Common use of Military Leave for Active Duty Clause in Contracts

Military Leave for Active Duty. An employee who is required to serve on active duty in the armed forces of the United States or state militia must be granted leave without pay for the period the employee is required to remain in the military service. The employee is entitled to reinstatement to the former position or one of comparable status upon separation from the armed forces, provided application for reinstatement is made within 90 days from date of separation.

An A full-time or part-time employee who is required to serve on active duty in the armed forces of the United States or a state militia must be granted leave without pay for the period the employee is required to remain in the military service. The employee is entitled to reinstatement to the former position or one of comparable status upon separation from the armed forces, provided application for reinstatement is made within 90 days from the date of separation. Under certain circumstances employees may be eligible for administrative leave while performing military service, as provided in Article 19.l(g) of this Agreement. Employees will be granted all rights and privileges under USERRA for any qualifying military leave for active duty.
