Opera. An up-front payment will be made to each Musician in the amount of 5.5% of weekly scale or 35% of per-service performance scale, whichever is applicable, subject, in either circumstance, to a minimum up-front payment of $85.72 per Musician. The up-front payment shall cover a recording containing 130 minutes of music or less (whether the orchestra plays in the pit or on stage). For every 16 additional minutes or portion thereof, an additional payment shall be made that is 1/8 of the original up-front payment. The up-front payment entitles the Employer to produce and sell 15,000 units.
Opera. Opera television programs shall be paid at the applicable per-minute rate for up to two hours of program, and thereafter shall be paid at 75% of the applicable per- minute rate.
Opera. Rates for opera broadcasts shall be subject to local negotiation, but in no case shall be lower than a floor of $91.08 per broadcast during the first year of the agreement (increasing thereafter to the amounts specified in Exhibit F).
Opera. The following discounts from symphonic rates apply to the recording of operatic works by opera orchestras other than as provided in (13) above:
(a) 15% if 3, 4 or 5 sessions are called.
(b) 20% if 6 or more sessions are called.
Opera. Except where otherwise indicated, the terms and conditions of Article E2 (“MINIMUM RATES FOR PERFORMERS - REMOTE PICKUPS”) will apply to Operas recorded under this agreement. In addition, the following terms and conditions will also apply: • Opera performer definitions based on “AGMA Schedule C”. • Payment for Opera will be as per Rate Schedule 3 (“REMOTE RATES - OPERA”) as follows:
Opera. SDUK will shortly be issuing a similar contract for freelance Assistants and Staff Directors in opera.
Opera. 2.3. Customers need to sign up with the various platforms in their own right and agree to the terms and conditions for each platform, which will constitute an agreement between the customer and the platform provider.
2.4. The Socializa bundles Promotion Offer will be available to all new and existing Cell C Prepaid, Hybrid and Postpaid customers.
2.5. The Socializa bundles Promotion Offer will be available for purchase exclusively through the *147# USSD menu, Cell C App and Cell C Portal.
Opera. 5.3. All standard usage on an applicable platform will deplete from the applicable bundle.
5.3.1. Please note that using Instagram live will not deplete from the Instagram bundle, as further outlined in 5.5 below.
5.4. Usage outside the Socializa platform apps and websites and usage when a Socializa bundle has been depleted will be depleted from any other available data bundle OR will be billed for as usage as per the tariff plan the customer is on.
5.5. Using Instagram live will not deplete from the Instagram bundle and will deplete from any available data bundle or will incur additional data charges as per the customer’s tariff plan.
5.6. Usage can be through the mobile applications and / or web browser of the applicable social media or streaming media platform.
5.7. The inclusive Socializa data is exclusively for use within South Africa. International roaming usage will not deplete from a Socializa bundle and usage will be charged for as per the roaming rate of the country and network.
5.8. The inclusive data cannot be converted into Rand value.
Opera the agreement, i.e., 1 hour of payment for each 10 minutes of finished product (15 minutes for opera).
(1) In advance of the location recording, the record company shall identify in writing the works intended to be recorded and included in the final product. The Company may later change any work that has not been recorded without penalty, and it may also add additional material to the planned disc at a later date without penalty. The Company is responsible for any additional payments if the additional work changes the length of the final product in such a way that an additional payment would be due.
(2) For the first such work recorded musicians shall receive a payment equivalent to 3 hours of session time, as it does in the case when a single work comprises the disc.
(3) For each subsequent work recorded musicians shall receive a payment equivalent to 2 hours of session time, provided however that the maximum amount of the payment shall not exceed the payment that would be due under the location recording provisions of the Sound Recording Labor Agreement as determined by the length of the planned final disc (1 session hour for each 10 minutes of finished product – 15 minutes in the case of operas – with half- hour increments; thus, for example, a 55 minute disc would be equate to 5.5 hours computed at straight time rates). Once the maximum payment has been reached, no further payments are due the musicians for material recorded.
(4) In the case of a recording which also includes material not performed by the orchestra, the musicians will be paid only for that amount of material which constitutes their performance on the disc.
(5) Non-playing Members of the orchestra receive 2/3 of whatever payment is received by playing members. If they play in some pieces but not others, they receive a 3 hour payment for the first piece in which they play, a 2 hour payment for any subsequent piece in which they play, and 2/3 of the appropriate payment for any pieces in which they do not play. However, in no case shall they receive an amount greater than that due a member who played on the entire disc.
(6) Extra players and substitutes who play in only some of the works involved are paid only for those works in which they perform. They are paid 3 hours for the first work in which they perform, and 2 hours for any additional work in which they perform. 45.1 Payment in accordance with clauses 43 and 44 gives DR the broadcasting rights to the production in accordance with clause 45. DR has the broadcasting right in a 30-day broadcasting period from the first broadcast. The first broadcast is defined as the first of the kinds of broadcasts specified in sub-clause 2 below. In addition, DR has the right to 6 broadcasts including simulcasting within a 12-month period from the first broadcast on DR's specialised channels.
45.2 The broadcasting right covers – but is not limited to – the following uses: DR's public presentation – alone or in cooperation with others – of the production in whole or in part. Public presentation is defined as broadcasting or other public presentation, such as wireless terrestrial or satellite distribution, primary cable distribution, simulcasting (simultaneous and identical internet transmission), webcasting (independent internet transmission) and similar presentation forms. Making the production in whole or in part available on demand on all platforms, i.e. making the production available to the public independent of time and place. However, the broadcasting right do not cover making the production available in accordance with sub-clause 4 below.
45.3 With regard to radio broadcasts of operas, DR can for each broadcast choose whether the broadcast payment is to secure DR broadcast periods in accordance with sub-clause 1 above or 4 broadcasts within a 4-year period. In connection with each broadcast, DR obtains the right to make the material available on demand in streaming format in a 30-day period. DR may exchange 1 of the 4 broadcasts for 6 broadcasts within a 12-month period on specialised channels.
