Operating ReportThe Company shall deliver to each of the Holders within 30 days after the end of each full quarter occurring after the Closing Date, a summary operating report with respect to the Project, which shall include, with respect to the period most recently ended (a) a monthly and year-to-date numerical and narrative assessment of (i) the Project’s compliance with each material category in the then-current Annual Operating Budget, (ii) electrical production, capacity, availability and delivery, including any reports delivered under the MESPA and MOMA, (iii) fuel use, including heat rate, (iv) plant and unit availability, (v) distributions to Pledgor, debt service payments and balances in the Accounts, (vi) Hot Box Replacements, (vii) material unresolved disputes with contractors, materialmen, suppliers or others and any related claims against the Company and (viii) warranty claims under the MESPA or MOMA; and (b) to the extent applicable, a comparison of year-to-date figures to corresponding figures provided in the prior year. Operating ReportDeliver to Lender within 30 days of the end of each month, summary operating reports, substantially in the form of Exhibit D-1 attached hereto with respect to each Project Company, and substantially in the form of Exhibit D-2 attached hereto with respect to the Borrower and its Subsidiaries, taken as a whole, each of which shall include, as soon as practicable, but in any event commencing with the first summary operating report required to be delivered six months after the Original Closing Date (in which case each of Exhibit D-1 and Exhibit D-2 shall be revised accordingly in a manner reasonably satisfactory to the Lender), the calculations underlying such report in a Microsoft Excel spreadsheet format, information as to under-performance of any Project, payments in respect of the Production Guarantees, identification of any Projects with delinquent payments for periods of greater than each of 30 days, 60 days, 90 days, 120 days, 180 days and 240 days, and the percentages of the remaining contract balance for such Projects.

Operating ReportDeliver to Administrative Agent within 26 days of the end of each month after Commercial Operation, a summary operating report with respect to the Project, which shall include, with respect to the period most recently ended, (i) a monthly and year-to-date numerical and brief narrative assessment of (A) the Project’s compliance with each material category in the then-current Annual Operating Budget, (B) electrical production, capacity, availability and delivery, (C) plant and unit availability, including trips and scheduled and unscheduled outages, (D) maintenance activity, (E) replacement of material equipment, (F) transactions involving the provision of electrical products from sources other than the Project, if any, and (G) material unresolved disputes with contractors, materialmen, suppliers or others and any related claims against Borrower, if any; and (ii) to the extent applicable, a comparison of year-to-date figures to corresponding figures provided in the prior year.

Operating ReportThe Consultant will prepare two semi-annual LFGCS Operating Reports. These reports will comply with regulatory requirements outlined in 40 CFR 63.1980(a), 60.767(g), and 60.768(c)(1)(i). The Consultant will maintain compliance with New Source Performance Standards (NSPS) Subpart XXX and Subpart WWW reporting as applicable. The Consultant will use the EPA’s Electronic Reporting Tool (ERT) for submittal of the report. Operational data will be provided by City Staff, as needed and requested, for the completion of the two semi-annual reports.
Operating Report no later than forty five (45) days after the end of each Interest Payment Date to the Global Agent.
Operating Report. The Dealer will furnish to the Company a complete operating report covering its operations on a calendar year-to-date basis. This operating report: o will be due by the 15th of each month o must be submitted either on Company-provided forms or over the Company-approved Dealer Communication System, as the Company shall elect.

Operating Report. No later than 30 days after the end of each Fiscal Quarter, an operating report substantially in the form of Schedule 4.1(d), duly completed and executed by the Chief Financial Officer of the Company, which shall contain (i) all cell and switch sites constructed, all cell and switch sites put in service and all fibre nodes put in service during the Fiscal Quarter covered by such report, (ii) the number of new Subscribers acquired during such Fiscal Quarter, (iii) the total number of Subscribers as of the end of such Fiscal Quarter and churn during such Fiscal Quarter, (iv) Total Lines in service as of the end of such Fiscal Quarter, (v) the average age of receivables for such Fiscal Quarter, (vi) the average monthly bill (xx Dollars) per Subscriber Segment (split between activation fees and monthly billing fees) during such Fiscal Quarter and (vii) minutes of use (MOUs) per Subscriber Segment during such Fiscal Quarter, and including a comparison of actual results with respect to items (i) through (vii) for and as of the end of the relevant periods to the most recent budget delivered pursuant to Section 2.1(b) or Section 4.1(e); Common Terms Agreement 53 64
