LOCAL MATERIALS. Irrespective of actual distance involved, local materials such as bricks, stones, aggregates, sand, road metals etc shall conform to or superior to the specifications given here in after and to the samples kept in the office of GEs/EIC. The tenderers are advised to inspect these samples. The tenderers shall be deemed to have inspected the samples and have full knowledge thereof whether they inspect them or not before quoting their tender.

LOCAL MATERIALS. The first sentence of the seventh paragraph of this Subsection of the Standard Specifications is hereby deleted and the following substituted therefore: The following requirements shall apply to all material sites used on the project regardless of whether such material sites are located on private lands or public lands, with the exception of established commercial sources, as follows: The third, fourth, and fifth paragraphs after subparagraph (e) on the middle of page 28 of the Standard Specifications are hereby deleted. Should material sites be located on public lands under the jurisdiction of the Bureau of Land Management, new Part 23 of Title 43 as noted in Subsection 106.03 shall pertain. Any material imported for use can not originate from an uncontrolled hazardous waste site, or similar site as defined by federal, state or local regulation or definition, unless it meets all necessary federal, state or local regulation and agency determinations. No contaminated, regulated or hazardous materials as defined by federal, state or local regulation or definition, may be imported for use. Imported material must comply with federal, state or local regulations and requirements, as necessary. Material determinations can be accomplished through accepted customary practice to satisfy; the innocent landowner defense, risk-based criteria, and worker and public safety, as required by federal, state or local regulations and agencies.

  • Instructional Materials A. The Board recognizes that appropriate texts, library reference facilities, maps and globes, laboratory equipment, audio-visual equipment, art supplies, athletic equipment, current periodicals, standard tests and questionnaires, computers, and similar materials are the tools of the teaching profession.

  • Equipment and Materials Contractor at its sole cost and expense shall provide and furnish all tools, labor, materials, equipment, transportation services and any other items (collectively, "Equipment") which are required or necessary to perform the Services in a manner which is consistent with generally accepted standards of the profession for similar services. Notwithstanding the foregoing, District shall not be responsible for any damages to persons or property as a result of the use, misuse or failure of any Equipment used by Contractor of the Contracted Parties, even if such Equipment is furnished, rented or loaned to Contractor or the Contracted Parties by District.   • Proprietary Materials Each of the Parties shall own its own intellectual property including without limitation all trade secrets, know-how, proprietary data, documents, and written materials in any format. Any materials created exclusively by IPS for the School shall be owned by IPS, and any materials created exclusively by Operator for the School shall be Operator’s proprietary material. The Parties acknowledge and agree that neither has any intellectual property interest or claims in the other Party’s proprietary materials. Notwithstanding the foregoing, materials and work product jointly created by the Parties shall be jointly owned by the Parties and may be used by the individual Party as may be agreed upon by both Parties from time to time.

  • Technical Information The Employer agrees to provide to the Union such information that is available relating to employees in the bargaining unit, as may be required by the Union for collective bargaining purposes.
