NETWORK DEPLOYMENT. Throughout the term of this Agreement, the quality of the technology, equipment, facilities, processes and techniques (including, without limitation, such new architecture, equipment, facilities, and interfaces as PACIFIC may deploy) that PACIFIC provides to CLEC under this Agreement must be at least equal in quality to that provided by PACIFIC to itself.
NETWORK DEPLOYMENT. (a) Metricom will deploy the network infrastructure necessary to provide the Service substantially in accordance with the Deployment Schedule; provided that the Deployment Schedule will be adjusted on a day-for-day basis for any delay in the Closing Date under the Purchase Agreement beyond September 1, 1999. (b) If the Deployment Schedule is delayed or Metricom's actual deployment of the network infrastructure necessary to provide the Service occurs more slowly than called for by the Deployment Schedule, the parties will work together in good faith to modify MCI WorldCom's Guaranteed Subscribers accordingly; provided that if such delay exceeds twelve (12) months, Section 5.2 will terminate and be of no further effect and MCI WorldCom shall have the option to terminate this Agreement under Section 8.3. (c) To the extent reasonably requested by Metricom, MCI WorldCom will provide confirmation to Metricom's potential equipment and services vendors of MCI WorldCom's commitment to the guaranteed volume of MCI WorldCom Subscribers and to the Deployment Schedule. -------------------- * Confidential Treatment Requested (d) Metricom will use its best efforts to locate its wireless access points ("WAPs") at locations where MCI WorldCom owns fiber network facilities consistent with Metricom's provision of services at a level consistent with Schedule 4.1. A list of such facilities is provided under Schedule 4.5, which list may be amended by MCI WorldCom from time to time.

NETWORK DEPLOYMENT. 1.1 GTE shall complete on a timely basis AT&T's orders for Network Elements and Combinations and for services that GTE is required to offer to AT&T pursuant to this Agreement in all its serving areas from and after the Effective Date of this Agreement. To the extent sections contained in this Attachment set forth technical references, technical standards, technical requirements, and/or performance standards, GTE’s obligation to comply with such references, requirements, and/or standards shall be subject to Section 23.19 of the General Terms and Conditions of this Agreement. 1.2 Throughout the term of this Agreement, the quality of the technology, equipment, facilities, processes, and techniques (including, without limitation, such new architecture, equipment, facilities, and interfaces as GTE may deploy) that GTE provides to AT&T under this Agreement must be at least equal in quality to that provided by GTE to itself.
NETWORK DEPLOYMENT. (A) Metricom will deploy the network infrastructure necessary to provide the Service substantially in accordance with its Market Launch Schedule. (B) If the Market Launch Schedule is delayed or Metricom's actual deployment of the network infrastructure necessary to provide the Service occurs more slowly than called for by the Market Launch Schedule and if such delay exceeds [**], the ASP shall have the option to terminate this Agreement under SECTION 8.
NETWORK DEPLOYMENT. GlobeTel shall use all commercially reasonably endeavors to deploy and build wireless networks using its know-how in 30 cities located in the Russian Federation (as further described herein, the "Project"). The wireless network is expected to be generally in keeping with the description contained in Schedule 2.1.1, with appropriate adjustments. The 30 cities are tentatively identified on Schedule 2.1.2 (the "Project Cities") along with the publicly reported population of each city. The cities shall be divided into 3 groups (each, a "City Group"). *** The list of Project Cities on Schedule 2.1.2 is tentative and preliminary, and the parties shall in good faith consider deployment in other Russian cities.

  • Network Upgrades The Transmission Owner shall design, procure, construct, install, and own the Network Upgrades described in Attachment 6 of this Agreement. If the Transmission Owner and the Interconnection Customer agree, the Interconnection Customer may construct Network Upgrades that are located on land owned by the Interconnection Customer. Unless the Transmission Owner elects to pay for Network Upgrades, the actual cost of the Network Upgrades, including overheads, shall be borne initially by the Interconnection Customer.

  • Network PHARMACY is a retail, mail order or specialty pharmacy that has a contract to accept our pharmacy allowance for prescription drugs and diabetic equipment or supplies covered under this plan. NETWORK PROVIDER is a provider that has entered into a contract with us or other Blue Cross and Blue Shield plans. For pediatric dental care services, network provider is a dentist that has entered into a contract with us or participates in the Dental Coast to Coast Network. For pediatric vision hardware services, a network provider is a provider that has entered into a contract with EyeMed, our vision care service manager.

  • Network Services Preventive care: 100% coverage. Preventive services include, but are not restricted to routine physical exams, routine gynecological exams, routine hearing exams, routine eye exams, and immunizations. A $100 single and $200 family combined annual deductible will apply to lab/diagnostic testing after which 100% coverage will apply. A $50 copay will apply to CT and MRI scans.

  • Network Interconnection Architecture Each Party will plan, design, construct and maintain the facilities within their respective systems as are necessary and proper for the provision of traffic covered by this Agreement. These facilities include but are not limited to, a sufficient number of trunks to the point of interconnection with the tandem company, and sufficient interoffice and interexchange facilities and trunks between its own central offices to adequately handle traffic between all central offices within the service areas at a P.01 grade of service or better. The provisioning and engineering of such services and facilities will comply with generally accepted industry methods and practices, and will observe the rules and regulations of the lawfully established tariffs applicable to the services provided.

  • Network Access During its performance of this Contract, Contractor may be granted access to Purchaser’s computer and telecommunication networks (“Networks”). As a condition of Network use, Contractor shall: (a) use the Networks in compliance with all applicable laws, rules, and regulations; (b) use software, protocols, and procedures as directed by Purchaser to access and use the Networks; (c) only access Network locations made available to Contractor by Purchaser; (d) not interfere with or disrupt other users of the Networks;

  • Connectivity User is solely responsible for providing and maintaining all necessary electronic communications with Exchange, including, wiring, computer hardware, software, communication line access, and networking devices.

  • Availability of Verizon Telecommunications Services 3.1 Verizon will provide a Verizon Telecommunications Service to Reconex for resale pursuant to this Attachment where and to the same extent, but only where and to the same extent, that such Verizon Telecommunications Service is provided to Verizon’s Customers. 3.2 Except as otherwise required by Applicable Law, subject to Section 3.1, Verizon shall have the right to add, modify, grandfather, discontinue or withdraw, Verizon Telecommunications Services at any time, without the consent of Reconex. 3.3 To the extent required by Applicable Law, the Verizon Telecommunications Services to be provided to Reconex for resale pursuant to this Attachment will include a Verizon Telecommunications Service customer-specific contract service arrangement (“CSA”) (such as a customer specific pricing arrangement or individual case based pricing arrangement) that Verizon is providing to a Verizon Customer at the time the CSA is requested by Reconex.

  • Network Management 56.1 CLEC and CenturyLink will exchange appropriate information (e.g., network information, maintenance contact numbers, escalation procedures, and information required to comply with requirements of law enforcement and national security agencies) for network management purposes. In addition, the Parties will apply sound network management principles to alleviate or to prevent traffic congestion and to minimize fraud associated with third number billed calls, calling card calls, and other services related to this Agreement. 56.2 The Parties will employ characteristics and methods of operation that will not interfere with or impair the Parties’ networks, or the network of any third parties or Affiliated companies, connected with or involved directly in the network or facilities of CenturyLink. 56.3 CLEC shall not interfere with or impair service over any circuits, facilities or equipment of CenturyLink, its Affiliated companies, or its connecting and concurring carriers. 56.4 If CLEC causes any impairment or interference, CenturyLink shall promptly notify CLEC of the nature and location of the problem and that, unless promptly rectified, a temporary discontinuance of the use of any circuit, facility or equipment may be required. The Parties agree to work together to attempt to promptly resolve the impairment or interference. If CLEC is unable to promptly remedy, then CenturyLink may, at its option, temporarily discontinue the use of the affected circuit, facility or equipment until the impairment is remedied. 56.5 Any violation of Applicable Law or regulation regarding the invasion of privacy of any communications carried over CenturyLink’s facilities, or that creates hazards to the employees of CenturyLink or to the public, is also considered an impairment of service. 56.6 CenturyLink shall give advanced notice to CLEC of all non-scheduled maintenance or other planned network activities to be performed by CenturyLink on any Network Element, including any hardware, equipment, software, or system, providing service functionality of which CLEC has advised CenturyLink may potentially impact CLEC End Users. 56.7 The Parties shall provide notice of network changes and upgrades in accordance with 47 C.F.R. §§51.325 through 51.335. CenturyLink may discontinue any Interconnection arrangement, Telecommunications Service, or Network Element provided or required hereunder due to network changes or upgrades after providing CLEC notice as required by this Section. CenturyLink agrees to cooperate with CLEC and/or the appropriate regulatory body in any transition resulting from such discontinuation of service and to minimize the impact to customers which may result from such discontinuance of service.

  • Bandwidth the amount of data (quantified as “Mbps” or “Gbps”) made available to Customer as specified in a Service Order.

  • Infrastructure Vulnerability Scanning Supplier will scan its internal environments (e.g., servers, network devices, etc.) related to Deliverables monthly and external environments related to Deliverables weekly. Supplier will have a defined process to address any findings but will ensure that any high-risk vulnerabilities are addressed within 30 days.
