Maintenance of Personal Property. Tenant shall, at its sole cost and expense, during the Term, keep and maintain all the personal property including furniture, fixtures and equipment, in good working order, condition and repair, including, without limitation, all repairs, alterations, replacements and additions to the Premises required by law and/or as necessary to obtain and maintain licensing for the operation of the Premises as an RCFE and all Standard Furnishings located on the Premises at the commencement of the Term (as more particularly described on Exhibit AB@ and shown on the video referenced in Paragraph 11 above). Tenant shall have the right to install on the Premises any and all additional equipment and fixtures that Tenant desires to install thereon and which are necessary or convenient to Tenant's use of the Premises as permitted herein, without Landlord=s consent, provided that Tenant shall provide Landlord with a detailed description of all of such additional equipment (as well as any subsequent replacements thereto) so that such additional equipment may be distinguished from the Standard Furnishings to be surrendered by Tenant to Landlord upon the expiration or sooner termination of this Lease. All such additional property so installed by Tenant shall remain Tenant's property and, provided Tenant is not in default hereunder, may be removed by Tenant from the Premises. Tenant shall not remove any of the Standard Furnishings installed by Landlord and/or any replacements or substitutions therefor, or any part thereof, from the Premises, without the prior written consent of Landlord. As a part of Tenant=s maintenance obligations hereunder, Tenant shall purchase and replace, with substitutes of equal or higher quality, any worn out or broken items of Standard Furnishings throughout the Term at Tenant's sole cost and expense. Such items being replaced by Tenant, to the extent that they are in substitution for items originally provided by Landlord, shall immediately become the property of Landlord. Tenant agrees to periodically provide Landlord with a detailed list of all such replacements or substitutions, and upon written request from Landlord, to execute any and all documents necessary to fully evidence Landlord's ownership of all such personal property.

Maintenance of Personal Property. The Borrower and each Restricted Subsidiary will maintain all material personal property necessary to the conduct of its business in good working order and condition in accordance with the standards of a good operator in the open pit coal mining business, ordinary wear and tear excepted and from time to time make, or cause to be made, all needful and proper repairs, renewals, additions, improvements and replacements thereto necessary in order that the business carried on in connection therewith, if any, may be properly conducted at all times, except where the failure to do so would not reasonably be expected to result in a Material Adverse Effect.
Maintenance of Personal Property. Except as otherwise provided in Section 22.2 of the Operating Lease with respect to the right to sell Personal Property to the Operating Tenant, and subject to the conditions set forth in Section 5.1.20 hereof, Borrower shall own, lease or license Personal Property (other than the Inventory), and the Operating Tenant or Manager shall own Inventory, adequate to maintain and operate the Property as a hotel in accordance with the standards of this Agreement, the other Loan Documents, the Operating Lease, the Management Agreement, Replacement Management Agreement, the Franchise Agreement and any Replacement Franchise Agreement. Neither Borrower, the Operating Tenant nor Manager shall lease, license, encumber or enter into any other financing arrangements with respect to any of the Personal Property or Inventory, as the case may be, other than as may expressly be permitted hereunder or under the other Loan Documents.
Maintenance of Personal Property. Xxxxxx agrees that it will, at Xxxxxx’s own cost and expense, maintain, preserve and keep the Personal Property in good repair, working order and condition. Lessor will have no responsibility to maintain, or repair or to make improvements or additions to the Personal Property. If requested to do so by Lessor, Xxxxxx will enter into a maintenance contract for the Personal Property with Vendor.

Tenant shall also keep and maintain in good order, condition and repair (including any such replacement and restoration as is required for that purpose) any special equipment, fixtures or facilities (other than Landlord's Work) which special facilities shall include but not be limited to grease traps, located outside the Premises. Tenant shall store all trash and garbage in metal or other Health Department approved containers so as not to be visible or create a nuisance to guests, customers and business invitees in the Hotel, and so as not to create or permit any health or fire hazard, and arrange for the prompt and regular removal thereof. Landlord shall keep and maintain in good order, condition, and repair (including, except as otherwise provided in this Lease, any such replacement and restoration as is required for that purpose) those portions of the Premises constituting Landlord's Work, as well as the common areas of the Hotel in the vicinity of the Premises and cause all such areas to be in compliance with all governmental rules, regulations, ordinances, statutes and laws, and the orders and regulations of the National Board of Fire Underwriters, the Insurance Service Office, or any other body now or hereafter exercising similar functions, now or hereafter in effect.

Maintenance of Personal Property. Mortgagor shall cause the Improvements to be equipped with the Personal Property as, to the extent and in the manner, as shall be necessary, appropriate or required for the operation of the Premises. Except where appropriate replacements, free of superior liens, are promptly made of a value at least equal to the value of the Personal Property being removed, no Personal Property covered hereunder with a value of more than $10,000 shall be permanently removed from the Premises without the consent of Mortgagee, subject to the provisions of Section 7.18. The Personal Property so disposed of shall be promptly replaced by Personal Property of the same character and of at least equal usefulness and quality. Mortgagor shall not be required to replace any item of Personal Property which has become unnecessary or inappropriate for the operation or maintenance of the Premises. To the extent that the Tenant Lease requires that all or any of the foregoing obligations be performed by the tenant thereunder, Mortgagor shall be relieved of such obligations hereunder for so long as the Tenant Lease shall be in effect.
Maintenance of Personal Property. UDLP shall maintain Personal Property furnished by the LRA under this Sublease consistent with Paragraph 12 of the Lease and the Maintenance standards agreed to by the Navy, the LRA and UDLP. The LRA may, subject to Government Security Restrictions, inspect the Personal Property from time to time, upon reasonable notice to UDLP, to determine compliance with the foregoing. In the event that the Navy funds replacement of such Personal Property, or augmentation of such Personal Property, to maintain or improve the state of the art of operations, any such replacement or new Personal Property, will fall under this Sublease to the extent it is added to or falls under the Lease with the Navy, or is otherwise transferred to the LRA by the Navy. UDLP shall notify the LRA in advance in writing in the event UDLP seeks to have the Navy fund replacement of such Personal Property or the Augmentation of such Personal Property to maintain or improve the state of the art of operations by UDLP of the Personal Property. Equipment that is acquired by UDLP that is not such replacement or new Personal Property, as referenced in the preceding sentence, shall be the property of XXXX.
