MANAGEMENT FUNCTIONS. 3.01 The Union recognizes that the Employer has retained and shall possess and exercise all rights, functions, power, privileges and authority that it is possessed prior to the execution of this Collective Agreement except those that are expressly and specifically relinquished or restricted in this Collective Agreement. 3.02 The Employer retains the sole right to make, enforce, and alter from time- to-time reasonable rules and regulations to be observed by the employees, provided that such rules and regulations shall not be inconsistent with the provisions of this Collective Agreement. 3.03 The Employer shall not execute its management rights in such a way as to be in violation of the specific provisions of this Collective Agreement.
