MISUSING THE SERVICE. 8.1. The Customer acknowledges that it is strictly forbidden to use the service: 8.1.1. To make offensive, indecent, menacing, nuisance or hoax Calls; 8.1.2. Fraudulently, or in connection with a criminal offence. 8.2. The Customer agrees to take all reasonable steps to make sure that this does not happen. The action Midpoint Communications can take if this happens is explained in paragraph 11. If a claim is made against BT and/or Midpoint Communications because the Service is misused in this way, the Customer must reimburse Midpoint Communications in respect of any sums Midpoint Communications is obliged to pay. 8.3. The Customer accepts that it is not permitted to advertise the phone number for the Service in, or on, a BT phone box without BT's consent. If this happens, Midpoint Communications may suspend the Service or end this Contract, but Midpoint Communications and/or BT will write to the Customer before taking this action.

MISUSING THE SERVICE. 6.1 Nobody must use the Service: (a) to make offensive, indecent, menacing, nuisance or hoax Calls; (b) fraudulently or in connection with a criminal offence; (c) to send, knowingly receive, upload, download, or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy or any other rights; (d) to cause annoyance, inconvenience or needless anxiety; (e) to spam or to send or provide unsolicited advertising or promotional material or, knowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party; (f) in any way which in HBT Communications opinion is, or is likely to be, detrimental to the provision of the service to the Customer or any of HBT Communications other customers; (g) in an unlawful manner, in contravention of any legislation,laws,license or third party rights or in contravention of HBT Communications acceptable use policies as may be amended from time to time, or (h) in a way that does not comply with any instructions HBT Communications has given to the Customer. The Customer agrees to take all reasonable steps to make sure that this does not happen. If a claim is made against HBT Communications because the Service is misused in any way, the Customer must reimburse HBT Communications in respect of any sums HBT Communications is obliged to pay.

The action the Supplier can take if this happens is explained in condition 10 (breach). If a claim is made against the Supplier because the Service is misused in this way, the Customer must reimburse the Supplier in respect of any sums the Supplier is obliged to pay.

If a claim is made against Chrome Telecom Ltd because the Service is misused in this way, the Customer must reimburse Chrome Telecom Ltd in respect of any sums Chrome Telecom Ltd is obliged to pay.

MISUSING THE SERVICE. 3.1. The Customer must not use the Internet Service: 3.1.1. In a way that does not comply with the terms of any legislation or any license applicable to the Customer or that is in any way unlawful or fraudulent or has any unlawful or fraudulent purpose or effect. 3.1.2. In connection with the carrying out of a fraud or criminal offence against the Company, or any other public telecommunications operator; 3.1.3. To send, knowingly receive, upload, download, use or re-use any material which is abusive, indecent, defamatory, obscene or menacing, or in breach of any copyright, confidence, privacy or any other rights. 3.1.4. To send or procure the sending of any unsolicited advertising or promotional material other than in the case of the Customer to its own customers; 3.1.5. In any way that does not comply with any instructions the Company or the service provider has given. 3.1.6. In any way that in the Company’s reasonable opinion could materially affect the quality of any service, including the Service, provided by The Company or the service provider. 3.1.7. In a way that in the Company’s reasonable opinion could affect the experience of other users on the network. By way of specific example, heavy download users may affect the performance of the network. For the avoidance of doubt, heavy download users affecting the performance of the network may be asked to upgrade their products. 3.2. The Company will be entitled to suspend the Internet Service or terminate the Contract (without any liability to the Company) where the Company has reasonable grounds to believe the Customer is in breach of any provision. 3.3. The Customer acknowledges and accepts the following technical limits relating to the Internet Service: 3.3.1. Transmission performance of some metallic local loops will mean it is technically impracticable to provide Internet Service to all Customers within the Internet Service Availability Area. 3.3.2. The Internet Service is not available to Premises where all or part of the Access Connection is provided over fibre optic cable or radio systems. 3.3.3. That the Internet Service may also affect the performance of some PSTN customer premises equipment. 3.3.4. That some technical service effects and limitations may not become apparent until after the service has been installed and working for some time. MISUSING THE SERVICE. 9.1 The Customer shall not use or utilise or allow the use or utilisation of the Service for: 9.1.1 Persistently sending messages causing any threat, harassment, annoyance, inconvenience or needless, anxiety to any person whosoever. 9.1.2 To spam or to send or provide unsolicited advertising or promotional material or, knowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party. 9.1.3 Gaining or attempting to gain access to any computer systems connected to the Internet or to any private information or resources without the written approval of the owners or holders of the rights to such systems, information or resources. 9.1.4 Infringing any copyright or other intellectual property rights to any information or resources or posting any copyright material to any newsgroup, forum or mailing list without the explicit permission of the copyright holder. 9.1.5 Any criminal or unlawful purpose, such as but not limited to: vice, gambling or obscenity or for carrying out any activity which is contrary to the social, cultural, political, economic or religious values of the UAE. 9.1.6 Any purpose that is contrary to or conflicting with such regulatory rules or policies as is issued by Etisalat or other competent authority from time to time. 9.1.7 Posting or transmitting any message that is libelous, defamatory or which discloses private or personal matters concerning any person. The Customer shall not post or transmit any message, data, image or programme which is indecent, obscene or pornographic. 9.1.8 Posting or transmitting any message that is harmful, threatening, abusive or hateful. Etisalat reserves the right to take such action as it deems appropriate in cases where the Service is used to disseminate statements that are deeply and widely offensive and/or harmful. 9.2 The Customer agrees to take all reasonable steps to make sure that this does not happen. Violation to the above shall trigger legal remedies as well as disconnection of the Service and / or termination of the Agreement.

If this happens, Bluecherry Telecom may suspend the Service or end this Contract, but Bluecherry Telecom and/or BT will write to the Customer before taking this action.
