Other Crafts. If the Employer employs employees who are covered by a collective bargaining agreement while performing work on a project with employees covered by this Addendum, employees working under this Addendum shall be paid at the highest collectively bargained rate (excluding foremen and superintendents) applicable to the employees working on the same project as employees working under this Addendum. All payments over the scale negotiated in this Addendum payable under this Section shall be added to the employees’ gross taxable rate.

  • Assessment and Understanding It is capable of assessing the merits of and understanding (on its own behalf or through independent professional advice), and understands and accepts, the terms, conditions and risks of that Transaction. It is also capable of assuming, and assumes, the risks of that Transaction.

  • Final Agreement This Agreement terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only by a further writing that is duly executed by both parties.

  • Law, Venue 19.1. This Agreement has been executed and delivered in the State of California and the validity, enforceability and interpretation of any of the clauses of this Agreement shall be determined and governed by the laws of the State of California.

  • Jury or Witness Leave The Employer shall grant Leave of Absence without loss of seniority to an Employee who is required to serve as a juror or who is subpoenaed to serve as a witness in Court. The Employer shall pay such an Employee their normal earnings. The payment they receive for service as a juror or as a witness, excluding payment for travel, meals, or other expenses, will be returned to the Employer. The Employee will present proof of service to the Employer, along with copies of payment for services they receive as a juror or as a witness.

  • Jury or Court Witness Duty The Employer shall grant leave of absence without loss of seniority to an employee who is called as a juror or witness in any court. The Employer shall pay such an employee the difference between the normal earnings and the payment received for jury service or court witness, excluding payment for travelling, meals, or other expenses. The employee will present proof of service and the amount of pay received.

  • Entire Understanding This Amendment sets forth the entire understanding of the parties with respect to the matters set forth herein, and shall supersede any prior negotiations or agreements, whether written or oral, with respect thereto.

  • Compliance with this Agreement The Purchaser shall have performed and complied with all of its agreements and conditions set forth or contemplated herein that are required to be performed or complied with by the Purchaser on or before the Closing Date.

  • Resolution of Grievances In the event of a grievance related to a matter of discipline or any dispute as to the interpretation, application or observance of the provisions of this Agreement other than discipline, it shall be handled in the following manner:

  • Jury or Witness Duty An employee who is not a party to the action and who is absent in compliance with a summons for jury duty or a subpoena requiring the employee to appear in court as a witness shall be excused with pay for the period during which the employee is absent on scheduled days because of such jury service or court appearance. When an employee is excused from jury or witness duty for part of a day or for an entire day, the employee shall report to his or her supervisor in person or by telephone for an assignment.
