Manner of Giving. A communication may be delivered by hand, sent by prepaid post or sent by facsimile transmission to the address of the party or parties to which it is being given and is deemed to have been received:
(a) if delivered by hand, upon delivery;
(b) if sent by post, 3 business days after posting; and
(c) if sent by facsimile transmission, on receipt by the sender of a confirmation report.
Manner of Giving. Each such communication shall be given (i) by registered or certified mail of the United States Postal Service, return receipt requested, postage prepaid, (ii) by overnight delivery service guaranteeing next business day delivery, or (iii) via telecopier or facsimile transmission to the facsimile number listed above; provided, however, that if such communication is given by telecopier or facsimile transmission, an original counterpart of such communication shall concurrently be sent in the manner specified in clause (ii) above.

Manner of Giving. Whenever under the provisions of the laws of the State of Delaware, the Certificate of Incorporation or these By-laws, notice is required to be given to any director or stockholder, it shall not be construed to mean personal notice, but such notice may be given by mailing or telegraphing (including telex or cable or other similar means) the same to each such director or stockholder at such address as appears on the books or in the records of the Corporation, and such notice shall be deemed to be given at the time when the same is thus mailed or telegraphed.

Zxxxxx, Sxxxxxx, Wxxxxxx & Shoulders 1000 Xxx National Bank Building Evansville, IN 47706 Either party may change such address for notice by notice given to the other party in the aforesaid manner.

Each such notice, demand, request or other communication shall be given (i) against a written receipt of delivery, (ii) by registered or certified mail of the United States Postal Service, return receipt requested, postage prepaid, or (iii) by a nationally recognized overnight courier service for next business day delivery, or (iv) delivered via telecopier or facsimile transmission to the facsimile number listed above, provided, however, that if such communication is given via telecopier or facsimile transmission, an original counterpart of such communication shall concurrently be sent in either the manner specified in clause (i) or (iii) above.
Manner of Giving. Xxxxx, Esq., or to such other post office address as the Commission may furnish to Lessee for such purpose. Notice to Lessee shall be mailed to Aventine Renewable Energy — Mt Xxxxxx, LLC, 0000 X. Xxxxxx Xxxxxx, Xxxxx, XX 00000 Attn: Xxxx Xxxxxxxxx, with copy to Aventine Renewable Energy, Inc., 0000 X. Xxxxxx, Esq., or to such other addresses as Lessee may furnish to the Commission for such purpose, and with copy to any Mortgagee who has given notice of its Mortgage pursuant to Section 7.02 at its address and with copy to its copy address furnished pursuant to Section 7.02, or to such other addresses as such Mortgagee may furnish to the Commission for such purpose. Notice by (a) personal delivery, (b) recognized overnight national courier service, or (c) registered or certified mail, is deemed to be received at the time notice is delivered to a party’s designated address. Confirmation by the courier delivering any notice given pursuant to this section shall be conclusive evidence of receipt of such notice. Each party hereto agrees that it will not refuse or reject delivery of any notice given hereunder, that it will acknowledge, in writing, receipt of the same upon request and that any notice rejected or refused by it shall be deemed for all purposes of this Lease to have been received by the rejecting party on the date so refused or rejected, as, conclusively established by the records of the U.S. Postal Service or the courier service. Any notice required to be given within a stated period of time which is sent by certified or registered mail, return receipt requested, shall be considered timely if postmarked before midnight of the last day of such period.

Manner of Giving. Any notice given under this Agreement must be in writing and must be sent to:
(a) the address for the recipient specified in this Agreement; or
(b) any other address which has been notified by the recipient to the sender as the recipient’s updated address for the purposes of this Agreement.
