Common use of Overtime/Call Back Accumulation Clause in Contracts

Overtime/Call Back Accumulation. a) Where an employee has worked and accumulated approved overtime hours (other than overtime hours related to paid holidays) or has accumulated hours for Call Back up to a maximum of sixty (60) hours, then such employee shall have the option of electing payment at the applicable overtime rate or time off equivalent to the applicable overtime rate (i.e. where applicable rate is one and one-half times, then time off shall be at one and one-half times). b) Time off in lieu may be taken on a mutually agreed upon basis between the employee and the Hospital. Such time off will be equivalent to the premium rate the employee has earned for working overtime. The Employer shall revert to payment of premium rate if time off is not taken within sixty (60) calendar days. Notwithstanding the above, it is understood that the sixty (60) day restriction may be extended by mutual agreement between the supervisor and the employee, however, such extension shall not extend beyond the end of the fiscal year. Lieu time earned within 60 days immediately preceding the fiscal year end may be carried over to the following year. Subject to applicable legislation and the employee providing required documents, the employer will cooperate to have the monies accumulated transferred to an employee’s RRSP. The employee is required to have the appropriate documents completed and returned to the Payroll Department no later than March 1st.
