Leave of Absence Without Pay. A Section 1. All requests for leave of absence without pay shall be made in writing by the employee desiring the leave. Such requests shall set forth fully the reasons for the request of such leave, the date when such leave would begin and end, and a statement of the desire and intention of such employee to return to the service of the City at the expiration of the leave. In the case of a reasonable time after notice in writing request for an unpaid leave of absence due to return a prolonged illness or disability due to dutyinjury, the employee must file for FMLA leave as well, and such request must be accompanied by a physician's or licensed psychologist’s certificate identifying the illness or injury, explaining why the leave is needed, estimating how long the illness or disability due to injury will continue, and substantiating the need for continuing the leave as required by the Director of Human Resources. G. Leave of Absence Without Pay. A An Employee covered by this Agreement may be granted leave of absence without pay for sickness, disability, or other good and sufficient reasons which are considered to be in the best interests of the City.
A. The Chief of Police may be granted authorize up to thirty (30) days leave without pay to an employee when it would improve the quality of the employee's job performance for the City or is otherwise in the best interest of the City. E. Employees on leave may not work for another employer during their leave unless such employment is part of the purpose of the leave (e.g., internships as part of an educational program). The determination of appropriate employment while on leave without pay shall rest solely with the City Manager.
F. In the case of a request for an unpaid leave of absence due to report promptly at its expirationa prolonged illness or disability due to injury, the employee must file for FMLA leave as well, and such request must be accompanied by a physician's or within a reasonable time after notice in writing licensed psychologist’s certificate identifying the illness or injury, explaining why the leave is needed, estimating how long the illness or disability due to return to dutyinjury will continue, and substantiating the need for continuing the leave as required by the Director of Human Resources. If the City so desires, the employee on leave shall be cause for dischargeexamined by a physician or licensed psychologist selected by the City. In the event of leave of absence due to injury or illness, after all sick leave is exhausted, utilization of accrued vacation, compensatory time and/or floating holidays shall be at the option of the employee.

Leave of Absence Without Pay. A All requests for leave of absence without pay shall be made in writing by the employee desiring the leave to the Fire Chief. Such requests shall set forth fully the reasons for the request of such leave, the date when such leave would begin and end, and a statement of the desire and intention of such employee to return to the service of the City at the expiration of such leave. Such requests shall be transmitted to the City Manager by the Fire Chief with a statement of his approval or disapproval of the request, his plan for taking care of the work during the absence of the employee and if necessary, his request for certification of an eligible person for appointment to the temporary vacancy. Leave of Absence Without Pay. A. All requests for a leave of absence without pay for up to ten (10) workdays require a written application to the Police Chief. The application shall contain the specific reason for the leave, the date leave would begin, and the probable date of return. The application shall be submitted prior to the first effective day of the leave.
B. A leave of absence without pay beyond ten (10) workdays requires approval from the Police Chief and the HR Director. The application shall contain the specific reasons for the leave over ten (10) days, the date leave would begin, and the probable date of return. A written application signed by the Police Chief shall be submitted to the HR Director two (2) weeks prior to the first effective day of the leave, except for emergency situations.
C. An employee on a leave of absence without pay may engage in other employment under the following conditions:
1. having secured the Police Chief's prior approval; and
2. having secured the Police Chief's approval of the specific type of employment prior to beginning work. To engage in other employment while on a leave of absence without pay, except as herein defined, automatically constitutes termination of employment with the City.
D. An employee who is on a leave of absence without pay does not accumulate vacation and sick leave as though she/he were being paid. An employee on leave beyond one (1) month, must bear full cost of all benefits.
E. The failure of an employee on a leave of absence without pay to report back to work at the end of his/her leave, or to secure the approval of the Police Chief or the HR Director to extend the leave will be considered a voluntary resignation by the employee.
F. Employees returning from leave of absence prior to their agreed upon date shall be returned to their former positions as soon as practicable. Employees on leave of absence shall be reinstated to their former positions at the agreed upon end of their leave, unless mutually agreed by the Police Chief and the employee. An employee on leave of absence without pay shall not accumulate seniority during his/her absence, and upon his/her return to duty an employee's seniority shall be adjusted according to the length of his/her absence
G. Leave of Absence for Medical Condition
1. An employee who develops a medical condition that causes his/her absence from work, may, upon a physician's certification (acceptable to the City) of inability to work, begin the use of accrued sick leave or request a medical leave of absence for up to ninety (90) calendar days.
2. To be eligible for this leave of absence, an employee must have been employed by the City, as a regular employee in good standing with continuous and uninterrupted service, for no less than one (1) full year prior to commencing such leave.
3. Such a leave of absence may be granted to an employee when it would improve the quality of the employee's job performance for the City or is otherwise in the best interest of the City. This may include leave for such purposes as additional job-related education or training, or extended illness not covered by accumulated sick leave. For the purposes of this section, a leave of absence is a privilege that may be granted to an employee wishing to leave the City service in good standing without pay for a limited period. Such employee must make a written request to their supervisor for such leave, stating the dates upon which they wish to leave and to return, and the reason for the request. F. Leaves of absence shall be granted upon the following terms and conditions, unless specifically varied by written agreement between the Board and the staff person applying for leave:
1. Leave of Absence Without Pay. A leave Leave of absence without pay may be granted upon the recommendation of the Chief of Police and the approval of the City Administrator for the following reasons:
A. For the purposes of this section, Where a leave of absence is given, the vacancy thus caused shall be filled, if necessary, by a privilege that may be granted to temporary appointment.
C. To enter the Armed Services of The United States in any period of national emergency, and upon their release or discharge from service, an employee wishing granted such leave shall be authorized to leave resume their position with their former status, provided that such person shall resume their employment within ninety (90) days after their discharge or release from military service. B. C. A pregnant employee holding a position by permanent appointment, shall be granted a leave of absence without pay for a period of six months, which may be extended upon the recommendation of the department head and the approval of the Personnel Officer, up to one year. The employee shall report to the department head the existence of pregnancy not later than the end of the fourth month. The department head may recommend placing the employee on leave at any time during the pregnancy when in his judgment the interests of either the department or the employee would be best served by such action.
D. Absence for more than thirty continuous days under this rule may cause adjustment in time for considering increments.
X. Xxxxxxx of an employee to exceed six (6) months. When reporting return to work at his position on the date of the expiration of any leave of absenceabsence without pay, or any authorized extension thereof, shall be deemed a resignation from the service upon the date such leave of absence without pay commenced.

Leave of Absence Without Pay. A All requests for leave of absence without pay shall be made in writing by the employee desiring the leave. Such requests shall set forth fully the reasons for the request of such leave, the date when such leave would begin and end, and a statement of the desire and intention of such employee to return to the service of the City at the expiration of the leave. Such request shall be transmitted to the City Manager by the department head with a statement of his approval or disapproval of the request, his plan for taking care of the work during the absence of the employee and if necessary ,his request for certification of an eligible person for appointment to the temporary vacancy. No leave of absence shall be effective until formally requested as stated above and approved by the City Manager, except that when leave of absence is made necessary through sudden illness or injury or service of country or state, the department head may grant such leave without a signed statement from the employee; and the approval thereof, if given by the City Manager, shall be retroactive.

Leave of Absence Without Pay. A A. Apart from circumstances covered by the Family and Medical Leave Policy, leave of absence without pay may be granted at the discretion of the superintendent or board of education to personnel who have worked continuously for three years upon application, in writing, to the superintendent of schools.

C. Such application shall specify the quality beginning and termination dates of the employee's job performance for the City or is otherwise in the best interest of the City. H. An employee granted a Leave of Absence Without Pay by the Superintendent shall not lose accumulated sick leave.
I. Leaves of absence will not be granted to take other employment outside Xxxxxx-XxXxxxxx County Schools, or to go into business.
J. Persons returning to work, who have been on a Leave of Absence Without Pay, must complete a New Employee Packet and applications to become eligible for dischargedistrict group benefits.

Leave of Absence Without Pay. A. Employees may be granted a leave of absence without pay or fringe benefits for the following reasons:
1. Health
2. Study
3. Military Service
4. Union Activity
5. Such other justifiable reasons as may be approved by the Chancellor or designee.
B. Employees shall be eligible for an authorized leave of absence after one (1) year of service with the Employer which immediately precedes the authorized effective date of such leave of absence.
1. An employee who requests a leave of absence shall make an application in writing to the Vice Chancellor for Human Resources with a copy to the Chief. The application shall state the reasonthe leave of absence is being requested and the approximate length of time of said absence.
2. The application of an employee for a leave of absence will be considered by the Employer upon its individual merit and circumstances and the parties agree that the determination of whether or not the request shall be granted rests solely at the discretion of the Employer. A request for a leave of absence shall be answered promptly by the Employer. An authorization for leave of absence shall be in writing.
3. A leave of absence, when granted by the Employer, shall not exceed the time specified in the authorization. Such leaves of absence may be granted extended at the sole discretion of the Employer but the written authorization of the Employer is required in such cases. Employees who fail to return from an approved leave of absence on the date specified, shall be considered as voluntarily terminated. Requests for extension of a leave of absence must be made at least thirty (30) days in advance of the agreed date of return. The thirty (30) day requirement may be waived in cases of medical leave.
4. The discretion in granting leaves of absence shall not be abused by the Employer. Public Safety Officers absent due to a leave of absence specified in A (1-5) above, shall be required to conform to MCOLES regarding certification prior to resuming their duties. Recertification costs shall be borne by the employee.
C. If an employee when it would improve works for another Employer during an authorized leave of absence, the quality authorized leave of absence shall be canceled and said employee shall be considered to have voluntarily terminated his/her employment. Any employee taking leave of absence without the prior written authorization of the employee's job performance for Employer shall be considered to have voluntarily terminated his/her employment. Any employee who takes an approved leave of absence of thirty (30) days or more on an accumulativebasis or who is drawing short-term or long-term disability shall not accumulate vacation or sick leave days under Articles 9 and 13 during the City or is otherwise in the best interest period of said absence.
D. Employees who are members of the City. E. The provisions of this paragraph shall be subject to all applicable Federal Laws now in force, or as amended relating to the rights of returning veterans. Such Federal laws or regulations shall be applied if inconsistent in any manner with the provisions of this paragraph. An employee who shall enter into active service in the Armed Forces of the United States shall be given a leave of absence without pay subject to the conditions herein. On voluntary enlistment, this Section will only apply for the first enlistment period plus six (6) months of service.
1. Said employee shall retain any rights accumulated prior to his/her leave of absence and rights guaranteed under the applicable Federal laws now in force, or as amended.
2. Such employee, upon termination of such leave, shall be offered reemployment in his/her previous position held unless the circumstances have so changed as to make it impossible or unreasonable to do so, in which even he/she will be offered such employment as may be available and for which he/she is capable of doing at the time current rate of pay for such leave was grantedwork, unless they conduct themselves while on such leave provided he/she meets the following requirements.
a. He/she has not been dishonorably discharged.
b. He/she is physically able to do the work.
c. He/she applies for re-employment within ninety (90) days of completion of service or release from hospitalization continuing not more than one (1) year after discharge from the service.
3. As used herein "Armed Forces in a manner constituting cause for dischargethe United States" is defined as and limited to the United States Army, Navy, Marine Corps, Air Force, Coast Guard, or the Public Health Service.
4. Failure on the part of an employee on military leave of absence to report promptly at its expiration, or make an application for reinstatement within a reasonable time after notice in writing to return to duty, such ninety (90) day period shall be cause for dischargeconsidered as a resignation and such employee shall lose all employment rights he/she would be otherwise entitled to hereunder.
