Novelties. Nothing contained in this Agreement shall be construed to limit the City from selling or authorizing a third party to sell Novelties or Souvenirs at City Events, provided that the City will not at any time sell or authorize the sale of Food and Beverage Concessions by parties other than Hardball nor can it sell baseball themed novelties. The City shall solely retain all revenue from the sale of its own Novelties and Souvenirs at the Venue during City Events. Any such sales by the City shall be from temporary displays. The City will not be entitled to sell merchandise out of the Team Store(s), and the Team Store(s) will only be open at City Events upon the mutual agreement of the Parties. Notwithstanding the forgoing, or anything else herein to the contrary, Hardball shall retain all revenue from the sale of all baseball-themed, Club-related or league-related Novelties and Souvenirs at all Venue Events and from all sales of any type from the Team Stores. To the extent permitted by law, the City shall not provide vendor licenses allowing the sale of food and beverage or of baseball themed novelties on the sidewalks in a distance of 1,000 feet from the Venue structure immediately prior to, after and during Hardball Events.

To the extent permitted by law, the City shall not provide vendor licenses allowing the sale of food and beverage or of baseball novelties on a temporary basis on the sidewalks in a distance of 250 feet from the Stadium structure shown on Exhibit “A” during any Licensee Event, without advanced approval from Licensee.
Novelties. Novelty items sold at VENUE are subject to the appropriate State of Iowa sales tax, plus the following commissions to the VENUE: 10% on electronic/recorded media and 20% on soft goods if Artist/Lessee sells or 25% if VENUE sells. This would include all material originating from VENUE for resale to the general public; such as commemorative photographs and/or videos. Novelties. The Parties acknowledge and agree that event-related novelties (such as, without limitation, T-shirts and hats) are not concession items. All proceeds from the sale of the Partnership's, the Yankees', the Affiliates, or any other novelties shall at all times belong to the Partnership, regardless of who sponsors the event giving rise to the sale. The Partnership may sell Partnership's, Yankees' or Affiliates' novelties on the Premises, but not on the Himes Facility during events held at Tampa Stadium or its parking areas.
