Local Water Management Plan Clause Samples
The Local Water Management Plan clause establishes requirements for the development, implementation, and maintenance of a site-specific plan to manage water resources effectively. Typically, this clause obligates the responsible party—such as a contractor or developer—to assess water usage, control runoff, prevent pollution, and comply with relevant local regulations throughout the duration of a project. Local Water Management Plan. After consideration, but before adoption by its governing body, each member local governmental unit shall submit its Local Water Management Plan to the Joint Powers Board for review of its consistency with the Watershed Management Plan of the Middle St. Croix Water Management Organization. Each member local governmental unit may also adopt, by resolution, the Middle St. Croix Watershed Management Plan, as its own local plan. The Joint Powers Board shall approve or disapprove each Local Water Management Plan or parts thereof. The Joint Powers Board shall have sixty (60) days to complete its review. If the Joint Powers Board fails to complete its review within the prescribed time period, unless an extension is agreed to by the member local governmental unit submitting the plan, the proposed plan shall be deemed approved.
Local Water Management Plan. After the adoption of a new or revised watershed management plan, each Member and any other local government unit within the Area shall review its local water management plan for changes needed for it to be consistent with the new or revised Watershed Management Plan. Each local water management plan shall include:
1) a description of the existing and proposed land uses;
2) a definition of drainage areas, including the volumes, rates and paths of stormwater runoff;
3) identification of areas and elevations for stormwater storage;
4) a description of water quality efforts which may be needed to implement the plan; and
5) an implementation program including official land use and developmental controls and a capital improvement program if needed. The Board shall within sixty (60) days approve or disapprove the plan or parts thereof.
