Common use of Open Observation Clause in Contracts

Open Observation. 1. All monitoring or observation of the work of a teacher shall be conducted openly and with full knowledge of the teacher. The use of eavesdropping, closed circuit television, public address or audio systems, and similar surveillance devices shall be strictly prohibited unless agreed to by both parties. 2. Video cameras will not be used to monitor, observe, or investigate bargaining unit member behavior, evaluate work performance, or be used as a cause to discipline members. Video recordings will be erased, deleted, or recycled every 30 calendar days unless the recording is required for a student disciplinary hearing. Video recordings will not be released to third parties without first notifying the Association and every bargaining unit member who appears on the recording and providing him/her the opportunity to view the recording and to receive a copy of the recording being released to a third party. The Association shall have the right to review any video recording and shall be furnished a copy of any video recording upon request.
