Platba bude uhrazena pouze za ty pacienty účastnící se klinického hodnocení, kteří splňují všechna příslušná kritéria pro přijetí, zařazení a vyloučení dle protokolu. Jakákoli následná opakovaná podání nebo obnovení budou na základě schválení zadavatelem vyplacena po obdržení příslušné dokumentace. Celková výše plateb dle tohoto článku nepřekročí limit uvedený v Příloze A.

The total payments hereunder will not exceed the limit indicated in Exhibit A. Expected maximum amount of the total payment under this Agreement is approximately CZK 786.443.

Platby stanovené v těchto rozpočtových formuláších jsou pšíslušnými stranami považovány za pšiměšenou odměnu za práci provedenou danou stranou. Platby ze strany Zadavatele za služby poskytnuté Poskytovatelem a Hlavním zkoušejícím na základě této Smlouvy (i) pšedstavují pšiměšenou tržní hodnotu za takové služby, (ii) byly sjednány jako transakce v běžných obchodních vztazích a (iii) nebyly určeny zpnsobem, který zohledňuje objem nebo hodnotu jakýchkoliv doporučení nebo jakkoliv jinak generovanou obchodní spolupráci mezi stranami. Za vykonanou práci nebo vynaložené výdaje, za xxx xx Zadavatel povinen provést platbu, nebude Poskytovatel a Hlavní zkoušející požadovat z jakéhokoliv zdroje dodatečnou úhradu. . Payments shall be made to the bank account of the Institution set out above in this Agreement together with the variable symbol allocated for this Study. The payments and remunerations listed in the budget for the Study (Exhibit B) are all unique and the exclusive financial settlement between the contractual parties.
B. The Sponsor and Principal Investigator declare that, during the employment relationship between Principal Investigator and the Institution, they do not conclude among themselves any legal relationship regardless of whether it relates to this Study without Institution approval. The Contractual Parties hereby declare that there is no conflict of interests, whether of monetary or non-monetary nature, which would prevent them from the proper realization of the clinical trial in accordance with the applicable legal regulations and regulatory requirements (particularly as regards good clinical practice).
Náklady a platby. As consideration for performance of the Study under the terms of this Agreement, Sponsor shall pay the Provider on a per Subject basis as set forth in the Payment Schedule and Payment Rule Form which is attached herein as Exhibit A (hereinafter the “PRF”). Sponsor is entitled to claim the applicable tax credits on any eligible amounts paid by Sponsor to the Provider/Investigator.
