Common use of Open Positions Clause in Contracts

Open Positions. In the event that a bargaining unit position which has been posted and no bids have been received from an Association employee, is filled with a substitute in excess of forty (40) working days, the position will be considered filled with a qualified substitute. The employee shall then be subject to all provisions regarding new employees. The start date of the forty (40) working days will begin after the posting has closed and it has been determined that no Association employee has bid on the position.
