Liability of the User. 1. The user is liable for all damages suffered by High-End Nanny Services caused by the breach of contract and/or User Terms for use of the services of High-End Nanny Services and/or by initiation, implementation, and/or termination and/or liquidation of the Nanny Agreement. User commits to exonerate High-End Nany Services for all damages inflicted on High-End Nanny Services by potential claims of users or third parties caused by the breach of the Terms of Use of the services of High-End Nanny Services and/or initiation, implementation and/or termination of the Nanny Agreement. 2. The user and the nanny are responsible for the conclusion of their own legal liability and accident insurance and the conclusion of the Nanny Agreement.

Liability of the User. The User shall be liable for 1. Non-compliance of Terms & Conditions mentioned herein. 2. If it has breached the Terms & Conditions or contributed or caused the loss by negligent actions such as the following: ▪ In disclosing or failing to take all reasonable steps to prevent disclosure of the User- id and/or password to anyone including Issuer’s staff and/or failing to advise the Issuer of such disclosure within a reasonable time. ▪ Not advising the Issuer within a reasonable time about unauthorized access to or erroneous transactions in the account(s) through the MPay Portal and MPay Wallet Services.

Liability of the User i. Neither Bank nor the Affiliate/s shall be liable for any unauthorised transactions occurring through the Internet Banking and the User hereby fully indemnifies and holds Bank and the Affiliates harmless against any action, suit, proceeding initiated against it or any loss, cost or damage incurred by it as a result thereof. ii. Bank shall under no circumstance be held liable to the User if the Internet Banking is not available in the desired manner for reasons including but not limited to natural calamities, legal restraints, faults in the telecommunication network or network failure, or any other reason beyond the control of Bank. iii. Under no circumstances shall Bank be liable for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the User or by any other person. iv. Illegal or improper use of the Internet Banking shall render the User liable for payment of financial charges as decided by Bank or will result in suspension/termination of the Internet Banking services extended to such User/s. The aforesaid does not limit Bank’s right to initiate appropriate legal proceedings against such customers.

Liability of the User. For violation of the provisions of this Agreement, the User’s access to the Website or its individual services may be temporarily suspended or blocked for an indefinite period. The User's access to the Website (its individual services) is restored at the discretion of the Website Owner at the written request of the User. In the event of repeated or gross violation by the Users of the provisions of this Agreement, their accounts may be deleted. The Users shall be liable for the actions of their authorized employees in the exchange of information in accordance with this Agreement. If as a result of such actions the Website Owner incurs losses, the User shall reimburse it in full.

Liability of the User. When the User uses the product, they shall expressly undertake to comply with all the application laws, rules and regulations. The User shall be solely responsible for any use of GUITAR PRO that violates the rights of third parties, including those resulting in the creation of new works.

Liability of the User. 4.1.1. By acceding to this Agreement the User understands, acknowledges and accepts that he/she shall: - be absolutely and personally liable for the content and compliance with the statutory provisions of the Russian legislation and this Agreement of all materials posted on the Website; - be absolutely and personally liable for compliance of the methods and other terms of use of other Users' materials and other information provided on the Website with the statutory provisions of the Russian Law (including, but not limited to, the rules of intellectual property law and information protection), this Agreement; - be absolutely liable for the safety of its account (login and password), as well as for all actions performed under its account; - use the Website at its own risk. 4.1.2. The User shall be obliged to settle all claims of third parties related to the User's actions or omissions when using the Website at its own discretion and at its own expense. 4.1.3. The User acknowledges and agrees that the IP address of the personal computer (personal identification number of the computer) of the User, as well as other information available under the HTTP Protocol shall be recorded by the Administration's technical means, and in case of actions in violation of this Agreement, illegal actions, including actions violating the intellectual rights of third parties, the owner of the personal computer determined by the Administration's technical means shall be recognized as responsible for these violations, illegal actions.

Liability of the User. Users have sole responsibility for adequate protection and backup of data and/or equipment used in connection with the Network and will not make a claim against HCC for lost data, re-run time, inaccurate output, work delays or lost profits resulting from the use of the Network. Users agree to defend, indemnify and hold harmless HCC (including its employees and the HCC Board of Trustees) from, and covenant not to sue HCC for, any claims based on, or stemming from, use of the Network.

Liability of the User. The User shall defend and indemnify and in all cases be liable to Terminal Company for any damage, loss, or liability suffered or incurred by Terminal Company on account of the injury to or death of persons or damage to or destruction of Terminal Company's or any third party's property (including government property and public property) which is caused by the negligence or willful misconduct of or omission of User, its agents, or employees which arises from or out of the delivery by User of Commodities which do not meet the normal specification for **********; and User shall hold harmless, indemnify, and defend Terminal Company from and against any and all claims, suits, liabilities, and expenses on account of such injury, death, damage, or destruction so arising.

Liability of the User. The User shall defend and indemnify and in all cases be liable to Terminal Company for any damage, loss, or liability suffered or incurred by Terminal Company on account of the injury to or death of persons or damage to or destruction of Terminal Company's or any third party's property (including government property and public property) which is caused by the negligence or willful misconduct of or omission of User, its agents, or employees which arises from or out of the delivery by User of Commodities which do not meet the normal specification for the Commodities (or such other ********** as agreed pursuant to the definition of Commodities), or which contain **********, and User shall hold harmless, indemnify, and defend Terminal Company from and against any and all claims, suits, liabilities, and expenses on account of such injury, death, damage, or destruction so arising.
