Overtime and Callback. 3.2.1 Overtime lists based on seniority shall be maintained by the captains for the rotational procurement of employees to fill vacancies and details when said employees are available. A. Opportunities for overtime shall be offered equally to all employees. A refusal of overtime counts as an opportunity. B. Every effort shall be made to fill vacancies with an employee of equal rank to the absent employee. If this is not possible, then an employee will be appointed to work out of grade. C. Each shift commander is responsible for daily updates of master personnel absentee records. D. The Chief will designate one Captain to be "Overtime Distribution Coordinator" and the other Shift Commanders will serve as backup. E. The Town shall not be responsible for any errors or omissions caused by Union personnel in carrying out the provisions of this section. F. When filling vacancies for a twenty-four (24) hour shift, the overtime shall be filled in ten (10) hour day shifts (08:00 to 18:00) and fourteen (14) hour night shifts (18:00 to 08:00). Employees shall not be scheduled to work more than forty-eight (48) consecutive hours. After 48 consecutive hours of work, there shall be a minimum 10- hour break before additional hours may be assigned or worked. This shall not include emergency coverage situations as determined by the Chief or his designee. 3.2.2 An employee held overtime beyond his/her regular tour of duty shall be granted a minimum of two (2) hours overtime pay, and any overtime worked in excess of two (2) hours shall be compensated for the next full hour, and so on. An employee who is held beyond the end of an overtime shift that is less than ten (10) hours shall be compensated overtime pay to the next full hour, and any overtime worked in excess of the first hour shall be compensated for the next full hour, and so on. An employee who is held beyond an overtime shift that is ten (10) or more hours shall be granted a minimum of two (2) hours overtime pay, and any overtime worked in excess of two (2) hours shall be compensated for the next full hour, and so on. An employee called back to duty shall be compensated at an overtime rate of pay hereinafter set forth for at least four (4) hours, even if the overtime actually worked is less than four (4) hours. Such an employee shall be released when the situation initiating his overtime or call-back is returned to normal. Any overtime worked in excess of four (4) hours shall be compensated for to the next full hour, and so on. The Chief or the Chief’s designee shall approve all scheduled non-shift overtime. An employee serving such duty shall be available for emergencies during the time period that he/she is being scheduled. If an employee has not yet completed his/her assignment at the point he/she is called for an emergency, no additional 4 hour minimum call- back period will be generated. 3.2.3 The hourly rate of overtime pay shall be equal to time and one-half (1 and 1/2) the employee's hourly rate of pay. 3.2.4 The Town and the Union, hereby agree to those modifications which will provide compliance with the Fair Labor Standards Act (Revised) which became effective April 15, 1986. It is understood that the Union will be advised of any such changes prior to implementation and will be afforded an opportunity to discuss such changes. 3.2.5 An employee who is recalled to work from 12:00 midnight to 12:00 midnight on January 1, Thanksgiving, and December 25, shall receive double time for time worked as long as the holiday is not part of his/her regular Work Day. This section will not apply if an employee is recalled because of vacation or personal leave use. 3.2.6 If any employee is required, due to a job-related incident, to participate in any legal process (e.g. court appearance, deposition, etc.) during his/her off-duty hours, said employee shall be compensated at the overtime rate. If said employee is scheduled to work during the time of the appearance, the employee will be excused from work and coverage will be provided with no loss of pay or benefits to the employee. Mileage and out of pocket expenses will be reimbursed by the Town. 3.2.7 Employees will be compensated at the overtime rate for training which is required to maintain certification as an Emergency Medical Technician and is not done on duty. 3.2.8 Payment for extra paid details, Town or private, shall be at the employee's overtime rate, and shall be forthcoming in a timely manner no different than any other overtime.

(e) during his/her Overtime shall be scheduled by the Shift Commander at Headquarters' station. Overtime shall be scheduled in accordance with the overtime policy as established by the membership of Local 1381. Any changes to the Overtime Policy shall be mutually agreed upon by Local 1381 and the fire administration. All employees in the Fire Prevention Division shall be in a rotating schedule of being on call for the purpose of fire investigation. The rotation shall be on a weekly basis (00:00 hours on Monday to 24:00 hours on Sunday). Compensation will be provided to the assigned employee in the form of six (6) hours straight time per week. This is predicated on the employee's availability throughout the assigned week, (i.e., if the employee is available for six (6) days then the employee is unavailable the seventh (7th) day, the employee forfeits the six (6) hours regardless of the hours completed in the "on- call" status that week.) Those weeks where a holiday falls, employees shall be entitled to five (5) additional hours per recognized holiday. Call-in less than one-half (1/2) hour before the start of their shift shall be considered scheduled overtime, otherwise there shall be a three (3) hour overtime minimum for responding to fire investigation. (f) Pay for Court Time Employees who as a result of their employment within Clinton Township or while performing mutual aid duties are required to give testimony in Court while off-duty hours, said employee relevant to their activities or observations shall be compensated at the overtime rate. If said employee is scheduled to work during the time of the appearance, the employee will be excused from work and coverage will be provided with no loss of pay or benefits to the employee. Mileage and out of pocket expenses will be reimbursed by the Town. 3.2.7 Employees will be compensated paid at the overtime rate of one and one-half (1-1/2) times their base hourly rate for training which all hours spent on such assignments with a minimum of three (3) hours for each appearance. Employees cannot receive more than one and one-half (1-1/2) times their base hourly rate even if their appearance is required to maintain certification as an Emergency Medical Technician and on a holiday or the employee is not done on duty. 3.2.8 Payment vacation. (g) Staff Employee Compensatory Time (1) Compensatory time shall be accumulated as follows: a. No more than eighty (80) hours of compensatory time will be allowed on the books at any given time. c. No more than a total of one-hundred twenty (120) hours are to be taken in any contract year. d. When filling vacancies for a twenty-four (24) hour shift, the overtime shall be filled in ten (10) hour day shifts (08:00 to 18:00) and fourteen (14) hour night shifts (18:00 to 08:00). Employees shall not be scheduled to work more than forty-eight (48) consecutive hours. After 48 consecutive hours of work, there shall be a minimum 10- hour break before additional hours may be assigned or worked. This shall not include emergency coverage situations as determined by the Chief or his designee. 3.2.2 An employee held overtime beyond his/her regular tour of duty shall be granted a minimum of two (2) hours overtime pay, and any overtime worked in excess of two (2) hours shall be compensated for the next full hour, and so on. An employee who is held beyond the end of an overtime shift that is less than ten (10) hours shall be compensated overtime pay to the next full hour, and any overtime worked in excess of the first hour shall be compensated for the next full hour, and so on. An employee who is held beyond an overtime shift that is ten (10) or more hours shall be granted a minimum of two (2) hours overtime pay, and any overtime worked in excess of two (2) hours shall be compensated for the next full hour, and so on. An employee called back to duty shall be compensated at an overtime rate of pay hereinafter set forth for at least four (4) hours, even if the overtime actually worked is less than four (4) hours. Such an employee shall be released when the situation initiating his overtime or call-back is returned to normal. Any overtime worked in excess of four (4) hours shall be compensated for to the next full hour, and so on. The Chief or the Chief’s designee shall approve all scheduled non-shift overtime. An employee serving such duty shall be available for emergencies during the time period that he/she is being scheduled. If an employee has not yet completed his/her assignment at the point he/she is called for an emergency, no additional 4 hour minimum call- back period will be generated. 3.2.3 The hourly rate of overtime pay shall be equal to time and one-half (1 and 1-1/2) for a minimum of three (3) hours. In the event an employee is required to work beyond three (3) hours on one call, the rate of time and one-half (1-1/2) shall prevail for the remaining hours or any part thereof worked. On-duty employees who are required to work beyond 0800 hours to fill out reports shall be paid at the rate of time and one-half (1-1/2) of the employee's hourly rate of payregular wage rate. 3.2.4 (b) The Town call shall start from the time the employee is contacted and responds affirmatively until the equipment is back in service. Upon discretion of the officer in charge with relief the employee may be sent home and the Unioncall terminated. (c) Time and one-half (1-1/2) shall be paid for every hour worked in excess of the regular work schedule set forth in Article II of this Agreement. (d) When calling in additional employees for Emergency Callback, hereby agree the Township shall create and maintain an emergency callback list using the center of the Township (Xxxxxxxxxx and Xxxxxxxxx), to those modifications determine the distance, by internet map programs (i.e., Yahoo Maps, Mapquest, etc.), that each employee lives from the center of the Township and the order in which will provide compliance with they shall be called in by the Fair Labor Standards Act person on "watch". The Township shall also create and maintain a second (Revised2nd) list, that shall be used when the need arises for an extra dispatcher(s) to be hired for Emergency Callback position(s) in the "watch room." This distance, as determined by internet map programs (i.e., Yahoo Maps, Mapquest, etc.), shall determine which became effective April 15, 1986employees live closest to Fire Headquarters and the order that they shall be called for this position. It is understood shall be the responsibility of each employee to notify the fire department administration and the Union Executive Board when the Employee has an address change so that the Union Executive Board can determine the distance from the two locations as described in the above paragraphs. (e) Overtime shall be scheduled by the Shift Commander at Headquarters station. Overtime shall be scheduled in accordance with the overtime policy as established by the membership of Local 1381. Any changes to the Overtime Policy shall be mutually agreed upon by Local 1381 and the fire administration. All employees in the Fire Prevention Division shall be in a rotating schedule of being on call for the purpose of fire investigation. The rotation shall be on a weekly basis (00:00 hours on Monday to 24:00 hours on Sunday). Compensation will be advised provided to the assigned employee in the form of any such changes prior to implementation and will be afforded an opportunity to discuss such changes. 3.2.5 An employee who is recalled to work from 12:00 midnight to 12:00 midnight on January 1, Thanksgiving, and December 25, shall receive double six (6) hours straight time for time worked as long as the holiday is not part of his/her regular Work Dayper week. This section will not apply is predicated on the employee's availability throughout the assigned week, (i.e., if an the employee is recalled because of vacation or personal leave use. 3.2.6 If any available for six (6) days then the employee is required, due to a job-related incident, to participate in any legal process unavailable the seventh (e.g. court appearance, deposition, etc.7th) during his/her off-duty hours, said employee shall be compensated at the overtime rate. If said employee is scheduled to work during the time of the appearanceday, the employee will forfeits the six (6) hours regardless of the hours completed in the "on- call" status that week.) Those weeks where a holiday falls, employees shall be excused from work and coverage will entitled to five (5) additional hours per recognized holiday. Call-in less than one-half (1/2) hour before the start of their shift shall be provided with no loss of pay or benefits considered scheduled overtime, otherwise there shall be a three (3) hour overtime minimum for responding to the employee. Mileage and out of pocket expenses will be reimbursed by the Townfire investigation. 3.2.7 (f) Pay for Court Time Employees will required to testify in Court on non-duty days as a result of their employment within Clinton Township or while performing mutual aid duties shall be compensated paid at the overtime rate of one and one-half (1-1/2) times their base hourly rate for training which all hours spent on such assignments with a minimum of three (3) hours for each appearance. In the event an employee is required to maintain certification as an Emergency Medical Technician testify beyond three (3) hours, the rate of one and one-half (11/2) pay shall prevail for the remaining hours or any part thereof. Employees cannot receive more than one and one-half (1-1/2) times their base hourly rate even if their appearance is not done on duty. 3.2.8 Payment a holiday or the employee is on vacation. Any fees applicable for extra paid detailsCourt appearances, Town or privateexcept for mileage, shall be assigned to the Township. (g) Staff Employee Compensatory Time (1) Compensatory time shall be accumulated as follows: a. Compensatory time shall be accumulated at the rate of one and one-half (1-1/2) hours for each hour of overtime worked. b. No more than eighty (80) hours of compensatory time will be allowed on the books at any given time. c. No more than a total of one-hundred twenty (120) hours are to be taken in any contract year. d. The eighty (80) and one-hundred twenty (120) hours respectively are for each individual. (2) Compensatory time shall be used as follows: a. Compensatory time is to be used only when manpower permits, only at the employee's overtime ratediscretion, with the approval of the Chief, and shall be forthcoming in a timely manner no different / or his designee. b. No more than any other overtime.two (2) days or an accumulation of sixteen
