Participant’s rights and obligations. 3.1 The agreements, representations, warranties and obligations of each Participant under this Agreement (including in its capacity as a member of the Ad Hoc Committee) are several. Failure by a Participant (including in its capacity as a member of the Ad Hoc Committee) to perform its obligations under this Agreement does not affect the obligations of any other Party under this Agreement.
