of thirty (30) calendar days shall be approved by the Human Resources Director prior to the granting of the leave. Any APL in excess of six (6) months must be approved by the Mayor or designee.
C. At the expiration of an APL absence, the employee shall be reinstated in the position he vacated or in any other vacant position in the same class.
D. “Leave Without Pay” (LWOP) shall be considered as unauthorized absence from duty and shall be administered without pay. Leave Without Pay shall be coded as “LWOP” on timesheets, leave reports, and for all payroll purposes. Further, upon returning from an unauthorized leave of absence or based on an employee’s failure to contact his/her department during such a leave of absence without pay, the employee shall be subject to possible disciplinary action which may include dismissal.
E. A leave of absence without pay for more than one hundred sixty (160) continuous work hours shall not constitute a break in service; however, time spent while on leave of absence without pay shall not be used in computing time-in-grade for satisfactory performance increases. Vacation and sick leave benefits shall not accrue during a leave of absence without pay in excess of one hundred sixty (160) continuous work hours.
F. Any employee who shall receive payment for work performed for any employer other than the City of Tulsa while on either APL or LWOP shall be subject to immediate dismissal, except when an employee has received specific written approval from the department head or designee for use of such leave for the purpose of outside employment (also see 25.1B).
G. Failure on the part of an employee to report promptly at the expiration of a leave of absence without pay may be granted at the discretion of the Employer. Faculty members may apply cause for job-sharing under the provision for part-time leave of absence. Applications shall be made in writing to the administrator responsible. All applications will be dealt with promptly and will not be unreasonably denied, nor dealt with in a discriminatory manner. The reply to an application for leave will be in writing. Except in the case of leaves for short-term emergencies of thirty (30) days or less, the Employer may, at its discretion, require that the length of a leave coincide with the beginning or end of a semester or term of instructiondismissal.
(b) Where a leave is granted, the faculty member's performance evaluation shall be extended accordingly.
(c) No salary increment is payable for a period of leave of absence without pay unless the University President, upon written request from the faculty member concerned, decides the leave is spent in the activities relevant to the University curriculum. In this case, the faculty member will receive any salary adjustments for which he/she would normally be eligible. In the event that the University President judges that the activities are not relevant to the University curriculum, he/she will advise the faculty member as to the reasons for his/her decision in writing before the leave commences.
(d) No benefits shall be payable by the Employer for faculty members on leave without pay, except as provided in this Agreement. For faculty members on part- time leave without pay, benefit premiums shall be payable by the Employer on a pro rata basis. Leave of Absence Without Pay. (a) Full or part-time 28.01 A unit member may request and be granted in writing a leave of absence without pay may be granted for a period of up to six (6) months at the discretion of the EmployerFire Chief, or designee, where one of the following benefits will result: restoration of a unit member's health, increased job knowledge or an interest of the County is served. Faculty A longer period of time or an extension may be granted by the County Manager.
28.02 Leave without pay is a matter of right for members may apply of the National Guard or the U.S. Armed Forces Reserve requesting leave without pay for job-sharing military duties under the provision Uniformed Services Employment and Reemployment Rights Act “USERRA”, and unit members who are eligible under provisions of Section 9 of the Family and Medical Leave Act of 1993 (FMLA).
28.03 It is understood that any leave without pay time taken for part-the purposes permitted under the FMLA shall be attributed to any remaining FMLA time available to the unit member.
28.04 A unit member shall not be eligible to accrue or use annual or sick leave while on leave of absence. Applications shall be made in writing absence without pay.
28.05 It is acknowledged that a unit member may have paid whatever portion of the premium for group health insurance necessary to cover the administrator responsible. All applications will be dealt with promptly and will not be unreasonably denied, nor dealt with in a discriminatory manner. The reply to an application for leave will be in writing. Except in first full month that starts during the case of leaves for short-term emergencies of first thirty (30) days or lessof the leave of absence. However, the Employer may, at its discretion, require that cost of premiums for optional coverage must be borne by the length of a leave coincide with unit member. (b) Where a leave is granted28.06 The unit member shall return to his/her former position or an equivalent position with equivalent benefits, the faculty member's performance evaluation shall be extended accordingly.
(c) No salary increment is payable for a period pay and other terms and conditions of leave of absence without pay unless the University Presidentemployment, upon written request from the faculty member concerned, decides the leave is spent in the activities relevant to the University curriculum. 28.07 Any unused annual and sick leave shall remain in the respective bank and shall be eligibleavailable for use upon return to work. Leave of Absence Without Pay. (a) Full or part-time 15:01 A leave of absence without pay may be granted at by the discretion of Board to a Member, in accordance with the Employer. Faculty members may apply for job-sharing under the provision for part-time conditions set out in this article.
15:02 A leave of absence. Applications absence granted under this Article shall be made without salary/wages.

15:04 Before commencing a leave of absence, a Member may continue employee benefit coverage under Article 47 – Insured Employee Benefits, during the period of the leave by paying the full cost of the premiums. The responsibility for making these arrangements rests with the employee.
15:05 The period of a leave granted under this Article shall be for up to one (1) year.
15:06 An extension of up to one (1) year may be granted to the Member with the approval of the Board upon written request of the Member received by the Board not less than four weeks prior to the end of the leave.
15:07 Subject to Article 45, Layoff and Recall, at the end of the period of the leave of absence, or its extension, the Member shall return to the same position and work location held by the Member immediately prior to the commencement of the leave of absence, if the position at that location still exists and is vacant, or to a comparable position if it does not exist or is not vacant. If the Member has applied and been appointed to another position with the Board during the period of leave of absence without pay unless the University PresidentMember shall return to work in that position, upon written request from if it still exists, or to a comparable position if it does not. For the faculty member concerned, decides the leave is spent in the activities relevant to the University curriculum. In purposes of this caseclause, the faculty member position will receive any salary adjustments for which he/she would normally be eligible.
