Jury or Witness Leave. Leave without loss of pay shall be granted to a Long-Term Occasional Teacher to serve as a juror or to respond to a subpoena as a witness in any proceedings to which the Long-Term Occasional Teacher is not a party or one of the persons charged, provided that the Long-Term Occasional Teacher pays to the Employer any fee, exclusive of traveling and living expenses, that the teacher receives as a juror or as a witness.
Jury or Witness Leave. The Employer shall grant Leave of Absence without loss of seniority to an Employee who is required to serve as a juror or who is subpoenaed to serve as a witness in Court. The Employer shall pay such an Employee their normal earnings. The payment they receive for service as a juror or as a witness, excluding payment for travel, meals, or other expenses, will be returned to the Employer. The Employee will present proof of service to the Employer, along with copies of payment for services they receive as a juror or as a witness.
Jury or Witness Leave. Leave without loss of pay and not chargeable to sick leave shall be granted to a Teacher to serve as a juror or to respond to a subpoena as a witness in any proceedings to which the Teacher is not a party or one of the persons charged, provided that the Teacher pays to the Employer any fee, exclusive of travelling and living expenses, that the Teacher receives as a juror or as a witness.
Jury or Witness Leave. Any Member who is required to act as a juror or court witness in any proceeding to which the Member is not a party or one of the persons charged, will be granted the necessary leave of absence, without loss of pay, benefits or seniority, provided that the payment the Member receives from the court, exclusive of expenses, is turned over to the Board.
Jury or Witness Leave. The Employer shall grant leave of absence without loss of seniority to a nurse who is required to serve as a juror in any court of law, or is required by subpoena to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or coroner’s inquest in connection with a case arising from the nurse’s duties at AbleLiving Services Inc. The Employer shall pay the nurse the difference between her normal earnings and the payment she received for jury service or witness fees, excluding payment for travelling, meals, or other expenses. The nurse will present proof of service and the amount of pay received. The nurse must notify her supervisor within twenty-four (24) hours after receiving notice of selection or subpoena. This Article shall apply to the part-time nurse if she has been scheduled to work.
Jury or Witness Leave. Upon approval of the Superintendent, a covered employee who is subpoenaed as a witness in a civil or criminal case, or who is called for service on a jury, will be granted paid leave for the period of time he/she is unable to report to work for this reason. Application for the leave will be made in advance and submitted with a copy of the subpoena or notice of jury duty. The covered employee shall pay over to the Rochester School Board and City of Rochester any money paid for such witness or jury service except that portion of the money identified as personal expense, such as for travel.
Jury or Witness Leave. Leave of absence with pay shall be granted to an employee who is required to attend jury duty, or where an employee is summoned as a witness in a legal proceeding other than a legal proceeding occasioned by the employee’s private affairs. If an employee receives any fees or stipend for being a witness or juror, he shall give same to the Employer excluding any amount which is for reimbursement of expenses paid him for being a witness or juror.
Jury or Witness Leave. (a) An employee shall be granted leave of absence without loss of salary, benefits or seniority when subpoenaed to serve as a member of a jury or as a witness. Any remuneration awarded by the Court above actual expenses shall be repaid to the Employer up to the maximum of salary involved for the period of absence.
(b) If appearing as a witness for the Court of Queen’s Bench, the employee shall make application in accordance with "The Court of Queen's Bench Fees Regulations" for witness fees.
Jury or Witness Leave. The Board shall grant paid Leave of Absence without loss seniority to an Employee who is required by law to serve as a juror or appear as a witness in any court. The Employee will present proof of service.
