Manager's Environmental Responsibilities. Manager hereby undertakes to respect all Environmental Laws and to comply with such environmental laws promptly at Manager's expense and to notify Owner immediately of any discharge and any presence on or outside the Premises of Hazardous Materials that may be in violation of environmental laws. Manager will also comply with all procedures established by Owner for the use, abatement, removal, storage, disposal or transport of any Hazardous Substances and any required or permitted alteration, repair, maintenance, restoration, removal or other work in or about the Premises or Stadium Facility that involves or affects any Hazardous Substances. Except for cleaning supplies and office products used in connection with Manager's business, no Hazardous Substances will be stored, used, released, produced, processed or disposed in, on or about, or transported to or from, the Premises or Stadium Facility by Manager or its sub respective agents, employees, contractors, subcontractors, licensees or invitees, without first obtaining Owner's express written consent (any Hazardous Substances which are stored, used, released, produced, processed or disposed in, on or about, or transported to or from, the Premises or Stadium Facility by any of such persons or entities are called "Manager's Hazardous Substances"). Manager is responsible for any damage of any kind or cause to the Premises or the Stadium Facility as a result of non-compliance with environmental laws. Without limiting the generality of the foregoing, Manager, at its expense, will take all action necessary to restore the Stadium Facility and Premises to the condition existing prior to the introduction of Manager's Hazardous Substances, whether such action is required by any governmental authority in order to comply with applicable Laws or by Owner in order for Owner to make the same economic use of the Stadium Facility and Premises as Owner could have made prior to the introduction of Manager's Hazardous Substances. Such action may include, without limitation, the investigation of the environmental condition of the Stadium Facility or Premises, the preparation of remediation plans or feasibility studies, and the performance of cleanup, remediation, removal or restoration work.   • Environmental Responsibility 44.1 GTE and DTI agree to comply with applicable federal, state and local environmental and safety laws and regulations including U.S. Environmental Protection Agency (EPA) regulations issued under the Clean Air Act, Clean Water Act, Resource Conservation and Recovery Act, Comprehensive Environmental Response, Compensation and Liability Act, Superfund Amendments and Reauthorization Act and the Toxic Substances Control Act and OSHA regulations issued under the Occupational Safety and Health Act of 1970. Each Party has the responsibility to notify the other if Compliance inspections occur and/or citations are issued that impact any aspect of this Agreement such as occurring on a LEC Facility or involving DTI potential employee exposure.

  • Spill Responsibility PURCHASER will be held responsible for any and all releases of environmental pollution during performance of the contract which occur as a result of, or are contributed by, actions of its agent, personnel, or subcontractors. PURCHASER agrees to promptly dispose of such spills or leaks to satisfaction of the STATE and proper regulatory agencies in a manner that complies with applicable federal, state, and local laws and regulations.
