Obligations Regarding Scope of Development. 6.1.1. The Owner shall perform its obligations with respect to the development of the Public Improvements in strict accordance with this Agreement and in accordance with 6.1.2. Owner hereby agrees that if this Agreement is terminated by City under Section 7.2 for reason of Owner’s Event of Default, Owner waives, to the maximum legal extent, any rights it may have as a good faith improver of real property, including, without limitation, any rights pursuant to Code of Civil Procedure Sections 871.1 through 871.5, inclusive, Code of Civil Procedure Section 741, or all other state or federal statutes or judicial decisions of similar effect. With regard only to the matters being released herein, Owner waives the provisions of Section 1542 of the California Civil Code, and any other similar statute, rule or case law. Owner has read and understands Section 1542, and has consulted with counsel regarding its terms. Section 1542 provides as follows: “A general release does not extend to claims that the creditor or releasing party does not know or expect to exist in his or her favor at the time of executing a release and that, if known by him or her would have materially affected the settlement with the debtor or released party.”

Evaluate Scope Statement to develop a preliminary cost estimate and determinate whether project be vendor bid or be executed under a Job Order Contract (JOC).

  • Commencement of Development 5.3.1 In the event that development on the Lands has not commenced within five (5) years from the date of registration of this Agreement at the Registry of Deeds or Land Registry Office, as indicated herein, the Agreement shall have no further force or effect and henceforth the development of the Lands shall conform with the provisions of the Land Use By-law. For the purpose of this section, commencement of development shall mean issuance of a Mobile Home Park Construction Permit. 5.3.2 For the purpose of this section, Council may consider granting an extension of the commencement of development time period through a resolution under Section 4.1 of this Agreement, if the Municipality receives a written request from the Developer at least sixty (60) calendar days prior to the expiry of the commencement of development time period.

  • Procurement Planning Prior to the issuance of any invitations to bid for contracts, the proposed procurement plan for the Project shall be furnished to the Association for its review and approval, in accordance with the provisions of paragraph 1 of Appendix 1 to the Guidelines. Procurement of all goods and works shall be undertaken in accordance with such procurement plan as shall have been approved by the Association, and with the provisions of said paragraph 1.

  • Project Documentation All documentation provided to the City other than Project drawings shall be furnished on a Microsoft compatible compact disc.
