MAINTENANCE OF ELEVATORS IN TEMPORARY OPERATION. The Company shall have the unquestioned right to accept contracts from owners, contractors and others to provide maintenance on elevators during this period of their temporary operation. The Company, shall, as between the Company and the Union, have the exclusive right to provide such maintenance. The selection and assignment of Employees to maintenance on such elevators and the control of such work shall be solely with the discretion of the Company. Employees assigned to such work shall be paid at the rate of pay for construction workers established by this contract during the period of temporary operation i.e. while the car is operated by an elevator constructor or operating engineer or until the final certificate of occupancy for the building is issued or until the car is accepted by the customer, whichever occurs first. All overtime hours will be paid for at double time for all work after the regular eight (8) hour workday, Monday to Friday, 8 AM to 5 PM. However, such Employee(s) shall be paid at the rate of pay for Service Work no later than six (6) months after the final certificate (or until the car is accepted by the customer) on the car is issued by the appropriate governing agency.
