Should the Contract and manufacturer’s instructions conflict, Design Build Contractor shall report conflict to City Engineer for resolution prior to proceeding with the affected portions of the Work. to City Engineer, if required by City Engineer for review the Shop Drawings, Product Data, and Samples, which are required by the Contract Documents. Review by City Engineer is subject to limitations of Section 4.1.4. Design Build Contractor shall transmit the submittals to the City Engineer with reasonable promptness and in a sequence, so as to cause no delay in the Work or in activities of City or of separate Contractors. Design Build Contractor shall transmit submittals in time to allow a minimum of fourteen (14) days for City Engineer’s review prior to date Design Build Contractor needs reviewed submittals returned. This time may be shortened for a particular job requirement if approved by City Engineer in advance of submittal.

If there is any conflict between Contractor’s Plans and Specifications and any manufacturer’s specifications, it is the responsibility of Subcontractor to bring such discrepancy to Contractor’s attention in writing. Subcontractor’s further work without first resolving such conflict shall be at its own risk. Any deviation from the manufacturer’s specifications, the Plans and Specifications, and the Contract Documents may, at Contractor’s discretion, result in Subcontractor replacing all materials to comply with such specifications and requirements at no cost to Contractor.
