Mediators. Any mediation required under this agreement shall be conducted by an experienced attorney or judicial office in Arapahoe County, Colorado, who is mutually agreeable to the parties. In the event the parties cannot agree on a mediator, each party will select a mediator and the two mediators will select a third mediator who is not associated or affiliated with either mediator; the third mediator shall act as mediator in the dispute or claim. Mediation will proceed under all policies and procedures of the mediator. The fees associated with mediation will be divided 50/50 between CCAI and the Adoptive Family.
Mediators. The rules set out in this Code of Conduct as applying to Members or former Members apply, mutatis mutandis, to mediators.

Mediators. If, after completion of the categorization process in Section III, an Eligible Claimant and Xxxxxx cannot reach an agreement on categorization and award amount, the Eligible Claimant and Xxxxxx must participate in a mandatory mediation with the assistance of the mediators listed below. All parties may participate in mediation by counsel.

Mediators. Mediators from RESOLVE will design work session agendas and conduct the meetings. The mediators will remain impartial – not favoring any particular outcome. The mediators are responsible to the whole group and not to one member or interest. RESOLVE will distribute draft meeting summaries and provide an opportunity for the group to review and finalize each summary. Final summaries will be made available to the public. The group will work with the lead transportation agencies (Minnesota Department of Transportation and Wisconsin Department of Transportation) to hold public meetings that satisfy NEPA, WEPA and MEPA public involvement requirements and the public involvement requirements of other laws and regulations. These include scoping meetings; meetings to discuss alternatives prior to selection of a preferred alternative and the Draft Supplemental Environmental Impact Statement (XXXX); public meetings to present and take feedback about the preferred alternative; and a formal public hearing on the XXXX. The group may advise the agencies to conduct additional public involvement.
