Nonduplication. Corporation assistance may not be used to duplicate an activity that is already available in the locality of a program. And, unless the requirements of paragraph (f) of this section are met, Corporation assistance will not be provided to a private nonprofit entity to conduct activities that are the same or substantially equivalent to activities provided by a State or local government agency in which such entity resides.
Nonduplication. Payment of overtime rates shall not be duplicated for the same hours worked, but the higher of the applicable rates shall be used. Hours compensated for at overtime rates shall not be counted further for any purpose in determining overtime liability under the same or any other provisions, provided, however, that a holiday, whether worked or not, shall be counted for purposes of computing overtime liability under the provisions of Section 3-a- (3), (4) or (5) above and hours worked on a holiday shall be counted for purposes of computing overtime liability under the provisions of Section 3-a- (1) above.

Nothing in this Agreement shall require the Company to make any payment or to provide any benefit or service credit that GTE, the Company, or any affiliate of either of them (the "GTE Group") is required to provide with respect to the Executive under any other contract, agreement, policy, plan, or arrangement, including a separation policy or employment agreement ("Other Agreement"). In order to accomplish the foregoing, if the GTE Group is required, under any Other Agreement, to make any payment or to provide any benefit or service credit that also is required to be made or to be provided under this Agreement, the payment, benefit, or service credit required by this Agreement shall be reduced by the payment, benefit, or service credit that the GTE Group is required to make or to provide with respect to the Executive under the Other Agreement.

Nonduplication. (a) Nothing in this Agreement shall require the Company to make any payment or to provide any benefit or service credit that GTE or the Company is otherwise required to provide under any other contract, agreement, policy, plan, or arrangement.

Therefore, in the event you are entitled to any similar payments under the terms of any other plan, program, agreement, or arrangement of the Company, your payments under this Agreement will be correspondingly reduced.
Nonduplication. Notwithstanding any other provisions of this Agreement, if Executive becomes entitled to benefits under Article III of the CIC Agreement, the severance benefits described in Article III(a) of the CIC Agreement shall be in lieu of any termination allowance to which Executive is otherwise entitled under Section 2 of this Agreement or any retirement allowance to which Executive is otherwise entitled under Section 4(b) of this Agreement. Except as otherwise specifically provided in this Section 18, both this Agreement and the CIC Agreement shall continue in full force and effect, and Article X(e) of the CIC Agreement shall be interpreted consistently herewith.
Nonduplication. No provision of this Program shall require the Company to provide the Participant with any payment, benefit, or grant that duplicates any payment, benefit, or grant that the Participant is entitled to receive under any Company compensation or benefit plan, award agreement, or other arrangement. SPECIAL RETENTION ACCOUNT AND OTHER BENEFITS PROGRAM ADDENDUM A ADDITIONAL PAYMENTS BY THE COMPANY A Participant in the Program shall be entitled to a tax gross-up payment in accordance with the following provisions:
(a) Gross-Up Payment. If any payment or benefit received or to be received by the Participant from the Company pursuant to the Plan (the "Payments") would be subject to the excise tax (the "Excise Tax") imposed by section 4999 of the Code as determined in accordance with this Addendum A, the Company shall pay the Participant, at the time specified below, an additional amount (the "Gross-Up Payment") such that the net amount that the Participant retains, after deduction of the Excise Tax on the Payments and any federal, state, and local income tax and the Excise Tax upon the Gross-Up Payment, and any interest, penalties, or additions to tax payable by the Participant with respect thereto, shall be equal to the total present value (using the applicable federal rate (as defined in section 1274(d) of the Code) in such calculation) of the Payments at the time such Payments are to be made.
Nonduplication. Nothing in this Section 6.10 shall cause duplicate contributions or benefits to be paid to or with respect to any employee.
