Observation of the Unit. Ten-day Period: The Utility may conduct on-site verifications of the Unit and observe the execution of verification testing within a reasonable period of time, not exceeding ten (10) business days after system installation. The applicant’s facility will be allowed to commence parallel operation upon satisfactory completion of the verification test. The applicant must have complied with and must continue to comply with all contractual and technical requirements.

Observation of the Unit. Fourteen-day Period: The Company may conduct on-site verifications of the Unit and observe the performance of verification testing within a reasonable period of time, not exceeding fourteen days, after receiving a written request from the Customer to begin producing energy in parallel with the Company’s system. The Company may accept or reject the request, consistent with the SIR, based upon the verification test results.
Observation of the Unit. Post-Fourteen-day Period: If the Company does not perform an on-site verification of the Unit and observe the performance of verification testing within the fourteen-day period, the Customer may begin to produce energy after certifying to the Company that the Unit has been tested in accordance with the verification testing requirements of the SIR and has successfully completed such tests. After receiving the certification, the Company may conduct an on-site verification of the Unit and make reasonable inquiries of the Customer, but only for purposes of determining whether the verification tests were properly performed. The Customer shall not be required to perform the verification tests a second time, unless irregularities appear in the verification test report or there are other objective indications that the tests were not properly performed in the first instance.

  • SUSPENSION OF THE WORK 1. The State, at any time, may suspend all or any part of the services of the Engineer. In such event, the Engineer shall be given notice of such suspension in writing by registered or certified mail to the Engineer's address as furnished to the State for purposes of receiving notices under this contract, by email to the Engineer’s email address as furnished to the State for the purpose of notices, by facsimile transmission telecopy (fax) to the Engineer’s fax number as furnished to the State for the purpose of notices, or by hand delivery.

  • Inspection of Services Subcontractor shall make the Services accessible at all reasonable times for inspection by the Contractor. Subcontractor shall, at the first opportunity, inspect all material and equipment delivered to the job site by others to be used or incorporated in the Subcontractor’s Services and give prompt notice of any defect therein. Subcontractor assumes full responsibility to protect the work done hereunder until final acceptance by the Contractor or any authorized third (3rd) party.

  • Completion of the Work The Contractor must obtain Material Completion as defined in Section 6.1.2 below prior to any occupancy of the Project.

  • Evaluation of Tenders 33.1 The Procuring Entity shall use the criteria and methodologies listed in this ITT and Section III, Evaluation and Qualification criteria. No other evaluation criteria or methodologies shall be permitted. By applying the criteria and methodologies, the Procuring Entity shall determine the Lowest Evaluated Tender. This is the Tender of the Tenderer that meets the qualification criteria and whose Tender has been determined to be:

  • CONSTRUCTION OF THE PROJECT The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment/ Plot and accepted the floor plan, payment plan and the specification, amenities and facilities annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the bye-laws, FAR, and density norms and provisions prescribed by the relevant building bye-laws and shall not have an option to make any variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of this Agreement.
