Maintenance of Network Elements. If (a) ECI reports to Verizon a Customer trouble, (b) ECI requests a dispatch, (c) Verizon dispatches a technician, and (d) such trouble was not caused by Verizon’s facilities or equipment in whole or in part, then ECI shall pay Verizon a charge set forth in the Pricing Attachment for time associated with said dispatch. In addition, this charge also applies when the Customer contact as designated by ECI is not available at the appointed time. ECI accepts responsibility for initial trouble isolation and providing Verizon with appropriate dispatch information based on its test results. If, as the result of ECI instructions, Verizon is erroneously requested to dispatch to a site on Verizon company premises (“dispatch in”), a charge set forth in the Pricing Attachment will be assessed per occurrence to ECI by Verizon. If as the result of ECI instructions, Verizon is erroneously requested to dispatch to a site outside of Verizon company premises ("dispatch out"), a charge set forth in the Pricing Attachment will be assessed per occurrence to ECI by Verizon. Maintenance of Network Elements. If (a) a Party (“Reporting Party”) reports to the other Party (“Responding Party”) a Customer trouble, (b) the Reporting Party requests a dispatch, (c) the Responding Party dispatches a technician, and (d) such trouble was not caused by the Responding Party’s facilities or equipment in whole or in part, then the Reporting Party shall pay the Responding Party an Additional Labor Charge as provided in the Responding Party’s applicable retail or wholesale Tariff. In addition, this charge also applies when the Customer contact as designated by the Reporting Party is not available at the appointed time (made known to and accepted by the reporting Party in advance). The Reporting Party accepts responsibility for initial trouble isolation and providing the Responding Party with appropriate dispatch information based on its test results. If, as the result of the Reporting Party’s instructions, the Responding Party is erroneously requested to dispatch to a site on the Responding Party’s company premises (“dispatch in”), an Additional Labor Charge as provided in the Responding Party’s applicable retail or wholesale Tariff will be assessed on the Reporting Party by the Responding Party. If as the result of Reporting Party instructions, the Responding Party is erroneously requested to dispatch to a site outside of the Responding Party’s company premises ("dispatch out"), an Additional Labor Charge as provided in the Responding Party’s applicable retail or wholesale Tariff will be assessed on the Reporting Party by the Responding Party. A Responding Party agrees to respond to a Reporting Party’s trouble reports on a non-discriminatory basis consistent with the manner in which it provides service to its own retail Customers or to any other similarly situated Telecommunications Carrier.
