Dumping If a Party finds that dumping, within the meaning of Article VI of GATT 1994 is taking place in trade relations governed by this Agreement, it may take appropriate measures against that practice in accordance with Article VI of the GATT 1994 and the rules established by agreements related to that Article.
Migration MCK shall provide all requisite assistance as is reasonably requested by NewCo in order to migrate the Services from MCK’s personnel, facilities and environment to NewCo’s (or its designee’s) personnel, facilities and environment, provided, that, other than as expressly set forth in the Service Schedule, NewCo shall be responsible for all third-party costs incurred by MCK and its Affiliates to migrate such Services and, provided further, that, NewCo shall be responsible for all costs associated with operational decisions made by NewCo for its set-up costs and costs to procure items (e.g., selection of Customer Relationship Management software). For the avoidance of doubt, NewCo will be responsible for migration to any new NewCo Data Center, including design, implementation and testing. MCK will provide reasonable support in such efforts. MCK will provide to NewCo an electronic copy in the then-current format of all data that is owned by NewCo (a) a written description of processes and procedures used by MCK in connection with the provision of Services to the Core MTS Business to the extent such descriptions exist, (b) a written description of all system documentation, architecture diagrams and business process diagrams for the systems, processes and controls used in the Core MTS Business to the extent such descriptions exist and (c) written training and onboarding materials used in the Core MTS Business to the extent such materials exist. In addition, MCK will, upon NewCo’s reasonable request, make available knowledgeable MCK personnel for knowledge transfer and discussion at a mutually agreed upon time with respect to the Services and the processes, procedures and systems used in the provision of the Services. The parties will meet in person to establish, within two (2) weeks following the Closing Date, a planning process for the migration of the Services from MCK’s personnel, facilities and environment to NewCo’s (or its designee’s) personnel, facilities and environment. During such meetings, the parties will identify workstreams and workstream leaders, staff project teams for each workstream, identify roles and responsibilities for project team members and create a project charter that will serve collectively as the basis for developing more detailed timelines and specific deliverables for each of the workstreams. At a minimum, there will be a workstream for each functional area that is the subject of Schedules. Each workstream will report to the Project Managers. The parties will meet (in person or by telephone) as often as is reasonably necessary to develop such detailed timelines and specific deliverables for each workstream.

Bumping The employee scheduled for layoff under Section D. may elect to either accept layoff or bump in accordance with the process outlined in this Section. An employee scheduled for layoff who fails or is unable, in accordance with Section D.3., to exercise the option to bump to the least senior position shall be laid off. Within seven calendar days of receipt of notification of layoff, the employee scheduled for layoff shall notify the Employer of his/her decision to either accept layoff or bump within his/her current class series, as listed below. Alternatively, an employee may bump into the least senior position in the layoff unit in a former class series at or below any level at which the employee had satisfactorily completed the required probationary period. This alternative shall not apply to employees who were demoted from the higher paying class for disciplinary reasons or who transferred from the higher paying classification in less than satisfactory employment status. An employee seeking to bump into another position must meet all requirements in accordance with Section D.3. As a result of bumping, an employee shall not earn more than the maximum rate of the lower classification bumped into or more than the rate previously earned in a higher classification from which the employee bumped. When an employee bumps downward, he/she shall be paid at that step in the lower level pay range which credits the service in the higher level range(s) to the step at which the employee was paid when promoted from a lower level. 1. The Employer shall identify the vacancies and least senior employees within the layoff unit equal to the number of positions being abolished within the layoff unit. These least senior employees shall be issued layoff notices.
2. If the layoff unit contains more than one work location, employees remaining in the layoff unit who are displaced from their original work location (due to the closure, reduction consolidation, etc.), will be placed in existing vacancies or the vacated positions identified in step 1 above. Placement into these positions shall be in seniority order based on preferences provided by the employees.
3. Employees remaining in the layoff unit may request an exchange transfer (one for one transfer) with any bargaining unit member in the same classification in accordance with Article 15 Part D §A.6., either within or outside the layoff unit. Exchange transfers shall not be unreasonably denied and will be processed with the rest of the layoff unit moves, if possible. In addition, during the bump process, exchange transfers occurring within this Article shall supersede all other closer to home and seniority based transfers or recalls, as no vacancy exists. Requests for exchange transfers shall be in writing by both employees requesting to exchange.
4. The parties may reach mutual agreement to modify the process to minimize impact on affected employees as necessary.
Pendahuluan Industri perbankan syari’ah di Indonesia tengah memasuki fase growth (pertumbuhan) xxx sangat membutuhkan kepercayaan xxx loyalitas masyarakat untuk terus meningkatkan produktivitasnya. Kepercayaan xxx loyalitas mutlak dibutuhkan untuk memasuki fase maturity perbankan syariah dalam menghadapi kompetisi global. Kepercayaan xxx loyalitas tidak dapat diperoleh tanpa adanya produk- produk yang mampu menjawab kebutuhan masyarakat. Produk bank syariah sudah semestinya mampu memenuhi seluruh komponen masyarakat, baik dalam produk funding, financing, xxx services. Oleh karenanya, inovasi produk bank syariah menjadi syarat mutlak sebagai indikator bahwa bank syariah mampu beradaptasi dengan kebutuhan manusia modern. Inovasi produk merupakan salah satu unsur penting untuk dapat menjaga sustainabilitas perusahaan. Inovasi produk merepresentasikan kemampuan perusahaan untuk dapat memenuhi kebutuhan pasar sekaligus sebagai upaya untuk memperoleh keuntungan perusahaan. Bank syariah pada dasarnya telah melakukan serangkaian upaya inovasi, salah satunya adalah dengan melakukan “rekayasa” (engineering) terhadap akad- akad dalam fiqh muamalah. Beberapa akad dalam fiqh muamalah tidak begitu saja diadopsi oleh perbankan syariah, namun juga “diadaptasikan” dengan kebutuhan masyarakat terhadap xxxx-xxxx perbankan. Rekayasa xxx adaptasi ini memang sebuah keniscayaan, karena jika adopsi dilakukan secara apa adanya maka produk bank syariah diragukan dapat memberikan manfaat yang tepat bagi masyarakat. Prinsip keleluasan bermuamalah dalam Islam merupakan modal utama untuk menghadapi kompleksitas permasalahan ekonomi serta besarnya tuntutan masyarakat akan peran perbankan syariah.1 Dalam rangka memenuhi kebutuhan masyarakat xxx mengembangkan industri perbankan xxx keuangan xxxx xxxx kompetitif, inovasi dalam berbisnis yang dilakukan oleh perbankan syariah melalui serangkaian adaptasi tersebut memang sudah menjadi tuntutan bisnis. Sebagai contoh dapat dikemukakan xxxxxx xxxx kartu kredit syariah, asuransi syariah, obligasi syariah, FX iB, xxx Islamic Swap. Produk-produk dalam kegiatan keuangan syariah tersebut mengandung beberapa akad. Sebagai contoh, dalam transaksi kartu kredit syariah terdapat akad ijarah, qardh, xxx kafalah. Obligasi syariah mengandung sekurang-kurangnya akad mudharabah (atau ijarah) xxx wakalah, serta terkadang disertai kafalah atau wa’d. Islamic swap mengandung beberapa kali akad tawarruq, bay‘, wakalah, xxxxx, xxx terkadang disertai wa’d.2 Dalam setiap transaksi, akad-akad tersebut dilakukan secara bersamaan atau setidak-tidaknya setiap akad yang terdapat dalam suatu produk tidak bisa ditinggalkan, karena kesemuanya merupakan satu kesatuan. Hybrid contract merupakan perbincangan yang masih hangat dikalangan para cendikiawan muslim untuk menentukan keabsahan hukumnya. Pendapat pertama mengatakan hukumnya mubah berdasar kaidah fiqh al-ashlu fi al-mu’amalat al-ibahah (hukum asal muamalah adalah boleh). Pendapat kedua mengharamkan berdasarkan dengan hadits-hadits yang mengharamkan dua jual beli dalam satu jual beli (bai’ataini fi bai’atin), atau mengharamkan dua akad dalam satu akad (shafqatain fi shafqatin).3 Sebagai entitas bisnis yang menjadi bagian penting dalam sistem ekonomi syariah sebagai induknya, tentunya industri perbankan syariah tidak boleh keluar dari nilai-nilai syariah. Melakukan inovasi memang tuntutan bisnis, namun menjaga shariah compliance juga menjadi kewajiban bagi setiap pelaku bisnis syariah, tidak terkecuali perbankan syariah. Profit-oriented hanya boleh dijadikan sebagai media (tool) untuk mencapai tujuan (goal), yaitu benefit-oriented. Produk bank syari’ah seyogyanya memiliki multi benefit, yaitu: material benefit, emotional benefit, xxx spiritual benefit.4 Mengacu pada kondisi tersebut, maka inovasi produk perbankan syariah setidaknya memerhatikan inovasi dalam dua dimensi, yaitu dimensi ekonomi xxx dimensi sosial. Inovasi dalam dimensi ekonomi artinya bahwa produk perbankan syariah harus mampu menghadirkan produk yang sesuai dengan kebutuhan masyarakat, sehingga bank syariah menjadi pilihan utama masyarakat. Jika hal ini dapat dilakukan, maka fungsi-fungsi bank syariah akan mampu memainkan perannya sebagai intermediary institution. Pada dimensi sosial, sebagai produsen jasa keuangan syariah, bank syariah bertanggung jawab untuk melakukan edukasi terhadap perilaku masyarakat. Bank syariah xxx masyarakat xxxxxx melekat xxx memengaruhi satu dengan yang lain. Recycling If this Agreement provides for the purchase or use of goods specified in PCC 12207 (for example, certain paper products, office supplies, mulch, glass products, lubricating oils, plastic products, paint, antifreeze, tires and tire-derived products, and metal products), this section is applicable with respect to those goods. Without limiting the foregoing, if this Agreement includes (i) document printing, (ii) parts cleaning, or (iii) janitorial and building maintenance services, this section is applicable. Contractor shall use recycled products in the performance of this Agreement to the maximum extent doing so is economically feasible. Upon request, Contractor shall certify in writing under penalty of perjury, the minimum, if not exact, percentage of post consumer material as defined in the PCC 12200, in such goods regardless of whether the goods meet the requirements of PCC 12209. With respect to printer or duplication cartridges that comply with the requirements of PCC 12156(e), the certification required by this subdivision shall specify that the cartridges so comply.

Dewatering (a) Where the whole of a site is so affected by surface water following a period of rain that all productive work is suspended by agreement of the Parties, then dewatering shall proceed as above with Employees so engaged being paid at penalty rates as is the case for safety rectification work. This work is typically performed by Employees engaged within CW1, CW2 or CW3 classifications. When other Employees are undertaking productive work in an area or areas not so affected then dewatering will only attract single time rates.
(b) Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, appropriate Employees shall assist in the tidying up of their own work site or area if it is so affected. Where required, appropriate Employees will be provided with the appropriate PPE. Such work to be paid at single time rates. Productive work will continue in areas not so affected.
(c) To avoid any confusion any ‘dewatering’ time which prevents an Employee from being engaged in their normal productive work is not included in any calculation for the purposes of determining whether an Employee is entitled to go home due to wet weather (refer clauses 32.4 and 32.5)
Retrenchment At any time during an individual’s service, the individual may be subject to retrenchment in accordance with the provisions of Article 22 of the Agreement. In such cases, the notice provisions and all other terms of that article shall apply, anything above to the contrary notwithstanding.
