Maintenance of Spectrums. As provided in Section 4.2 of this Agreement, each Party shall use commercially reasonable efforts to coordinate the use of the Shared Spectrums so as to prevent harmful interference to the Shared Spectrums and other radio frequencies. In order to achieve the optimal operating environment, minimize the potential for interference and allow for prompt corrective action in the event of interference, each Party agrees to: (i) use only FCC type-approved radio equipment, to maintain such equipment in good operating condition and within emissions specifications, and to operate such equipment in a manner consistent with the manufacturer’s specifications; (ii) cooperate fully and in good faith with any investigation or inquiry conducted by any Party, as a licensee, or the FCC; (iii) provide access to any System access points to enable the Parties to monitor County’s and/or the Participants’ use of the Shared Spectrums, including private remote access should that feature be available to County and/or the Participants on the System; and (iv) in the event of interference from or to a Party’s or Participants’ use of the System, or in the event the a Party or Parties conduct a random or periodic audit, to grant the such Party or Parties and their respective agents and employees, the right to enter and inspect all of the System infrastructure and associated equipment and towers.

The University will take measures to ensure that prudent construction practices are followed, but there may be noise, dust and temporary interruption of some services. Residents may be required to temporarily or permanently relocate to facilitate construction or renovation to their residence area. There will be no compensation or reduction to your residence fees due to disruption and/or relocation.

  • Installation and Maintenance Except for the bi‐directional and production metering equipment owned by the City, all equipment on Customer’s side of the delivery point, including the required disconnect device, shall be provided and maintained in satisfactory operating condition by Customer and shall remain the property and responsibility of the Customer.
