Multi-Center Publication. The Parties, recognizing the importance of communicating clinical trial results to the public and to the scientific communities in an accurate and complete manner, intend for the first Publication of the Study to include the results from all of the study centers and to appear in a peer-reviewed scientific journal, in accordance with the Protocol. Without the prior written agreement of the Sponsor, the Institution shall not Publish or submit for Publication, directly or indirectly, any Manuscript prior to the publication of an article in a peer-reviewed scientific journal summarizing the data generated by all of the study centers, unless no such article is so published before the first anniversary of the finalization of the multi-center database, in which case the Institution may publish the results generated by Institution or submit for Publication a Manuscript without further delay (subject to Article 5 and the other Sections of this Article 6).

Multi-Center Publication. Institution and Principal Investigator agree that they shall not, without Sponsor’s prior written consent, independently publish any results of the Clinical Trial or information pertaining to Institution’s and Principal Investigator’s activities conducted under this Agreement until the earlier of: (a) the release of the multi-center publication and (b) twelve months after the completion of the clinical trial of the Product at all clinical trial sites (including the receipt by Sponsor of all data sets and the resolution of all queries related thereto)..
Multi-Center Publication. The Institution agrees that Sponsor shall have the right to the first publication of the results of the Study. Sponsor shall serve as the coordinator of multi-center study disclosures, in those specific instances where the first publication is intended to be a joint, multi-center publication of the results of the entire multi-center study made by Sponsor in conjunction with the investigators’ and institutions’ contributing data, analysis and comments, as appropriate. Any publication(s) resulting from the Study shall give appropriate credit to the scientific contributions made by Sponsor personnel. For such publication(s), authorship or acknowledgement of investigators will be determined based primarily on scientific contribution to protocol development and data interpretation and secondarily on patient enrollment. All authors must meet authorship criteria as outlined by the International Committee of Medical Journal Editors.

  • PUBLICATION AND PUBLICITY The CONSULTANT agrees that it shall not for any reason whatsoever communicate to any third party in any manner whatsoever concerning any of its CONTRACT work product, its conduct under the CONTRACT, the results or data gathered or processed under this CONTRACT, which includes, but is not limited to, reports, computer information and access, drawings, studies, notes, maps and other data prepared by and for the CONSULTANT under the terms of this CONTRACT, without prior written approval from the COMMISSION, unless such release or disclosure is required by judicial proceeding. The CONSULTANT agrees that it shall immediately refer any third party who requests such information to the COMMISSION and shall also report to the COMMISSION any such third party inquiry. This Article shall not apply to information in whatever form that comes into the public domain, nor shall it restrict the CONSULTANT from giving notices required by law or complying with an order to provide information or data when such order is issued by a court, administrative agency or other authority with proper jurisdiction, or if it is reasonably necessary for the CONSULTANT to defend itself from any suit or claim. All approved releases of information, findings, and recommendations shall include a disclaimer provision and all published reports shall include that disclaimer on the cover and title page in the following form: The opinions, findings, and conclusions in this publication are those of the author(s) and not necessarily those of the Mississippi Department of Transportation, Mississippi Transportation Commission, the State of Mississippi or the Federal Highway Administration.

  • Publications All published material and written reports submitted under the Contract must be originally developed material unless otherwise specifically provided in the Contract. When material not originally developed is included in a report in any form, the source shall be identified.

  • MPS LOGO/PUBLICITY No Contractor shall use the MPS Logo in its literature or issue a press release about the subject of this Contract without prior written notice to and written approval of MPS’s Executive Director of Communications & Outreach.
