MATERIALS FURNISHED BY THE CONTRACTOR. All materials used in the work shall meet the requirements of the respective specifications, and no material shall be used until it has been approved by the Engineer. All materials not otherwise specifically indicated shall be furnished by the contractor.

MATERIALS FURNISHED BY THE CONTRACTOR. Unless otherwise specified, all materials and equipment incorporated in the Work under the Contract shall be new. All work shall be accomplished by persons qualified in the respective trades.
MATERIALS FURNISHED BY THE CONTRACTOR. The Contractor shall be required to furnish all materials and supplies necessary for the satisfactory completion of the contract, except such items as are specified in Section 1.
MATERIALS FURNISHED BY THE CONTRACTOR. It is hereby agreed by the Subcontractor, if furnishing labor only for the finishing, installation or erection of materials furnished by the Contractor, that the following costs, without restriction, are to be fully recovered by the Contractor from the Subcontractor: (a) the full cost of material required to replace due to damage by the Subcontractor; (b) the full cost of removing rejected materials when not properly installed or supplied by the Subcontractor; (c) the full cost of altering any Work of the Subcontractor not accepted by the Owner’s authorized agent; and (d) the full cost of all additional supervision required by the Contractor including all labor, equipment, material and associated overhead costs.
MATERIALS FURNISHED BY THE CONTRACTOR. All materials used in the work including equipment shall be new and unused materials of a reputable North American Manufacturer conforming to the applicable requirements of the Specifications, and no materials shall be used in the work until they have been approved by the Engineer. If North American-made materials are not available, such material may not be used in the work without prior approval by the Owner or its duly authorized Engineer. The Contractor shall furnish all materials necessary except as otherwise specifically noted or specified.
MATERIALS FURNISHED BY THE CONTRACTOR. The cost of hauling, storing, processing, handling and caring for all materials and supplies furnished by the Contractor shall be included in the prices bid in the Unit Price Table. Materials used in the work shall meet the requirements of the specifications, or where not detailed in the specifications, shall be to the Engineer's satisfaction. All materials shall be new, unless otherwise specified. Schedules of piping, fittings or other materials indicating quantity and/or dimensions, which are shown on the drawings or in the applicable sections of the specifications, are intended only to assist the Contractor in quantity takeoff. Quantities and dimensions shown therein are not guaranteed to be accurate and shall be checked by the Contractor prior to placing an order for such materials. All materials provided by the Contractor shall vest in and become the property of the Owner as soon as the same are delivered to the site of the works, but shall remain in the custody and at the risk of the Contractor.

  • Subcontractor Any vendor, subcontractor or other Person that is not responsible for the overall servicing (as “servicing” is commonly understood by participants in the mortgage-backed securities market) of Mortgage Loans but performs one or more discrete functions identified in Item 1122(d) of Regulation AB with respect to Mortgage Loans under the direction or authority of the Servicer or a Subservicer.

  • Materials and Supplies The cost of materials and supplies is allowable. Purchases should be charged at their actual prices after deducting all cash discounts, trade discounts, rebates, and allowances received. Withdrawals from general stores or stockrooms should be charged at cost under any recognized method of pricing, consistently applied. Incoming transportation charges are a proper part of materials and supply costs.

  • Solicitations for Subcontracts, Including Procurement of Materials and Equipment In all solicitations either by competitive bidding or negotiation made by the Local Government for work to be performed under a subcontract, including procurement of materials or leases of equipment, each potential subcontractor or supplier will be notified by the Local Government of the Local Government’s obligations under this Agreement and the Acts and Regulations relative to Nondiscrimination on the grounds of race, color, or national origin.

  • CERTIFICATION OF NO ASBESTOS CONTAINING MATERIALS OR WORK 8.1 The Contractor shall be responsible for ensuring that no asbestos containing materials or work is included within the scope of the Work. The Contractor shall take whatever measures it deems necessary to insure that all employees, suppliers, fabricators, material men, subcontractors, or their assigns, comply with this requirement. 8.2 The Contractor shall ensure that Texas Department of Health licensed individuals, consultants or companies are used for any required asbestos work including asbestos inspection, asbestos abatement plans/specifications, asbestos abatement, asbestos project management and third-party asbestos monitoring.

  • Contractor If COUNTY elects to renegotiate this Agreement due to reduced or terminated 20 funding, CONTRACTOR shall not be obligated to accept the renegotiated terms.

  • Supplying Information Each Seller shall deliver or provide access to such records, documents, information and data to the applicable Purchaser as such Purchaser may reasonably request in order to properly and efficiently perform its obligations hereunder; provided, however, that the Sellers shall not be required to deliver or provide access to any records, documents, information or data that (a) relates to a part of the business of the Seller Group that is not being serviced by the Purchasers pursuant to this Agreement, (b) in the Sellers’ reasonable determination could violate applicable Law, or could result in the loss or waiver of any attorney-client, work product or similar legal privilege or (c) in the Sellers’ reasonable determination could violate any contractual obligation of the Seller Group with respect to confidentiality; provided, however, the Sellers and the Purchasers shall cooperate in good faith to put in place appropriate substitute disclosure arrangements, including, in the case of clause (a), by separating or redacting the portion of the information that relates to a part of the business of the Seller Group that is not being serviced by the Purchasers pursuant to this Agreement and, in the case of clauses (b) and (c), by using commercially reasonable efforts to obtain the consent of such third party to such access.

  • Subcontractors The Contractor will not subcontract any work under the Contract without prior written consent of the Department. The Contractor is fully responsible for satisfactory completion of all its subcontracted work. The Department supports diversity in its procurements and contracts, and requests that the Contractor offer subcontracting opportunities to certified woman-, veteran-, and minority-owned small businesses. The Contractor may contact the OSD at xxxxxxx@xxx.xxxxxxxxx.xxx for information on certified small business enterprises available for subcontracting opportunities.

  • Supplier A manufacturer, fabricator, distributor, supplier, or vendor of goods or equipment in connection with the Work, or any other party having a Contract or Purchase Order with the Contractor or with a Subcontractor to furnish materials or equipment to be incorporated in the Work by the Contractor or a Subcontractor.

  • Materials and Equipment ‌ Material means property that may be consumed or expended during performance, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Equipment means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for performance. Materials and Equipment shall be priced in accordance with the terms of the task order award, contract type, and applicable FAR and agency-specific regulatory supplements. Unless otherwise directed by task order terms and conditions, the Contractor may apply indirect costs to materials and equipment consistent with the Contractor’s usual accounting practices.
