Common use of Lower Wage Rates Clause in Contracts

Lower Wage Rates. When the College temporarily assigns an employee to the duties and responsibilities of a position in a payband with a lower rate range or maximum salary where there is no work reasonably available for them in the position from which they were assigned, they shall be paid the lower applicable wage rate to which they were assigned after the expiration of ten (10) consecutive working days in such lower payband. When the College temporarily assigns an employee to the duties and responsibilities of a position in a payband with a lower rate range or maximum salary where there is work reasonably available for them in that position from which they were assigned, they shall continue to be paid at the rate applicable to the position from which they were assigned.

When the College temporarily assigns an employee a Regular Part-Time Employee to the duties and responsibilities of a position in a payband covered by this Agreement with a lower rate range or maximum salary wage rate, where there is no work reasonably available for them in the position from which they were assigned, they shall be paid the lower applicable wage rate to which they were assigned after the expiration of ten (10) consecutive working days in such lower paybandpaying position. When the College temporarily assigns an employee a Regular Part-Time Employee to the duties and responsibilities of a position in a payband covered by this Agreement with a lower wage rate range or maximum salary where there is work reasonably available for them in that regular part-time position from which they were assigned, they shall continue to be paid at the rate applicable to the position from which they were assigned.
